Findings as to the Need and Justification for a Change or Amendment. A rezone from R3 --Multifamily Residential to R1--Single-Family Residential is neither needed nor justified because the R3 --Multifamily Residential Zoning District permits development that: A. is consistent with the comprehensive plan; B. can be suitable for the existing lots, given the prevailing lot sizes, widths and placement of existing structures, if each request for higher density development is fairly evaluated and appropriate conditions are required to mitigate any potential adverse impacts; C. will not create any non -conforming land uses on the nineteen (19) lots in the block. The 1968 Comprehensive Plan shows this block as a transition zone with designations for both Medium and High Density Residential Development. The zoning of Block 5, Leite Addition as R3 --Multifamily Residential has, in effect, determined this area to be a High Density Residential area. This designation clarifies the Comprehensive Plan's "split designation." Due to the current zoning, it would be inconsistent for the Commission to downzone the area when it appears to be showing signs of redevelopment to the prescribed density. Denial of a recommendation to rezone Block 5, Leite Addition is therefore consistent with the objectives of the Comprehensive Plan. COtatfISSIONER KNUDSEN MOVED TO, GRANT preliminary approval of the subdivision of Lot 18, Holland Acres Subdivision First Addition to Lots 18-1 and 18-2, subject to the conditions of approval contained in the memorandum from the Borough Engineer dated October 12, 1988. The motion was seconded. A discussion ensued among the Commissioners, with input from Community Development Department staff, regarding screening. The consensus of the Commission was to add the following to condition number three (3) as a FRIENDLY AMENDMENT: "A screening plan must also be submitted and reviewed by staff, with staff to make a recommendation for appropriate screening for approval by the Commission, in accordance with Borough Code Section 17.21.050(C): 'Screening. 'Where a business use is adjacent to a residential use or district, that business shall provide and maintain screening as approved by the Planning and Zoning Commission.'' The question was called and the mot'on CARRIED by unanimous roll call vote. CONDITIONS OF APPROVAL 1. The applicant must terminate the existing water service between the business and the duplex, and install a new water service for Lot 1B-1 (duplex) before submission of the final plat. 2. The shed located along the rear lot line must be relocated to conform with the five-foot rear and side yard setback requirements for accessory buildings. 3. A parking plan consisting of three spaces for the business on proposed Lot 1B-2 must be submitted to and approved by the Community Development Department prior to the filing of the final plat. The item is specifically related to the permitted use of apartments, hotels, and motels in the B --Business Zoning District when no public sewer and water is available. (Referred to the Commission by the Kodiak Island Borough Assembly) LINDA FREED noted that a new memorandum and a draft ordinance had been prepared based on the Commission's comments at the packet review worksession and were included with the additional handouts for this meeting. JOHN FINLEY appeared before the Commission and expressed support for the draft ordinance. STEVEN PENN appeared before .the Commission and expressed support for the draft ordinance. A discussion ensued among the Commissioners, with input from Community Development Department staff, and DAVE HEUMAN, regarding the issues surrounding this item. Staff compiled a report of the existing land uses and conditions on Block 5, Leite Addition for review by the Commission at the regular meeting of August 17, 1988. The Commission decided at the August 17th meeting that it would hear public input only and that final disposition of the case would be tabled until the regular meeting on September 21, 1988. At the Regular Meeting of September 21, 1988, the Commission heard further testimony from the public prior to making a decision. The Commission denied the recommendation to rezone Block 5, Leite Addition. Staff was directed to prepare findings of fact for this case for presentation at the Commissions October 19, 1988 Regular Meeting. APPROPRIATE MOTION: Move to adopt the findings for Case 88-045, the rezoning of Block 5, Leite Addition, including all lots therein, from R3 --Multifamily Residential to R1--Single-Family Residential in accordance with Section 17.72 of the Borough Code as contained in the Memorandum dated September 22, 1988 as "Findings of Fact" for this case. Mr. Bonney stated that he was in favor of having a R1 neighborhood on the small lots in the area, against the higher density on these small lots, but that he did not want to impact the R2 uses already existent on the larger lots in the area. Mr. Bonney stated that lots of 6,000 square feet are too small for R2 or R3 developments. IAN SCHOLZ reappeared before the Commission and expressed opposition to this request. Mr. Scholz noted that he purchased his property knowing that it was zoned for R3 development, that there was a need to keep the options open in this area, and that multifamily dwellings were already present in the area. THERESA BONNEY reappeared before the Commission and asked if just the substandard lots could be rezoned to R1. CHAIRMAN RENNELL noted that it was possible to rezone that area. The motion was seconded. A discussion ensued among the Commissioners regarding the pros and cons of rezoning this area. The Commission noted that there were a lot of good reasons to rezone to. R1, however for those who had bought property in the area knowing it was zoned R3 there were reasons to leave the zoning as it is. The Commission also noted that only four existent lots could be developed as R3 under the present Zoning Code. The question was called and the motion FAILED by unanimous roll call vote, Commissioners Hartt, Heinrichs, Hendel, Knudsen, Rennell, and Thompson voted "no." The consensus of the Commission was to defer findings of fact until the next regular meeting. B) Case 88-051. Request for a variance from Section 17.20.040 (Yards) of the Borough Code to permit a seven and one-half by nine (7.5 x 9) foot enclosed stairwell addition onto the existing women's shelter to project three and one-half (3.5) feet into the required twenty-five (25) foot front yard setback in a R3 --Multifamily Residential Zoning District on Lots 13 and 14, Block 14, Aleutian Homes Subdivision; 422 Hillside Road. (Kodiak Women's Resource and Crisis Center) DUANE DVORAK indicated 45 public hearing notices were mailed for this case and none were returned. Staff recommended approval of this request. In addition, the outdoor storage of fishing gear may also increase the potential for infestations of rodents, insects and other disease carrying pests. B. Will not be inconsistent with the general purposes and intent of this title The proposed use will be inconsistent with the general purposes and intent of Title 17, the specific description and intent of Chapter 17.17, the RR1--Rural Residential One Zoning District, and the 1982 Womens Bay Community Plan. Section 17.03.080 of the Borough Code specifies that uses not listed as a permitted use are prohibited. Outdoor storage is not listed as a permitted use in the RR1--Rural Residential One Zoning District. Additionally, Section 17.17.010(B), the Description and Intent of the RR1--Rural Residential One Zoning District is "To prohibit commercial and industrial land uses." In the 1982 Womens Bay Community Plan the section on Future Land Use states: "Future land usage in the' existing community will consist of large lot single family residential on both sides of Russian Creek. The community has expressed the goal of keeping the area as rural residential in nature." The applicant's exception request is for a commercial land use and therefore is inconsistent with the 1982 Womens Bay Community Plan. One appropriate alternative to an exception would be to first request an amendment to the Womens Bay Community Plan and if successful, apply for rezoning of the lot. C. Will not adversely impact other properties or uses in the neighborhood. The proposed use could potentially have adverse impacts on other properties in the area. In addition to the land use conflicts between commercial and residential uses (inherent incompatibility of outdoor storage next to residential properties), granting this exception will set a precedent for changing the expected use and lifestyle (i.e., large lot, low density, single-family residential) of the RR1--Rural Residential One Zoning District. This exception would also set a precedent for other gear storage requests on property zoned for residential purposes. C) Case 88-045. Now,when we bought our home which is located in this block,we were told that it is an R3, has potentials for growth as far as the structure(building) and the houses that were built in the block were mostly a two story frame house with an unfinished basement. This was done to allow for the owners or prospective owners to build the lower portion of the structure to whatever suits the needs of the people that were buying in this particular subdivision. On june of this year,we requested a variance(casel788-037)to build downstairs to allow for an small apartment for use of some of the members of my family (note that I have a big family) my mother and sister in law included. Please note that being an R3 zoning was our main reason for buying in that particular area for it would allow us to build as we had planned, but the variance was denied not for being in an unconformed lot, but due to oppositions of the few who saw this whole situation only one sided -to their benefit and the people from planning and zoning went along with them and voted against the vaiance that I had sought for. To have the zoning changed just to satisfy these elite group would be prejudicial on the rights of others especially of those who bought property in the area, with hopes that someday they will be able to build and satisfy their needs for'duplexes. The very fact is to date this area is an R3 and should remain so, and if anyone should care to look a little closer, they will find that the area in the general vici- nity of the subdivision in question is already got duplexes and tri- plexes erected and has been in place for so many years. It also a fact that less than one hundred yards to the north of my property are Apartments & Duplexes along mission road. What is the Borough(P b Z) going to do should the Zoning in these areas change? Are we going to ask the owners of those buildings and houses to Tear then down so as to conform with the new Zoning? BACKGROUND The investigation of the possible rezone of Block 5, Leite Addition from R3 --Multifamily Residential to R1--Single-Family Residential, was initiated by the Planning and Zoning Commission at the regular meeting of July 20, 1986. Staff compiled a report of the existing land uses and conditions on Block 5, Leite Addition for review by the Commission at the regular meeting of August 17, 1988. The Commission decided at the August 17th meeting that it would hear public input only and that final disposition of the case would be tabled until the regular meeting on September 21, 1988. RECOMMENDATION The Commission has heard public testimony both for and against the possible rezoning of Block 5, Leite Addition from R3 --Multifamily Residential to R1--Single-Family Residential. Primarily due to the substandard sizes of the majority of lots that make up Block 5, Leite Addition, staff has recommended that the Commission forward this rezone request to the assembly with its own recommendation for approval. Case 88-045 Page 1 of 2 P&Z: September 21, 1988 ITEM VI -A APPROPRIATE MOTION: Should the Commission agree with the staff recommendation, the appropriate motion is: Move to recommend that the Kodiak Island Borough Assembly approve the rezoning of Block 5, Leite Addition, including all lots therein, from R3 --Multifamily Residential to R1--Single-Family Residential in accordance with Section 17.72 of the Borough Code and to adopt the findings contained in the staff report dated September 7, 1988 as "Findings of Fact" for this case. FINDINGS OF FACT Section 17.72.020 states that the Commission shall incorporate the following criteria into their report to the Assembly: 1. Findings as to the Need and Justification for a Change or Amendment. A rezone from R3 --Multifamily Residential to R1--Single-Family Residential is needed and justified because the R1--Single-Family Zoning District permits development that: A. is consistent with the comprehensive plan; B. is suitable for the existing lots given the prevailing lot sizes, widths and placement of existing structures; C. will create only two (2) non conforming land uses on the nineteen (19) lots in the block. 2. Findings as to the Effect a Change or Amendment would have on the Objectives of the Comprehensive Plan. The 1968 Comprehensive Plan depicts this block as a transition zone containing designations for both Medium and High Density Residential Development. Due to the existing development and the predominantly nonconforming lot sizes, this proposed rezoning is generally consistent with the objectives of the comprehensive plan. Now,when we bought our home which is located in this block,we were told that it is an R3, has potentials for growth as far as the structure(building) and the houses that were built in the block were mostly a two story frame house with an unfinished basement. This was done to allow for the owner's or prospective owners lo Mar— the the lower portion of the structure to whatever suits the needs of the people that were buying in this particular subdivision. On June of this year,we requested a variance(casei88-037)to build downstairs to allow for an small apartment for use of some of the members of my family (note that I have a big family) my mother and sister in law included. Please note that being an R3 zoning was our main reason for buying in that particular area for it would allow us to build as we had planned, but the variance was denied not for being in an unconformed lot, but due to oppositions of the few who saw this whole situation only one sided -to their benefit and the p rople from planning and zoning went along with them and voted against the vaiance that I had sought for. To have the zoning changed just to satisfy these elite group would be prejudicial on the rights of others especially of those who bought property in the area, with hopes that someday they will be able to build and satisfy their needs for duplexes. The very fact is to date this area is an R3 and should remain so, and if anyone should care to look a little closer, they will find that the area in the general vici- nity of the subdivision in question is already got duplexes and tri- plexes erected and has been in place for so many years. It is also a fact that less than one hundred yards to the north of my property are Apartments & Duplexes along mission road. What is the Borough(P & Z) going to do should the Zoning in these areas change? Are we going to ask the owners of those buildings and houses to Tear them down? so as to conform with the new Zoning? I'd really like what the opposition has to say about that! I have utilized the property in the past as a duplex, and intend to sell it as a duplex. Rezoning would create problems for me in the sale of the property. I can appreciate the commission's concern about adjacent properties. In particular, I am aware and participated in the discussions concerning the development by the Assembly of God of their properties. I believe the record clearly states that their development was to ne iimited to single family homes due to the size of their lots. By comparison, I have two lots and a total of 10,000 square feet in my property. If the commission decides favorably on the rezoning, I would ask that my property be deleted from the change. I believe preceaent exists in the area as a similar circumstance occurred with the Zimmer development in the next block of the Leite Addition. As I have stated in the past when these lots in the Leite Addition have come before you for consideration for use as multifamily dwellings, I am apposed to there use for anything more than single family. With this in mind, I wish to go on the record as supporting this change from R-3 to R-1 for the lots in this block. If you allow this for the entire Leite properties in Kodiak case to pass as planned it will be a plus Addition as this portion of the zoning now contain enough multifamily dwellings. When continued use of existing nonconforming lots (due to size) for multifamily is allowed the areas close to them become over crowded and there is no room left after parking is taken into consideration for the property owner to improve the appearance of the yard. This does nothing for the price structure of the neighborhood when considering the loan, resale, or tax value of the block in question. The effect for the complete area is also apparent when an owner wishes to sell to someone else, as the prospective owner must pass by this area to get to the property that is for sale, or wanders around the area to see if they want to purchase in that area and then sees a gravel pit instead of a groomed yard. Where this is not feasible, onsite facilities shall be designed so as not to cause conditions that will pollute rivers, lakes, and other water bodies, including the ground water supply. Consistent: Yes. The lot is served by public sewer. 2. Open Space Green areas and open space shall be retained to the maximum extent feasible and prudent when land is subdivided. Consistent: Not applicable. This action does not involve land subdivision. COMMENTS: The purpose of this request is to rezone the nineteen lots comprising Block 5, Leite Addition, from R3 --Multifamily Residential to R1--Single-Family Residential. The block is bounded by Mission Road on the north, Delarof Avenue on the east, Kouskov Street on the south, and Spruce Avenue on the west side. As proposed, of the property that will be rezoned to R1--Single-Family Residential, two (2) multifamily residences will become nonconforming uses. The rezoning will not allow future high density development on two lots (Lot 2A, and Lots 15 and 16) which meet the minimum lot size requirement. In addition, fifteen (15) of the lots to be zoned Al will continue to be nonconforming lots of record that cannot be used for anything other than single-family residences under the current code. Issues to be considered in evaluating this rezone include conformance with the comprehensive plan, land suitability, compatibility with existing and potential land uses, and status of existing land uses. COMPATIBILITY WITH EXISTING AND POTENTIAL LAND USES The proposed rezoning to R1--Single-Family Residential would be compatible with the seventeen (17) existing single-family dwellings in the Block. Since a majority of the Lots that make up Block 5, Leite Addition, are nonconforming lots of record due to insufficient size and width, it is doubtful whether these properties have the potential to ever be fully developed to multifamily density. The proposed R1--Single-Family Residential Zoning District is consistent Case 88-045 4 of 7 P&Z: August 17, 1988 ITEM VI -C with the comprehensive plan concerning the west half of Block 5. The R1--Single-Family Residential Zoning District is not consistent with the comprehensive plan regarding the east half of Block 5 which indicates High Density Residential Development. Since this block is shown as a transition zone, one could argue that the block as a whole could be either Medium or High density and be generally consistent with the comprehensive plan. According to the comprehensive plan, the proposed R1--Single-Family Residential zoning District is considered Medium Density Residential Development as is the R2--Two-Family Residential Zoning District. The existing R3 --Multifamily Residential Zoning District is consistent with the comprehensive plan definition of High Density Development. The definitions of Medium Density Residential Development also specify the development should occur on lots over 7,200 square feet in area. Since over seventy-five percent (75%) of the lots do not meet this criteria for minimum lot area they may be considered to be unsuitable for development at a greater density than R1--Single-Family Residential. STATUS OF EXISTING LAND USES As previously noted, seventeen (17) of the lots that make up Block 5, Leite Addition, are currently developed with single-family dwellings. Only two (2) lots have uses that would become nonconforming if the zoning district was changed to R1--Single-Family Residential. While the rezoning would not adversely affect the majority of the lots in Block 5, Leite Addition, the two lots that would become nonconforming uses are at present conforming uses under the current code. The rezoning would also limit the future development of two of the lots at the currently permitted higher density. LAND SUITABILITY The east end of Block 5, Leite Addition, is fairly flat and slopes away from Mission Road to the south. The west end of Block 5, Leite Addition, has a more pronounced drop from the grade at Mission Road and also slopes to the south. The topography alone would not inhibit any kind of development from consideration at this location. Individual lot sizes range from 1,300 to 8,971 square feet, with an average lot size of 6,382 square feet. Lot widths range from 50 to 110 feet of road frontage. Only the corner lots have more frontage, with lot depths of about 120 feet. These lot sizes and widths are not generally suitable for development for High Density Residential Development. The small size of the lots would make it difficult to provide for multifamily structures and adequate off-street parking. The inability to provide adequate off-street parking reduces the suitability of these lots for High Density Residential Development. SUMMARY In conclusion, staff views Block 5, Leite Addition, as an area that is appropriate for the proposed R1--Single-Family Residential Zoning Case BB -045 5 of 7 P&Z: August 17, 1988 ITEM VI -C District. This perception is based on the following points that were revealed by the investigation: 1. The R1--Single-Family Residential Zoning District generally conforms with the Medium Density Residential designation of the comprehensive plan. 2. The land is not suitable, given the present pattern of land ownership, for High Density Residential Development. With the small lots available, it would be difficult to develop a multifamily dwelling and adequate parking area. 3. A majority of the lots will be conforming land uses if zoned R1--Single-Family Residential (about 75%). Only two (2) of the nineteen (19) lots that make up Block 5, Leite Addition will become nonconforming uses. FINDINGS OF FACT Section 17.72.020 states that the Commission shall incorporate the following criteria into their report to the Assembly: 1. Findings as to the Need and Justification for a Change or Amendment. A rezone from R3 --Multifamily Residential to R1--Single-Family Residential is needed and justified because the R1--Single-Family Residential Zoning District permits development that: A. is consistent with the comprehensive plan; B. is suitable for the existing lots given the prevailing lot sizes, widths and placement of existing structures; C. will create only two (2) non conforming land use of the nineteen (19) lots in the block. 2. Findings as to the Effect a Change or Amendment would have on the Objectives of the Comprehensive Plan. The 1968 Comprehensive Plan depicts this block as a transition zone for both Medium and High Density Residential Development. Due to the existing development and the predominantly nonconforming lots sizes, staff views this proposed rezoning as generally consistent with the objectives of the comprehensive plan. RECOMMENDATION: Staff finds that this rezone request meets all the required findings and therefore recommends that the Commission forward this rezone request to the Borough Assembly recommending approval.
