9 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND
10 BOROUGH AMENDING THE 2008 COMPREHENSIVE PLAN BY
11 CHANGING THE FUTURE LAND USE DESIGNATION OF LOT 1,
12 SAWMILL SUBDIVISION FROM OPEN SPACE/RECREATION TO
13 INDUSTRIAULIGHT INDUSTRIAL (P&Z CASE NO. 16-003)

15 WHEREAS, as a second class Borough, the Kodiak Island Borough excercises
16 planning, platting, and land use regulations on an area wide basis pursuant to Chapter
17 29.40 Alaska Statutes; and
18
19 WHEREAS, in accordance with AS 29.40, the Kodiak Island Borough adopted the 2008
20 Comprehensive Plan update on December 6, 2007 (Ordinance No. FY2008-10) to replace
21 the 1968 Comprehensive Plan; and
22
23 WHEREAS, the Kodiak Island Borough has adopted KIBC Title 17 (Zoning) in
24 accordance with AS 29.40 to implement the Kodiak Island Borough Comprehensive Plan;
25 and
26
27 WHEREAS, KIBC 17.205.010 provides that "Whenever the public necessity,
28 convenience, general welfare or good zoning practice requires, the assembly may, by
29 ordinance and after report thereon by the commission and public hearing as required by
30 law, amend, supplement, modify, repeal or otherwise change these regulations and the
31 boundaries of the districts;" and

33 WHEREAS, the Planning and Zoning Commission received a request to amend the
34 2008 Comprehensive Plan by changing the Future Land Use Designation of Lot 1, Sawmill
35 Subdivision; and
36
37 WHEREAS, at an advertised public hearing, consistent with Kodiak Island Borough
38 Code 17.205.040, the Commission considered the merits of the Comprehensive Plan
39 amendment request; and
40
41 WHEREAS, the Commission voted to recommend to the Borough Assembly that the
42 Comprehensive Plan Future Land Use Designation of this lot be changed finding that the
43 public necessity, convenience, general welfare, and good zoning practice would be
44 enhanced by such action; and
45
46 WHEREAS, the Commission hereby recommends that this 'amendment request be
47 reviewed and approved by the Borough Assembly.

50 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
51 BOROUGH that:

53 Section 1: This ordinance is not of a general and permanent nature and shall not
54 become a part of the Kodiak Island Borough Code of Ordinances; and
55
56 Section 2: The 2008 Comprehensive Plan Future Land Use Designation of Lot 1,
57 Sawmill Subdivision is hereby changed from Open Space/Recreation to
58 Industrial/Light Industrial.

60 Section 3: The findings of the Kodiak Island Borough Planning and Zoning
61 Commission are confirmed as follows:'

63 1. The amendment will recognize long standing industrial uses on this site.

65 2. The lot is of sufficient area and provides suitable building sites for industrial use.

67 3. The lot is adjacent to I-Industrial zoned land and uses.

69 4. Adequate buffers between this lot and nearby residential development are
70 established by ordinance and plat restrictions.

72 5. The lot appears to be capable of accommodating the full range of industrial uses
73 without negatively impacting the surrounding area. The I-Industrial zoning
74 performance standards (KIBC 17.105.060) should further ensure that there are no
75 negative impacts with future industrial development.

77 6. The amendment is consistent with various objectives of the adopted 2008
78 Comprehensive Plan and will facilitate a rezone that will further implement those
79 objectives.

81 7. The Planning and Zoning Commission recommends that the Borough Assembly
82 approve this Comprehensive Plan amendment.
