(Jim Torgramsen) 22 PUBLIC HEARING NOTICES MAILED ON JUNE 3, 1983 GENERAL INFORMATION 1. Applicant.- Mr. James Torgramsen Box 115 Kodiak, Alaska 99615 2. Owner - Same 3. Requested Action -. Front yard variance. 4. Purpose - To allow the construction of a 16' x 20' garage to be attached to an existing accessory building, both structures to be located within 10 feet of the front property line. 5. Existing Zoning - R1 -Single Family. 6. History - In December of 1976 a request was made to rezone this property from R1 to R2. The request was denied by the Kodiak Island Borough Assembly at its January 14, 1977 public hearing. (Case Z -415-A) Also in July of 1981 Lot 6 was granted a variance to allow a 40 square foot reduction in the minimum lot size by the Planning and Zoning Commission. (Case Z-81-018) City of Kodiak Building Permit #5034 was issued to Mr. Torgramsen on March 30, 1983 to allow the placement of an accessory building on Lot 6. Case 83-066: June 8, 1983 Page 2 On May 18,.1983 the Planning and Zoning Commission denied a request for a variance to allow the placement of the accessory building covered by permit #5034 to be located within 10 feet of the front property line. (Case 83-042) 7. Location - 1320 Ismailov Street. 8. Lot Size - 7,027 square feet. 9. Existing Land Use - A 1,209 square foot single family residence exists on Lot.6 and is used by the Torgramsen family as their residence. Also present is a 192 square foot accessory building. 10. Surrounding Land Use and Zoning - North - Single Family and R1 South - Single Family and R1 East - Single Family and R1 West - Single Family and R1 11. Comprehensive Plan - This property is identified by the Compreh- ensive Plan as MediumDensity Residential. 12. Applicable Requlatfons - 17.18.050(A) front yard; 17.66.090 through 17.66.170 variances and Alaska State Statutes 29.33.110(3)C. COMMENTS Mr. Torgramsen's present request is similar to his request of last month. This request however includes the proposed construct- ion of a 16' x 20' garage which will be connected to the existing 192 square foot accessory building. In order for the garage to be properly located on Lot 6 and not encroach on the sewer easement running through the middle of the property, the smaller accessory building will have to be located within 10 feet of the front property line. Because both accessory structures are to be connected to each other, they are looked upon as being one structure. The following must be considered by the Commission prior to the granting of a variance: 1. That there are exceptional physical circumstances or conditions applicable to the property or to its intended use or development which do not apply generally to the other prop- erties in the same land use district; O 2. That the strict application of the provisions of this title would result in practical difficulties or unnecessary hardship; 3. That...the granting of the variance will not result in material damage or prejudice to other properties in the viciriity nor be detrimental to the public health, safety or welfare; and Case 83-066 June 8, 1983: Page 3 4. That the granting of the variance will not be contrary to the objectives of the comprehensive plan. Staff agrees with the applicant that the location of the 10 foot sewer easement running through the middle of Lot 6 is an unusual physical characteristic applicable to the property. RECOMMENDATION Staff recommends approval of the requested variance based -On - the following reasons: 1. There are exceptional circumstances applicable to the property involved; 2. The application of Title 17 will present practical difficulties; 3. The variance will not be detrimental to the public health, safety or welfare; and' 4. The variance will not be contrary to the objectives of the comprehensive plan. William A.
