SUMMARY STATEMENT:
This application is for a liquor license transfer of ownership and dba name change permit for
Wayne L. Sargent dba Kalsin Bay Inn to Wayne T. Sargent dba KBI Spirits#622.The KIB
Assembly may protest an application within a 60-day period.The deadline to lodge a protest
is January 16.
The Clerk's office followed the procedure in KIBC 5.01.030 New license and transfer
procedure and sent out 14 public hearing notices.An email was received from Jamie Brooks
of the State of DOT noting that KBI Spirits does not have authorization from the State to
operate at the airport.
The Assembly decided to postpone this liquor license to a special meeting on January 14,
2016 to solicit more comments regarding this license.Assembly member Crow submitted the
attached resolution for Assembly consideration which opposes the approval of the application
at this time and requests the State of Alaska Alcohol Beverage Control Board postpone a
decision for at least two months and provide a new deadline for the Kodiak Island Borough to
respond.
RECOMMENDED MOTION:
The motion on the floor is to: Move to voice non-protest to the State of Alaska Alcohol
Beverage Control Board for a Liquor License Transfer of Ownership and DBA Name Change
permit Wayne L. Sargent dba Kalsin Bay Inn to Wayne T. S*gent dba KBI Spirits#622.
Move to amend the motion by adopting Resolution No. FY2016-25 opposing the approval of
the application at this time and requests the State of Alaska Alcohol Beverage Control Board
postpone a decision for at least two months and provide a new deadline for the Kodiak Island
Borough to respond.

AS 04.11.520.Notice to Local Goveming Body.
After receipt of an application from within(1)an established village,(2)an incorporated city,(3)
an organized borough,or(4)a unified municipality,the board shall transmit written notice to the
local governing body within 10 days so that the local governing body may protest under AS
04.11.480.
A5 04.11.480.Protest.
(a)A local governing body may protest the issuance,renewal,relocation,or transfer to another
person of a license by sending the board and the applicant a protest and the reasons for the
protest within 60 days of receipt from the board of notice of riling of the application.A protest
received after the 60-day period may not be accepted by the board,and in no event may a
protest cause the board to reconsider an approved renewal,relocation,or transfer.The local
governing body may protest the continued operation of a license during the second year of the
biennial license period by sending the board and the licensee a protest and the reasons for the
protest by January 31 of the second year of the license.The procedures for action on a protest
of continued operation of a license are the same as the procedures for action on a protest of a
renewal application.The board shall consider a protest and testimony received at a hearing
conducted under AS 04;11 510(b)(2)or(4)when it considers the application or continued
operation,and the protest and the record of the hearing conducted under AS 04.11.51_0(b)(2)or
(4)shall be kept as part of the board's permanent record of its review, If an application or
continued operation is protested,the board shall deny the application or continued operation
unless the board finds that the protest is arbitrary,capricious,and unreasonable..
(b)If the permanent residents residing outside of but within two miles of an incorporated city or
an established village wish to protest the issuance,renewal,or transfer of a license within the
city or village,they shall file with the board a petition meeting the requirements of AS 041-11,5110
(b)(3)requesting a public hearing within 30 days of the posting of notice required under S
,y,111,.or by December 31 of the year application is made for renewal of a license.The
board shall consider testimony received at a hearing conducted under AS Qj,11r,j0(b)(3)
when it considers the application,and the record of a hearing conducted under AS 04 A1 510
(b)(3)shall be retained as part of the board's permanent record of its review of the application,
(c)A local governing body may recommend that a license be issued,renewed,relocated,or
transferred with conditions.The board shall consider recommended conditions and testimony
received at a hearing conducted under AS,4.11,510(b)(2)or(4)when it considers the
application or continued operation,and the recommended conditions and the record of the
hearing conducted under AS ;a„0(b)(2)or(4)shall be kept as part of the board's
permanent recons of its review.If the local governing body recommends conditions,the board
shall Impose the recommended conditions unless the board finds that the recommended
conditions are arbitrary,capricious„or unreasonable,If a condition recommended by a local
governing body is Imposed on a licensee,the local governing body shall assume responsibility
for monitoring compliance with the condition,except as otherwise provided by the board.
(d)In addition to the right to protest under(a)of this section,,a local governing body may notify
the board that the local governing body has determined that a licensee has violated a provision
of this title or a condition Imposed on the licensee by the board.Unless the board finds that the
local C(oveming body's determination is arbitrary„capricious„or unreasonable,the board shall
prepare the determination as an accusation against the licensee under AS 440„,,, 0 and
conduct proceedings to resolve the matter as described under AS 04 11 X1.0(c).

It Is declared the policy of the borough to cooperate with and aid the Alcoholic Beverage Control
Board for the state of Alaska in determining the fitness of applicants requesting a transfer,
renewal,or issuance of a new liquor license.[Ord.86-07-0§2, 1986).
5.01.020 Llcenss renewal procedure.
A.Upon receipt of notice from the Alcoholic Beverage Control Board of the board's receipt of
Intent to approve the renewal of a new liquor license:
1.The clerk shall investigate to determine if the borough has an interest which can be
protected by protesting the approval of the application for renewal;and
2.The clerk shall check with the slate troopers on the number of trouble reports at the
place of business.
B.If the clerk determines that the borough has no interest in protesting the renewal,the clerk
shall advise the Alcoholic Beverage Control Board of continued nonobjection to renewal in
writing.If it is determined that the renewal could be protested based on unpaid taxes or trouble
reports,it shall be scheduled for review by the borough assembly.[Ord.86-07-0§2,19861,
6.01.031D Now license and transfer Iprocodure.
A.Upon receipt of notice from the Alcoholic Beverage Control Board of the board's receipt of an
application or intent to approve the transfer or issuance of a new liquor license:
1.The clerk shall investigate to determine if the borough has an interest which can be
protected by protesting the approval of the application for transfer or issuance of a new
liquor license;

2.The clerk shall check with the stale troopers on the number of trouble reports at the
place of business;
3.The cleric shall duly advertise and place the matter of the application upon the agenda
for the next meeting of the assembly in order that citizens may express their desires as to
whether or not the assembly should approve or protest the transfer or issuance of the
liquor license;and
4.The notice of intent to establish a new liquor license or transfer of location of an existing
license shall be mailed to each landowner within 1,500 feet of the proposed location by the
clerk.A transfer from one person to another of a liquor license,even if the location stays
the some,shall be considered a request for a new liquor license by the Kodiak Island
Borough.The applicant shall pay a fee based upon the cost of the notice and application
processing costs to the borough.
B.The assembly,after public hearing,shall determine by motion if a protest to the application is
to be lodged with the Alcoholic Beverage Control Board.If a protest is lodged,the manager and
attorney are authorized to use any document or evidence necessary to effectively advance the
position of the borough at any hearing before the Alcoholic Beverage Control Board..[Ord,

17 WHEREAS, the Assembly received an application from the Slate of Alaska Alcohol Beverage
1a Control Board for a Liquor License Transfer of Ownership, Location, and dba Name Change
19 Permit for Wayne L. Sargent dba Kalsin Bay Inn to Wayne T. Sargent dba KBI Spirits#622, as
20 an agenda item for review in the regular meeting packet posted on December 22,2015;and
21
22 WHEREAS, certain members of the Assembly only realized that this application was unusual
23 and had the potential to impact a larger segment of the population (more than the property
24 owners who were initially notified and who were located within a 1500 foot radius of the affected
25 location-the state airport)during the second week of January 2016;and
26
27 WHEREAS, during the regular Assembly meeting held on January 7, 2016, the Assembly
29 recognized that more citizens would be affected than the initial property owners who were
29 noted;and
30
31 WHEREAS, at that time the Assembly agreed to postpone action on this application for one
32 week to allow additional research, and they scheduled a special meeting to be on January 14,
33 2016 to decide whether or not to oppose this application or whether additional time is needed to
34 make a decision;and
35
36 WHEREAS, during the past week Assembly member enquiries have revealed that many
37 residents have concerns and that additional time is needed for public comment before the
38 Assembly can make a decision;and
39
40 NOW, THEREFORE BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
41 BOROUGH that the Assembly opposes the approval of the application at this time and requests
42 the Stale of Alaska Alcohol Beverage Control Board postpone a decision for at least two months
43 and provide a new deadline for the Kodiak Island Borough Assembly to respond.

45 BE IT FURTHER RESOLVED that the Kodiak Island Borough shall endeavor to advertise this
46 application Borough wide through radio announcements, newspaper ads, posters or bulletins,

We have received a request for transfer of ownership,transfer of location,and DBA name
change for}L I Spiral License 0622 on November 16,2015.The KIB Assembly may protest an
application ithin a 60-day period.The deadline day to lodge a protest is January 16.
The code requires the clerk to ivestigale to determine it the borough has an interest which
can be protected by protesting the approval of the transfer,My initial Investigation resulted In a
recommendation to voice non-protest to this application.Today,I have received ane ail from
Chief Jamie Brooks from the Mate of Alaska Department of Transportation and Public
Facilities noting that K8I Spirits does not have authorization from the Mate to operate at the
airport.The property they want to operate from is leased from Department of Transportation
and Public Facilities to Aviation Acquisition Group.The lease does not authorize operation of
a package store.I have attached Ms.Brooks email to this memo.I have also called and Jett a
message to the applicant,Mr,Wayne Sargent about the neva Information I just received,
Alaska Statutes 04.110.400(C)Protest states that ag local govaming body may recommend
that a license be transferred with conclitions.Based an this provision,the Assembly May
amend the motion to recommend the transfer with conditions that K131 spirit obtain proper
lease authorization to operate a package store at the proposed site/property.I have to note
at If a condition recommended by the Assembly Is Imposed,the local governing body shall
assume responsibility for monitoring compliance with the condition,except as otherwise
provided by the Board.
These are the options available to the Assembly.
Move to amend the motion with condition that the applicant meets proper lease
authorizations to operate a package store at the proposed silo/property.
Fall the motion voicing non protest and adoM the motion below-
Move to voice protest to the Mate of Alaska Alcohol Beverage Control Board for a
[JqUDr License Transfer of Ownership.Transfer of Location.and DBA Name Change

the application for a liquor package store at the Kodiak Airport.KBI Spirits does not have authorization from the State of

After receipt of an application from within(1)an established village,(2)an incorporated city,(3)
an organized borough.at(4)a unified municipality,the board shall transmit written notice to the
local governing body within 10 days so that the local governing body may protest under AS
04.11.480.
AS 04.11.480.Protest.
(a)A local governing body may protest the Issuance,renewal,relocation,or transfer to another
person of a license by sending the board and the applicant a protest and the reasons for the
protest%ithin 60 days of receipt from the board at notice of Illing of the application.A protest
received after the 60-day period may M be accepted by the board,and In no event may a
protest cause the board to reconsider an approved renewal,relocation,or transfer.The local
governing body may protest the continued operation of a license during the second year of the

She advised me that it was entirely appropriate for us to oppose this application for the purpose of
allowing wider notifications and more time for comments from the pubic and that this is routinely
done by other municipalities.She also advised me that thea plication could be opposed by the
assembly for basic reasons,such as done by other municipalities.E.g." e already have enough
liquor stores in this area",etc..
I asked her if it would be appropriate for the Assembly to oppose it simply because many people
have expressed their opposition,and she said that it would be a valid reason.She also advised me
that we could not be sued by an applicant for opposing thea plication.The State approves and
denies requests,we only provide input and feedback.
I have also spoken with numerous people throughout the larger Kodiak Island community and so far
everyone that I've spoken with wasn't aware of the application but when I explained it,they were
opposed.These include people affiliated with village public safety,village leaders and elders,and
airport business owners.Unfortunately none of them was willing to make a public statement for a
variety of valid reasons.I am willing to listen to their concerns and represent them.In order to be
fair I'd like to hear from others before makingy decision.Voting the proposed resolution
buys the public the time they need to effectively review and consider this issue and make
comments.
I'm surprised that some folks feel this isn't an issue that the assembly should be opposing and that
the marijuana issue is;as fundamentally they are both similar in nature.

In the interest of expediting tonight's discussion of the above agenda item, I attach copies of
AS 04.11.340 and 3 AAC 304.180, which address factors relevant to denial of a request for
relocation of a liquor license.
I am opposed to any further delay in the assembly's voting on whether or nor to protest
transfer of ownership and location of the package store license presently held by Wayne L. Sargent.
I will vote in favor of the motion to voice non-protest to the Alaska ABC Board with respect to this
transfer.
Moving the location of this package store license to premises at the Kodiak state airport is
not, to my view, a legitimate reason to protest this transfer or to delay consideration of it. To those
who regard location of a package store license at the airport as sensitive because such a location
might facilitate deliveries to the Kodiak villages, I would point out that AS 04.11.491 sets forth a
procedure whereby a village may prohibit, among other things, the importation of alcoholic
beverages by holding a local option election. So far as 1 know, none have done so.
AS 04.11.470 allows any person to object to an application for transfer of ownership and/or
location of a liquor license by simply "serving upon the applicant and the [ABC] board the reasons
for the objection." Therefore,the assembly's voting to voice non-protest to the instant transfer will
not leave those who aright have legitimate concerns about it with no option.

§04.11.340.Denial of request for relocation
An application requesting approval for the relocation of licensed premises shall be denied if
(1)the board finds, after review of all relevant information, that relocation of the license would
not be in the best interests of the public;
(2)the relocation is prohibited under AS O4.11.400(a)or(b);
(3) the license would be relocated out of the established village, incorporated city, unified
municipality,or population area established under AS O4.11.400(a)within which it is located;
(4)transfer of ownership is to be made concurrently with the relocation of the licensed premises
and a ground for denial of the transfer of ownership under AS 04.11.360 is presented;
(5)the application has not been completed in accordance with AS 04.11.290;
(6)relocation of the license would result in violation of a local zoning law;
(7) relocation of the license would violate the restrictions pertaining to the particular license
imposed by this title;
(8) relocation of the license is prohibited under this title as a result of an election conducted
under AS 04.1 l.507;or
(9)the license was issued under AS O4.11.400(d),(e),or(g).
Alaska Administrative Code
§ 3 AAC 304.180. Denial, suspension, revocation, or refusal to renew or transfer, in the
public interest
(a)The factors the board will,in its discretion,consider in determining whether it is in the public
interest to deny,revoke,suspend,or refuse to renew or transfer a license include
(1)the applicant's,the applicant's affiliates',the transferee's,or the transferee's affiliates'histories
of commission of
(A)an act that constitutes a crime involving moral turpitude;
(B)a violation of AS 04 or regulations adopted by the board;
(C)a violation of the alcoholic beverage control laws of another state,as a licensee of that state;
or
(D) a felony in this state, the United States, or another state or territory during the 10 years
immediately preceding the date of application;

(2)whether the applicant,the applicant's affiliates,the transferee,or the transferee's affiliates are

have permitted, on licensed premises belonging to that person, the occurrence of sexual contact
between persons; for the purpose of this paragraph, "sexual contact" means the touching of
genitals, anus, or female breast or the intrusion of any object into the genital or anal opening
regardless of whether the act was consensual;and
(4)all other factors the board in its discretion determines relevant to the public interest.
(b)The grounds on which a local governing body may properly protest an application under AS
04.11.480 include the grounds set out in(a)of this section.

Regional Leadership Forum,when approximately six representatives from each village are In town
already. The date also had to be on a weekend so that Pat Pitney could be away from Juneau once the
legislature is In session.
Before we begin posting flyers,and publish an ad to announce the event,we would like to Invite the
Kodiak island Borough to participate as a co-sponsor. KANA has generously agreed to reach out to each
of rural Kodiak island-based tribal council to offer lodging and travel sponsorship for tribal
representatives who may already be In town attending the Rural Forum,so that they can stay an extra
night to attend the event. However,given that their funding Is reserved to support Alaska Native
beneficiaries,this does not Include non-Native rural community members,who do participate in the
Rural Forum, We are curious If the Borough would have the ability to sponsor a City Council
representative from each village to attend,which should ensure more broad rural participation. We
estimate this support to be approximately$660($110 for I additional nights lodging x 6 people'.
As the Borough represents the entire island,we thought this opportunity may be one way to help
ensure Island-wide participation In the session. We would list the Kodiak Island Borough as a co-sponsor

As a property tax paying citizen of this community I do not understand how this corporation cannot
afford$660,and why they must come to the KIB.
Don't the native corporations work together to accomplish their goals? None of them have$660 to help
the folks out at Afognak? What did the folks at Afognak do,to try and raise the money?Anything at all?
We are no longer able to conduct business as usual and YOU SHOULD NOT throw money away,no
matter how much is just"LYING AROUND".
