After our conversation, it seems that we are in agreement concerning the need to demolish this structure. On January 2, 1996 I inspected this structure with assistant building official Doug Mathers. It was evident to me that structurally, the house is likely to fail or collapse. The walls move in and out with a light pushing effort. A significant portion of the walls have no foundation under them. Holes in the ground around the walls are dangerous. The back wall of the second floor is uncovered, exposing the house to weather. Because this structure is vacant, and its advanced state of dilapidation, this office also considers the building to be an attractive nuisance for children, a possible harbor for vagrants and an unnecessary environment for vermin. For all these reasons stated above, I have determined that this structure must be demolished. A demolition permit shall be secured from this office within 60 days. The demolition and site cleanup shall be completed within 60 days of Securing the demolition permit. If the required demolition work is not commenced within the time specified, this office may proceed to cause the work to be done and charge the costs thereof against the property or its owner. Any person having any record title or legal interest in the building may appeal from the notice and order of any action of the building official to the Board of Appeals, providing the appeal is made in writing as provided in this code and filed with the building official within 30 days from the date of service of such notice and order; and that failure to appeal will constitute a waiver of all right to an administrative hearing and determination of the matter. Staff from this department conducted a site visit on January 25, 1994, to confirm the observations of the Building Official. At the site, staff observed what appears to be a foundation for a new house being constructed inside the existing house. From our limited view outside a window, it appears that the perimeter of the new house foundation is substantially smaller than the existing house. Therefore, a structure placed on this recently constructed foundation will not require the use of any structural members or bearing walls from the original house. This constitutes a total abandonment of the existing house. When an existing grandfathered structure is destroyed by more than 50% of its replacement cost then it must be reconstructed in conformity with the current zoning requirements. Abandoning the original structure is equivalent to complete destruction. Your new construction inside must therefore be reviewed for compliance with the current R1 --Single-family Residential zoning requirements. A new dwelling unit must meet the setback requirements of the R1 --Single-family Residential zoning district. In this case, this is probably the average setback of main structures on either side of your development. It appears that the newly constructed foundation encroaches the required front yard in relation to the average setback on the lot. You may be required to recover the lot corners of this lot in order to enable staff to measure the setback before zoning compliance is issued. In addition, all new dwellings are required to show at least three (3) off-street parking spaces with minimum dimensions of 9 feet by 18 feet. According to the Building Official, you did not obtain a building permit based on the zoning compliance that is now revoked. The original stop work order placed on this project by Building Official is still in effect. Any further construction work at this site prior to obtaining the proper permits is a violation of City and Borough Codes and can lead directly to legal action.
