The Kodiak Island Borough Planning and Zoning Commission at their meeting on March 19, 1986, granted your request for the conditional use permit cited above and adopted the following findings in support of their decision: FINDINGS OF FACT: 1. That the conditional use will preserve the value, spirit, character and integrity of the surrounding area. It appears that the proposed home occupation will preserve the value, spirit, character and integrity of the surrounding area. The home occupation will be conducted entirely within the residence, no assistants will be used and according to the applicants, only an occasional customer is expected to call a the residence. 2. That the conditional use fulfills all other requirements of this chapter pertaining to the conditional use in question. The proposed home occupation will fulfill all other requirements of the R1--Single-Family Residential District (Chapter 17.18) such as parking and the definition of a home occupation (Section 17.06.320). That granting the conditional use permit will not be harmful to the public health, safety, convenience and comfort. That sufficient setbacks, lot area, buffers or other safeguards are being provided to meet the conditions listed in subsections A through C of this section. As the home occupation will be conducted entirely within the existing residence and because only an occasional customer will call at the residence, provision of additional buffers or other safeguards are not necessary in this instance. There is sufficient area on the lot for four (4) off-street parking spaces. Should the nature of the home occupation change over time, the Commission could review the conditional use permit to determine if additional safeguards are appropriate. An appeal of this decision may be initiated by any person or party .aggrieved by filing a written notice of appeal with the City Clerk within ten days of the date of the Commission's decision. The notice of appeal must state the specific grounds for the appeal. Therefore, the Commission's decision will not be final and effective until ten days following the decision. This letter shall constitute your conditional use permit. Please bring it with you if you need to come into our office to obtain zoning compliance for any construction on your lot. Lot 1, Block 3, Leite Addition; 1610 Ismailov Street (Eric and Marion Stirrup) BOB PEDERSON indicated 40 public hearing notices were mailed for this case and 2 were returned in favor of this request, 1 of which stated opposition to any human traffic across her property. A discussion ensued amongst the Commissioners, Engineering Department staff, Community Development Department staff and Bud Cassidy, Resource Management Officer concerning the rationale for disposing Borough lands, the need to reserve adequate lands for parks and public services such as a sanitary landfill and a fire hall and the status of a comprehensive plan for the Chiniak Community. COMMISSIONER JAMES MOVED TO APPROVE RESOLUTION 86-01-R AND TO RECOMMEND TO THE BOROUGH ASSEMBLY the disposal of Lots 3 through 10, Block 1 and Lot 15, Block 2, Chiniak Alaska Subdivision. The motion vas seconded and CARRIED by unanimous roll call vote. F) CASE 86-019. Shuyak Island Comprehensive Plan. (Community Development Department) BUD CASSIDY presented a slide show and discussed the development of the draft Shuyak Island Comprehensive Plan. The process involved defining "why a Shuyak Island Comprehensive plan," the purpose of the plan, how the plan was put together, general recommendations and recommendations specific to Borough -owned lands. A discussion ensued between Bud Cassidy and Dave Herrnstein. Mr. Herrnstein indicated that he liked a lot of things about the plan but he disagrees that the Borough should encourage development in the Port Williams/Shuyak Straits areas. This area is large enough to safely accomodate four cars without obstructing traffic on~17th Street. ' � There should not be any increased impact on -" traffic flow to the neighborhood. However, traffic in this area is already high since this road is a major "convenience shortcut" linking Rezannf and Mission Road. No changes to the current setbacks are anticipated within the next five years unless the city goes ahead with its plan to widen 17th Street.
