MINUTES - April 20, 1983 Mrs. Crowe moved to accept the April 20, 1983 mintues as prepared. Seconded by Mrs. Strickert. Motion PASSED by unanimous voice vote. Mr. Hill on the agenda this evening the order will be as follows: item 1114 will be heard before item 119 and item 816 will be deleted altogether. 2. APPEARANCE REQUESTS WITH PRIOR NOTICE AND AUDIENCE COMMENTS A. Russell Welborn 1 would like to place a temporary 100 person construction camp on my lot on Mill Bay Road. Mrs. Crowe would the building meet City Building Codes? Mr. Briggs what are your plans for the building after the construction boom? Russell Welborn they would be removed. P Mrs. Strickert 1 think the Commission should look into this as we are going to have nore and more requests of this nature in industrial zoned areas. Mrs. Crowe what about efficiency apartments? Discussion between the Commission members on what to do with this request. The reasons for denial where the staff's two points and the comments from myself, Mrs. Crowe and Mr. James. _ 5.- PUBLIC NEARING ON CASE 83-046. A request for a conditional use permit to operate'a day care center for 27 children in a single family home on Lot 5, Block 1, Leite Addition. (Joan Newland) Mr. Hill closed the regular meeting and opened the public hearing. Hearing no comments the public hearing was closed and the regular meeting reopened. Mrs. Crowe only 6 public hearing notices returned? n yes. Mr. Hill I would be more comfortable with this if it was for only 10 children, and I think there would be a traffic problem in this area. Mr. Pennell anything over 10 children would be considered a business instead of a home occupation in my opinion. (Jim Torgramsen) • 22 PUBLIC HEARING NOTICES MAILED ON MAY 6, 1983 GENERAL INFORMATION 1. Applicant - Jim Torgramsen Box 115 Kodiak, Alaska 99615 2. Status of Applicant - owner. 3. Requested Action - variance to Section 17.18.050(A) front yard. 4. Purpose - To allow the relocation of a 192 square foot accessory building within 10 feet of the front lot line and 5 feet to the side lot line. 5. Existing Zoning - R1 -Single Family Residential. 6. Zoning History - In December of 1976 a request was made to rezone this property from R1 to R2. The request was denied by the Kodiak Island Borough Assembly at its January 14, 1977 public hearing. (Case Z -415-A) Also in July of 1981 Lot 6 was granted a variance to allow a 40 square foot reduction in the minimum lot size by the Planning and Zoning Commission. (Case Z-81-018) City of Kodiak Building Permit #5034 was issued to Mr. Torgramsen on March 30, 1983 to allow the placement of the accessory build- ing under consideration on Lot 6. Case 83-042 Page 2 May -11, 1983 7. Location - 1520 Ismalov Street in Leite Addition between Rezanoff Drive and Mission Road, approximately 4 blocks from Baranof Park. 8. Size - 7,027 square feet. 9. Existing Land Use - A 1,209 square foot single family residence exists on Lot 6 and is used by the Torgramsen family as their residence. Also present is the 192 square foot accessory build- ing under consideration for this variance request. 10. Surrounding Land Use and Zoning - North - Single Family Residences & R1 South - Single Family Residences & R1 East - Single Family Residences & R1 West - Single Family Residences & R1 11. Comprehensive Plan - This property is identified by the Comprehensive Plan as Medium Density Residential. 12. Applicable Regulations - 17.18.050(A) front yard; 17.66.090 through 17.66.170 variances and A.S. 29.33.110(3)C. COMMENTS Mr. Torgramsen's request stems from his desire to relocate his accessory building within 10 feet of the front property line to allaw easier access to the structure. The following conditions must also be considered by the Commission prior to the granting of a variance: 1. That there are exceptional physical circumstances or conditions applicable to the property or to its intended use or development which do not apply generally to the other properties in the same land use district; 2. That the strict application of the provisions of this title would result in practical difficulties or unnecessary hardship; 3. That the granting of the variance will not result in material damage or prejudice to other properties in the vicinity nor de detrimental to the public health, safety or welfare; and 4. That the granting of the variance will not be con- trary to the objectives of the comprehensive plan. Staff finds that granting this request will not result in material damage or prejudice to other properties in the area nor be detrimental to the public's health, safety or welfare. Staff also finds that the approval of this request will not be contrary to the objectives of the Comprehensive Plan.
