Box 1161 Kodiak, AK 99615 Dear Mrs. Omlid: We have received a complaint concerning an accessory building on part of Lot 18, Block 2, Leite Addition, which reportedly belongs to you, and may be encroaching on another person's property. The Kodiak Island Borough cannot enter,An to the possible tres- pass of your accessory building on another's property becuase that is a civil matter. We are responsible for enforcement of the zoning ordinances and the health, safety, and public welfare con- cerns contained in them. Please be advised that you appear to be in violation of the fol- lowing sections of Borough Code: 1. Section 17.03.06. A building permit is required for the erection of a building. Neither the Borough or the City of Kodiak have any record of a building permit being issued for the accessory building located next to your residence. 2. Section 17.45.010 (D). Accessory building cannot be located closer than five feet to a side or rear property line. The acces- sory building in question does not comply with these yard require- ments. The question of adequate access for fire fighting equipment has been raised by the Fire Department and they should be contacting you on that matter. Be advised that the Boroughpassed Ordinance Number 80-24-0 on June 5, 1980. That Ordinance "grandfatheree or forgave all zon- ing violations which were in existence on that date. To resolve the code violations cited above we need to receive, within ten days of your receipt of this letter, proof that the accessory building existed before June 5, 1980.
