WHEREAS, ALASKA STATUTES 29,33.090 empowers the Borough to enact a Zoning Ordinance and provide for its administration, enforcement and amendment, and WHEREAS, the Kodiak Island Borough has pursuant thereto adopted Chapter 5 of its Code of Ordinances and Resolutions which provided for planning and zoning provisions and procedures and WHEREAS, according to the Comprehensive Planning and Zoning Map adopted by the Kodiak Island Borough, Lots 48, 49, and 50, Block 19, Kodiak Townsite, has been zoned R-3 and, WHEREAS, a petition has been received from RUSSELL WELBORN requesting same be rezoned from R-3 to Commercial for further development of the area, and WHEREAS, the Petition was considered and approved by the Planning and Zoning Commission on the 23rd day of February, 1974, after a public hearing was held thereon and said body has re recommended the reclassification of said property to Commercial and no objections were voiced at the public hearing; it having been determined that the public necessity, convenience and good zoning practice require such. reclassification, ' NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly of the Kodiak Island Borough that the property described as: Lots 48, 49, and 50, Block 19, Kodiak Townsite, Be and the samearehereby reclassified as Commercial and that notice of this Ordinance be given by publication in the Kodiak Mirror seven (7) days prior to the second reading and that a public hearing be held thereon the date of the second reading and that this Ordinance become effective at expiration of thirty (30) days after its adoption. Mrs. Saupe stated that the extended care unit is for people who have a physical condition who need professional care. Mr. Murray explained the difference between an extended care unit and a Pioneer's home. Sister Claire stated that within two years, they would probably have the twenty bed unit filled. Mrs. Strigga stated that she feels there is a need for an extended care unit. Mr. Powell closed the public hearing and reconvened the regular meeting. Mrs. Holt stated that she did not want to bid for the architect if they were not going to expend money. Mrs. Wallin moved that her motion be withdrawn with concurrence of the second. It was noted that this project was started in 1972. The question is expenditure of local funds along with the state. Mr. Schneider statedthat-the building costs two years ago would be $220,000.00, just for the building alone. Mrs. Wallingwould like the Kodiak Island Borough .to advertize for an architect to do a cost analysis and work up the plans. Mr. Nelson seconded the motion. Mr. Wood suggested that we should renegotiate a contract with the hospital. Mr. Nelson would like to amend the motion made by Mrs. Wallin, to amend'work up the plans" , seconded by Mrs. Wallin. Motion passed by unanimous roll call vote. Mr. Nelson moved we direct the Borough Chairman to re -negotiate the contract with the Kodiak Island Hospital. Seconded by Mrs. Wallin. Mr. Nelson moved that the Borough Chairman investigate the projected daily operational expenses and also to determine the potential income for the proposed unit. Seconded by Mrs. Wallin. Memo from Borough Clerk on Kenneth Beemer Lot - Mrs. Holt read the Memo stating that Mr. Beemer came in and picked up a building permit and fine was paid due to late filing. Mr. Powell notedthat it appeared the Beemer case was closed. B. Opinion from Borough Attorney on Paving of Cutoff Road - The Bcrowh Attorney's opinion is that the Kodiak Borough could not legally allocate funds for this paving. Mr. Wood would like to take three trips and he would like the Assembly's concurrence. Mr. Nelson voiced no objection to the use of funds from Assembly Travel Account. Mr. Nelson felt that we should be judicious in what we attend. Mr. Brechan stated that in the past we have had to review written reports and suggested requirement after attendence at such meetings. The Assembly concurred. B. Mr. Wood feels that it was good that we attended the village meeting and give them advise. X ASSEMBLY CONMENTS A. Mr. Nelson stated that the new High School building leaks and what is being done about.it. Mrs. Holt stated that she talked with Rolland Jones and that they have sent someone over with caulking to fix the leaks and that they will be replacing the tiles. B. Mr. Nelson feels that the Borough Assembly should attend the School Board budget review meeting tomorrow, set for 3:30_in the -School Library. He also asked about the removal of the. .trailers around the'new high School Mr. Powell stated that Ken Brad isworking out a deal with the Kodiak Jaycees to give them the trailers through a State grant. In order for them to sell the lot and have it FHA approved, they must sell it as a duplex. Mrs Holt suggested that P&Z consider rezoning the entire block. The motion was seconded by Mr. Erwin. I have again reviewed the Zoning Ordinance as it per- tains to business zoning and I cannot find where there is specific zoning for specific business. My reason for rezoning the- property is as stated in my letter of November 20th "I believe that a Business use would be more adaptable to these lots”. I am in the final stages of dressing up and closing down the quarry that is directly behind these lots. This is being done under the supervision of the City Engineer and the U. S. Bureau of Mines. When the proj- ect is completed the above referenced lots will be safe from falling rock and completely useable. At that time I will probably want to dispose of the lots. As they are now zoned (Residential R-3) the lots are not, in my opinion desireable for use as zoned. The property ac.cross the street is zoned Industrial (used by fish processors); the property joining these lots on the North and West is the City of Kodiak Watershed Survey. The only sub -divided lot that joins this property is zoned R-3 and does have an Apartment house on it. This apartment house is on the last useable lot for R-3 in my opinion. With the apartment house next door I am sure that my prop- erty would not be suitable for Industrial (especially fish) nor is it suitable for residential, I feel that allsprivately owned property within the Bor- ough should be useable and marketableif it is taxable. Mrs. Holt stated that the subdivi'ers are required to . put up .a bond to insure that the access'.roed will be put in. Mrs. Gellis stated that we should approve this preliminary subdivision with the stipulation that the subdivider put up a bond for the proposed access road. There was some question an the legality of the accessroad to the back two lots of :the subdivision. Mr. Jones stated that this was a dedicated road ,and could serve as an access to the two (2) lots. P&Z..::felt that ' it could not serve, as an ,access road. /hey believed that the .subdivider has to physically put an access road to -connect to all lots. Mr. Terry asked to have a legal interpretationof the law on the subdivision access of lots. Mrs. Gellis made a motion to table the subdivision. Motion died for lack Of second. These lots are adjacent the Base -Town highway just beyond the Rezonoff Apartments and directly in front of the Quarry operation now in progress.
