In response to your request, the Planning and Zoning Commission
has reviewed your expressed desire'to .di.vide the. above described
parcels for.the_purpose of selling a.portion of -same.
We have -conferred with counsel .on the technicality of the matter
and have been advised that you certainly have the right to dispose
of the property utilizing a metes and .bounds description for the
purpose of the transaction, however, since that particular tech-
nique may .produce =a.questionable title for. the buyer, we .wish to
make you aware of the fact that Chapter 16, Section 16.18.020 of
the Borough. Subdivision regulation requires that ultimately a .plat
must: be sub6i tted that complies with the. minimum of final plat
requirements.

Request for Additional Use. The Chair opened the public hearing for the
McBride request for additional use. Lorna Arndt voiced opposition to the
request. 'it'. Denslow inquired as to the presently existent environmental
conditions. He stated the i3orough Assembly has awarded a contract for the
study of the water and sewer probeirn in this area which whould be taken into
consideration. iAr. McBride spoke in his own behalf stating that the sewer and
rainage problem has been taken care of. Mr. Ogg asked that it be placed in
the minutes that it would be desirable for ,Mr. ;:•icbride to request a home occupa-
"Uon instead of additional use when it comes before the P 8 Z again for another
public hearing. The secretary was instructed to reschedule and readvertise

A; Placement of Advertis.ing Sign ('William Fearn) Laot 11A, Block 7, Hells Flats
Subdivison. No action was taken with the recommendation that Mr. Fearn in-
vestigate the ownership of the property and Its description then bring the informa-
tion to the attention of Mr. Denslow so he can look into this matter,
B" Request for Variance (Guyneth Cessna) Lots 5 and 6, Block 3, Allman Addition.
After Inspection by the building official itrs, Cessna was informed that she does not
need a variance and is In fact within the law. :!r. ';Williams moved this item be
'referred to the building inspector. Seconded by ?tr. Brenteson. Motion carried
by unanimous voice vote.
C: Request for Variance and Repiat (Vincent and nary Root) Tract "1", USS 3218.
Ar. Denslow explained the property Is being divided into separate parcels. .ir.
Busch moved to approve the request. Seconded by ,;Mr. Heglin. There was
itn, ; t .discussion of the desirability of creating an irregular lot of less than 20,000
•square feet. The motion passed by a vote of 4 to 3 with Mr. Ogg, 'itr. Busch and
r1r. Hayden casting i40 votes.
D.' Request for Variance (Carl Huer) Lot 3, Block 3, Leite Addition and Lot 11,.
Urdahl Subdivision. Mr. Denslow stated this is a somewhat complex legal
situation and should be referred to counsel for clarification of Article 16.28.020.
Mr. Heglin moved to refer this matter to counsel for clarification. Seconded by
Mr. Brenteson. Motion passed by unanimous voice vote.
E. Request for Vacation and Repiat (L. P. Martin and F. P. Moore) Lots 4A and 5A
Block 9, New Kodiak Subdivision. Mr. Busch moved that the Commission approve
{vacation and replat of Lots 4A and SA, Block 9, New Kodiak Subdivison. Seconded
by Mr. Ogg. r'Motion passed by a unanimous roll call vote.
yF, Request for Rezoning from Unclassified to INdustrial (Russell J. Welborn)
k: Tract S-4, USS 3218. Cover letter was read into the minutes by request of
dr. Williams. Mr. Ogg moved to schedule a public hearing on the request for
rezoning from unclassified to industrial by Russell J. Welborn, Seconded by
fMr. Busch. :.lotion passed unanimous voice vote.

G. Request for Rezoning from Unclassified to f3usiness (Art Zimmer and Property
.Owners) USS 3218 and USS 3463. 'Ar. Busch moved to schedule a public hearing
for this petition at the October 20 meeting. Seconded by Mr. Heglin. Mr. Ogg
asked (1) what does the present Comprehensive Pian do with this area of real
estate? (2) what type of traffic situation will we run into? Lir. Oenslow asked
that the date be deleted from the motion to allow time for research. Agreed.
Motion carried by unanimous voice vote.
