STAFF REPORT: Mr. Milligan presented a staff report based on a memorandum
prepared by the planning department.
Mr. Busch closed the regular meeting and opened the public hearing.
Mr. J.T. Groggen stated that he disapproved of the rezoning. He would
rather it stayed residential instead of business as he would like to
build a house on the adjoining property, lot 17A.
Discussion between the Commission and Mr. Groggen.
Mr. Busch closed the public hearing and reopened the regular meeting.
Mrs. Crowe moved that we recommend to the Borough Assembly the rezoning of
lots 16B and 16C, USS 3098 from unclassified to business. Mr. Pugh seconded
the motion. Motion PASSED_ by _unanimous roll call vote_.
2. Z-79-027. A request for variance for the minimum lot requirements on lot
block 2, USS 1681.Nilliam Hogan '
STAFF REPORT: Mr. Milligan presented the staff report based on a memorandun
prepared by the planning department.
Mr. Ball moved to reconsider lot 2, block 2, USS 1681. Mr. Pugh seconded
the motion. Motion PASSED by unanimous roll call vote.
Mr. Milligan continued with the staff report after reconsideration of the
variance was brought back up.
The Commission had no questions for Mr. Milligan or for lMrs. Bishop.
Mr. Pughtmoved7that sNe grant the request for -a -variance on lot 2, block 2,
USS 1681 from the minimum lot requirements. Mr. Pugh stated reasons why
the variance should be granted. Motion seconded by Mrs. Crowe. Motion
PASSED by unanimous -roll -call- vote'. -
3. Z-79-030. A request for a variance from the minimum lot requirements on
lot 3, block 2, USS 1681. (William Hogan)
Mr. Pugh moved that we grant a variance form the minimum lot requirements
on lot 3, block 2, USS 1681. For the same reasons he gave on the above
request. Seconded by Mrs. Crowe. Motion PASSED by unanimous roll call
vote.

A RESOLUTION OF THE KODIAK ISLAND BOROUGH PLANNING AND ZONING COM-
MISSION GRANTING A VARIANCE FROM THE MINIMUM LOT SIZE PROVISIONS OF SECTION
17.42.010 OF THE KODIAK ISLAND BOROUGH CODE OF ORDINANCES. (William Hogan)
WHEREAS, a petition was received from Mr. William Hogan requesting a
variance to permit the seperate sale and development of lot 2, block 2, U.S.S.
1681. And;
WHEREAS, notice was published, notices were mailed and a public hear
ing was held. And;
WHEREAS, the Commission found replatting the property would result
in an unusual lot configuration and would create parcels with double frontage.
And;
WHEREAS, the Commission found replatting the three lots would create
two lots of a size and configuration inconsistant with the established loting
configuration in the neighborhood. And;
WHEREAS, the Commission found granting the variance would not alter
the character of the neighborhood and would preserve the present densities.
And;
WHEREAS, the Commission found granting the variance would not be
detremental to the objectives of the Comprehensive Plan.
NOW THEREFORE BE IT RESOLVED by the Kodiak Island Borough Planning
and Zoning Commission this request for a variance to reduce the minimum lot
size for seperate sale and development of lot 2, block 2, U.S.S. 1681 is
approved.

Motion passed bya 4-1 vote, Mr: Pugh Voted NO, and all others voted YES.

regular, meeting. Seconded by Mr. Perez. Motion passed by:ta 4-1 vote,
Mr. Pugh casting a NO vote and all others casting YES votes.
Mr. Anderson requested cases Z-79-028.and Z-79-026 be placed on the
next work session agendas.
Z-79-027. Ki.;dquest for a variance from the minimum lot requirements
of Section 17.18.030 B-1 of the Kodiak Island Borough Code of Ordinances
which requires a minimum lot area of 7200 square feet. The petitioners
property contains 6828.13 square feet. Lot 2, Block 2, USS 1681.'

STAFF REPORT: Mr. Milligan suggested he present case #'s Z-79-027,
Z-79-030, and Z-79-031. With the approval of the Vice Chairman. Mr.
Milligan presented the staff report on the above mentioned cases as
prepared by the Planning Staff.
Vice Chairman Anderson closed the regular meeting and opened the
public hearing.
Mrs. Betty Bishop shared her involvement in these cases as realtor and
the research that she has encountered. Discussion between Mrs. Bishop
and Commission.
Hearing on one else speaking either for or against these variance
requests, the Vice Chairman closed the public hearing and re -opened
the regular meeting.
Mr. Perez moved that Z-79-027 which consists of Lot 2, Block 2, USS
1681 be granted a variance. Seconded by Mrs. Crowe. Somediscussion.
followed between Commissioner's. Motion FAILED 3-2, with -Mr. Pugh
and Mr. Erwin casting NO votes.
Mr. Pugh moved that at our next regular meeting that we hold a public.
hearing to repeal that section of the Ordinance which requires that
two non -conforming lots be combined if owned by the same owner.
Seconded by Mr. Erwin. Motion passed by unanimous roll call vote.
Items under the same request were moved by Mrs. Crowe to place these
on the August agenda 'and acted upon if the ordinance fails. Seconded
by Mr. Pugh. (Z-79-030 & Z-79-031). Motion passed by unanimous roll
call vote.
Mr. Pugh moved that the last issue (Lot 2, block 2, USS 1681) that
we voted on be put back on the table for reconsideration at next
month's meeting. Seconded by Mr. Perez. (No roll call vote necessary).
B. Subdivisions
1. S-79-032. A request to vacate Block 1 of the Alderwood Townhouse
subdivision. And to replat as blocks 1A, 1B, 1C, and 1D Alderwood.

Discussion between Mr. Pugh and Mr. Gordon.
Mr. Pugh made the motion, in as much as the City has not signed the
Building permit that the Borough contact the City and/or the Inter-
national Sea Foods and inform them that until such time that the Plan-
ning Commission makes an interpretation of the zoning ordinance at
the next regular meeting that we are withholding permission on the
building permit in regards to the parking ordinances. Seconded by
Mr. Perez. Motion passed by unanimous roll call vote.
Mr. Pugh requested that the Borough Attorney be present at the
August 15, 1979 meeting.
Mrs. Lechner request that the City Attorney be notified about the
meeting. (Hal Horton)
Mr. Milligan states, "we will issue a letter tomorrow based on your
order that any permits that are approved are null and void until
after you have rendered an interpretation of the parking ordinances.
2. Monday evening you asked that we prepare a draft Resolution to the
President of the United States, Mr. Pugh and myself have drafted a
Resolution so that you may choose between the two of them or mix them
around to say what you want it to.
Mr. Pugh moves that we adopt Resolution No. 79-06-R. Seconded by Mrs.
Crowe. Motion passed by unanimous roll call vote.
3. Alderwood plat will now go to the Special meeting for the Borough
Assembly to be held Saturday, July 21, 1979.
4. The owners of the Crosswidns would like to discuss with you at a
work session to replatting of that piece of property and possibly
the rezoning of the property. They would like to be ready by the
September meeting. Mr. Anderson suggested they come to the July
25, 1979 work session.
5. Mr. Simmons would like to talk about rezoning some property in Port
Lions. He will be at the next work session which is July 25, 1979.
6. The Welborn matter was refered to the Planning Commission for public
hearing. Assembly has asked that a public hearing be held on the
Borrow Site Lease.
X. COMMISSIONER'S COMMENTS
1. Mr. Erwin is concerned with the building permits and would like a
check list at the next work session, July 25, 1979. •Mr. Erwin
would like the Commission to review all industrial and commercial
building permits before they are approved. Also we need an ordinance

XI. 1. 1. Mrs. Bishop spoke on Mr. Hogan's behalf, they would like to have
the letter interpretated so that Mr. Hogan does not have to wait
another month to sell his land.
Mr. Pugh moves that the Planning staff call the Borough Attorney
to get an interpretation of the Attorney's letter in English stating
whether or not it is possible for Mr. Hogan to sell these lots to
three seperate individuals. Seconded by Mrs. Crowe. Motion passed
by unanimous roll call vote.

SITE:
The petitioned property is located on lot 2, block,2, Leite Addition
Subdivision. The site fronts on Ismalov Street which is not constructed at
this'time. The site slopes from back to frontand from lot one down toward
lot 3. The -site is basically cleared with a few trees in the Right -of -Way
and the front yard. There is a sewer line easement bi-secting the lot near
•its mid point. This line will have some effect on the size and location of
any structure built on the lot.

HISTORY:
The Leite. Addition like.many:subdivisions in -Kodiak were plated prior:to
adoption of the present zoning ordinance'minimum lot area and width restriction;
thus the lots are,sub7standard or non -conforming by todays.standards:
ANALYSIS:
The petitioned -property has a miniMummidth of 49.88 feet which. is 10.12
feet below the -minimum and a minimum area of 6,823.14 -square feet which is
376.86 square feet below the minimum.
Section 17,18.010 of the"Kodiak Island Borough Code of Ordinances states:

Lots Under Common Ownership
You have inquired whether the Borough's zoning ordinance
permits an owner of contiguous non -conforming lots to use
each such lot individually for a single-family dwelling, or
whether the owner must consolidate the lots into lots of
conforming size before developing them.
I conclude that the Borough's zoning ordinance requires that
an owner of contiguous non -conforming lots consolidate those
lots into lots having at least the minimum area required
under the current zoning ordinance before he may develop
them.
Kodiak Island Borough Code 17.42.010 provides:
The requirements as to minimum lot area shall not be
construed to prevent the use of one family dwellings of
any lot, parcel of land, other than in the B, I or IR
district, in the event that such lot, parcel of land
was, on the effective date of prior Code Chapter 5,
subchapter 2, legally subdivided separately owned,
deeded by a deed or record, or subject to a recorded
contract of sale in full force and affect.
This section permits one to construct a single family
dwelling on a lot within certain zone districts although the
lot does not conform to current minimum lot area requirements,
provided the lot was platted prior to the effective date of
the current minimum lot area requirements, and provided
further that the lot be separately owned, or in the process
of being conveyed into separate ownership.

On its face section 17.42.010 seems clear. Separate ownership
of a non -conforming lot is a necessary prerequisite to
developing that lot. This intrepretation also is consistent
with a purpose of 17.42.010. Provisions such as 17.42.010
that allow the development of lots of non -conforming size
are designed to prevent hardship to property owners who, but
for such a provision, would find their property totally
undevelopable. If a person owns two or more contiguous non-
conforming lots, he may render them developable under current
zoning regulations merely by replotting them to form a;
lesser number of lots that •peet the current lot area requirements.
Since increasingjot a.ea.requirements does not'impose',the
burden on owners ,of contiguous non -conforming lots thatit
imposes on the owner of an isolated non -conforming lot,j the
owner of contiguous lots is not entitled to the benefit to
the non -conforming use _provision.

two lots to conform to lot size standards. They would be more difficult
to sell, because price would have to be raised, and this is more a
moderate priced neighborhood.

to other properties in the vicinity nor be detrimental to the public health, safety
or welfare in that: The lots are now in conformity with the surrounding
area. All of Leite Addition contains lots of approximately the same
size.
4. That the granting of the variance will not be contrary to the objectives of the
comprehensive plan for the following reasons:
This is an older neighborhood of single family dwellings, all on lots
of about 5,000-0,000+ square feet. This lot contains 6,792.25 square
feet. This variance will allow three families to build single family
dwellings with a reasonable lot cost, and this will serve to upgrade
the neighborhood.
NOTE: If this variance is granted, it will not permit a use prohibited in the use
district in which the above described premises is located.
