(William Burke) STAFF REPORT: Mr. Milligan presented a staff report based on a memorandum prepared by the planning department. Mr. Busch closed the regular meeting and opened the public hearing. Mr. J.T. Groggen stated that he disapproved of the rezoning. He would rather it stayed residential instead of business as he would like to build a house on the adjoining property, lot 17A. Discussion between the Commission and Mr. Groggen. Mr. Busch closed the public hearing and reopened the regular meeting. Mrs. Crowe moved that we recommend to the Borough Assembly the rezoning of lots 16B and 16C, USS 3098 from unclassified to business. Mr. Pugh seconded the motion. Motion PASSED by unanimous roll call vote. 2. Z-79-027. A request for a variance for the minimum lot requirements on lot 2, block 2, USS 1681. (William Hogan) STAFF REPORT: Mr. Milligan presented the staff report based on a memorandun prepared by the planning department. Mr. Ball moved to reconsider lot 2, block 2, USS 1681. Mr. Pugh seconded the motion. Motion PASSED by unanimous roll call vote. Mr. Milligan continued with the staff report after reconsideration of the variance was brought back up. The Commission had no questions for Mr. Milligan or for Mrs. Bishop. Mr. Pugh moved that we grant the request for a variance on lot 2, block 2, USS 1681 from the minimum lot requirements. Mr-. Pugh stated reasons why the variance should be granted. Motion seconded by Mrs. Crowe. Motion PASSED by unanimous roll call vote. _ 3. Z-79-030. William Hogan) Mr. Pugh moved that we grant a variance form the minimum lot requirements , on lot 3, block 2, USS 1681. For the same reasons he gave on the above \ request. Seconded by Mrs. Crowe. Z-79-030 A RESOLUTION OF THE KODIAK ISLAND BOROUGH PLANNING AND ZONING COM- MISSION GRANTING A VARIANCE FROM THE MINIMUM LOT SIZE PROVISIONS OF SECTION 17.42.010 OF THE KODIAK ISLAND BOROUGH CODE OF ORDINANCES. (William Hogan) WHEREAS, a petition was received from Mr. William Hogan requesting a variance to permit the seperate sale and development of lot 3, block 2, U.S.S. 1681. And; WHEREAS, notice was published, notices were mailed and a public hear ing was held. And; WHEREAS, the Commission found replatting the property would result in an unusual lot configuration and would create parcels with double frontage. And; WHEREAS, the Commission found replatting the three lots would create two lots of a size and configuration inconsistant with the established loting configuration in the neighborhood. And; WHEREAS, the Commission found granting the variance would not alter the character of the neighborhood and would preserve the present densities. And; WHEREAS, the Commission found granting the variance would not be detremental to the objectives of the Comprehensive Plan. NOW THEREFORE BE IT RESOLVED by the Kodiak Island Borough Planning and Zoning Commission this request for a variance to'reduce the minimum lot size for seperate sale and development of lot 3, block 2, U.S.S. 1681 is approved. A request for a variance from the minimum lot requirements, of Section 17.18.030 B-1 of the Kodiak Island Borough Code of Ordinances which requires a minimum lot area of 7200 square feet. Discussion between Mrs. Bishop and Commission. Hearing on one else speaking either for or against these variance requests, the Vice Chairman closed the public hearing and re -opened the regular meeting. Mr. Pugh made the motion, in as much as the City has not signed the Building permit that the Borough contact the City and/or the Inter- national Sea Foods and inform them that until such time that the Plan- ning Commission makes an interpretation of the zoning ordinance at the -next regular meeting that we are withholding permission on the building permit in regards to the parking ordinances. Seconded by Mr. Perez. Motion passed by unanimous roll call vote. Mr. Pugh requested that the.Borough Attorney be present at the August 15, 1979 meeting. Mrs. Lechner request that the City Attorney be notified about the meeting. (Hal Horton) Mr. Milligan states, "we will issue a letter tomorrow based on your order that any permits that are approved are null and void until after you have rendered an interpretation of the parking ordinances. 2. Monday evening you asked that we prepare a draft Resolution to the President of the United States. Mr. Pugh and myself have drafted a Resolution so that you may choose between the two of them or mix them around to say what you want it to. Mr. Pugh moves that we adopt Resolution No. 79-06-R. Seconded by Mrs. Crowe. Motion passed by unanimous roll call vote. 3. Alderwood plat will •now go to the Special meeting for the Borough Assembly to be held Saturday, July 21, 1979. 4. The owners of the Crosswidns would like to discuss with you at a work session to replatting of that piece of property and possibly the rezoning of the property. They would like to be ready by the September meeting. Mr. Anderson suggested they come to the July 25, 1979 work session. 5. Mr. Simmons would like to talk about rezoning some property in Port Lions. He will be at the next work session which is July 25, 1979. 6. The Welborn matter was refered to the Planning Commission for public hearing. Assembly has asked that a public hearing be held on the Borrow Site Lease. X. COMMISSIONER'S COMMENTS 1. Mr. Erwin is concerned with the building permits and would like a check list at the next work session, July 25, 1979. Mr. Erwin would like the Commission to review all industrial and commercial building permits before they are approved. Also we need an ordinance amendment for_the_next regular meeting. William C. and Elvina MI. Hogan) SITE: The petitioned property is located on lot 3, block 2, Leite Addition. The property fronts on Ismalov Street which is not constructed at this time. The site has been cleared •except for a few trees near,the front property line. The site slopes down from back to front with'a rather steep slope in front from lot 2 toward lot 4. This slope will create some problems with con- struction df Ismalov Street and development of the site. There is a sewer easement bi-secting the lot near its mid point which will •have an 'effect on the size and location of any buildings placed on the .property. HISTORY: • The Leite Addition like many subdivisions in Kodiak were plated prior to adoption of the present zoning ordinance minimum lot area and width re- striction: thus the lots are sub -standard or non -conforming by todays - standards. ANALYSIS: The petitioned property has a minimum width of 49.51 feet which is 10.49 feet below the minimum and a minimum area of 6,868.54 square feet which is . only 331.74 square feet below the minimum. Section 17.42.010 of.the Kodiak Island Borough Code of Ordinances states: "One -family dwelling --Existing use,. The requirements .as to:Tilinimum lot area shall. not be "construed to prevent:the use for one -family dwellings of any lot, parcel of land', other than in the B, I Or IR district, in the event that such lot or parcel of land was, on the effective date of prior code Chapter 5 subchapter 2, legally'subdivided:and separately owned, deeded by a deed or record,'or subject to a recordea contract of sale in full force and effect. Memorandum page 2 July 6, 1979 This section has been interpreted to mean that if an.individual owns one lot which is sub -standard to the present minimum lot requirements the lot may be developed or sold .as a seperate entity. However, if an individual owns two or more lots which are contiguous to one another they must be sold as a single unit or re -plated to conform with the -present standards. This request if granted:would allow the. sale of three_seperately plated lots which are'contiguous'to one another andin.the same ownership. 't973 egl;ri i',f3011011111211721(3141516 Re: Use of Contiguous Non -Conforming Lots Under Common Ownership pear Harry: You have inquired whether the Borough's zoning ordinance permits an owner of contiguous non -conforming lots to use each such lot individually for a single-family dwelling, or whether the owner must consolidate the lots into lots of conforming size before developing them. I conclude that the Borough's zoning ordinance requires,that an owner of contiguous non -conforming lots consolidate those lots into lots having at least the minimum area required under the current zoning ordinance before he may develop them. Kodiak Island Borough Code 17.42.010 provides: The requirements as to minimum lot area shall not be construed to prevent the use of one family dwellings of any lot, parcel of land, other than in the B, I or IR district, in the event that such lot, parcel of land was, on the effective date of prior Code Chapter 5, subchapter 2, legally subdivided separately owned, deeded by a deed or record, or subject to a recorded contract of sale in full force and affect. This section permits one to construct a single family dwelling on a lot within certain zone districts although the lot does not conform to current minimum lot area requirements, provided the lot was platted prior to the effective date of the current minimum lot area requirements, and provided further that the lot be separately owned, or in the process of being conveyed into separate ownership. Separate ownership of a non -conforming lot is a necessary prerequisite to developing that lot. This intrepretation also is consistent with a purpose of 17.42.010. Provisions such as 17.42.010 that allow the development of lots of non -conforming size are designed to prevent hardship to property owners who, but for such a provision, would find their property totally undevelopable. If a person owns two or more contiguous non- conforming lots, he may render them developable under current zoning regulations merely by replatting them to form a lesser number of lots that meet the current lot area requirements. Since increasing lot area requirements does not impose,the burden on owners of contiguous non -conforming lots that it imposes on the owner of an isolated non -conforming lot,J the owner of contiguous lots is not entitled to the benefit to the non -conforming use provision.
