Lot 4A, Block 2, Leite Addition; 1516 Ismailov Street. (Patricia K. Winn) Forty-four public hearing notices were mailed on March 1, 1985. 1. Applicant: Patricia K. Winn, 1516 Ismailov, Kodiak, AK 99615. 2. Land Owner: Same. 3. Request: Request for a conditional use permit in accordance with Section 17.18.030 (Conditional Uses) of the Borough Code to permit the selling of candy making, needlecraft, and stencil supplies and the teaching of classes as a home occupation in an RI --Single-family Residential District. 4. Purpose: To permit the selling of candy making, needlecraft, and stencil supplies and the teaching of classes to use these supplies out of a residence as a home occupation. 5. Existing Zoning: R1 --Single-family Residential. 6. Zoning History: The 1968 Comprehensive Plan identifies the zoning of this lot as R1 --Single-family Residential. On June 15, 1967 a request to rezone a number of properties in the area, including the lot in question, from residential to business was denied by the borough assembly (Case 102-C). In 1984, Case 84-009, the commission approved a variance that permitted the construction of a single-family residence that encroaches two feet into the required 25 -foot front yard setback on this lot. 7. Location: 1516 Ismailov Street. Lot 4A, Block 2, Leite Addition. 8. Lot Size: 7283 square feet. 9. Existing Land Use: Single-family home. 10. Surrounding Land Use and Zoning: North: South: East: West: Ismailov Street. Lot 5A, Block 2, Leite Addition. Lot 6, Block 2, Leite Addition. Lot 3, Block 2, Leite Addition. Zoning: R1; Use: R1/B. Zoning: R1; Use: R1. Zoning: R1; Use: R1. 11. Comprehensive Plan: The Comprehensive Plan designates this area as "High-density Residential." 12. Applicable Regulations: Chapter 17.18 (R1 --Single-family Residential District), Section 17.18.030 (Conditional Uses), states that home occupations are permitted in the R1 district as a conditional use, and require commission approval. COMMENTS: The applicant proposes to sell, as well as teach the use of, a number of home crafts. These include candy making and needlecraft. Stencil supplies will also be available for sale. An area inside the garage is set aside specifically for this purpose. Mrs. Winn has been operating this home occupation for months at this location but was unaware of the need for a conditional use permit. Because of a coordination program between the borough and the City of Kodiak, zoning compliance is now required prior to the processing of city sales tax applications. The processing of this application as well as the teaching of classes is on hold pending the outcome of the request. On-site parking does not appear to be a problem because of a 50' by 23' driveway and side yard adjacent to the residence. The applicant states that classes meet infrequently and are limited to about six people. In order for the Commission to grant a conditional use permit, all of the following conditions must be satisfied: A. That the conditional use will preserve the value, spirit, character, and integrity of the surrounding area. This area of Kodiak has little traffic because of the unimproved condition of the roads. It is accessible from Rezanof Drive from which most of the traffic will travel. The neighborhood is slowly improving with the construction of nice homes. This use, if allowed, should not negatively impact the value, spirit, character, and integrity of the area. B. That the conditional use fulfills all other requirements of this chapter pertaining to the conditional use in question. The nature of the conditional use will preclude it from creating undue noise, dust, obj.ectional odors, and will not generate undue traffic. The use will not involve more than one paid assistant and will be provided adequate parking. Case 85-006 March 12, 1985 C. That granting the conditional use permit will not be harmful to the public's health, safety, convenience, and comfort. The unimproved nature of most of the roads in the area and the lot's direct accessibility from Rezanof Drive will cause most traffic to use this convenie route. The proposed uses associated with the conditional use permit application will not be harmful to the public's health, safety, or welfare. D. That sufficient setbacks, lot area, buffers, or other safeguards are being provided to meet the conditions listed in subsections A through C. The commission granted a variance to allow the current structure to be constructed two feet into the required 25 -foot front yard setback. The space remaining in the front of the house as well as space on the side of the house allows for ample parking for customers. RECOMMENDATION: Staff believes that for this case all of the required conditions have been met in order for the commission to grant a conditional use permit. Therefore, staff recommends approval of this request. APPROPRIATE MOTION: Should the commission agree with the staff's recommendation, the appropriate motion for this case is specified below. "Move to grant a conditional use permit in accordance with Section 17.18.030 (Conditional Uses) of the Borough Code to permit the selling of candy making, needlecraft, and stencil supplies and the teaching of classes as a home occupation in an R1 --Single-family Residential District."
