I have reviewed your request, dated May 23, 1995, to reconstruct a deck on your house at
1610 Ismailov St. which encroaches slightly into the Sewer Easement on your lot, as shown
on the survey attached to your letter.
The City of Kodiak has no objection to this request subject to the following conditions which
are deemed accepted by you upon reconstruction of a deck which encroaches into the Sewer
Easement.
1 The deck shall protrude into the easement no more than 18 inches.
2 At the request of the City the owner agrees to immediately remove the deck from the
easement or be responsible for the cost of removal should the City have the deck
removed.
The owner assumes all responsibility for repairs should the deck be damaged by City
crews working in the easement.
4 The owner agrees that no permanent rights to locate the deck within the easement are
granted with this letter and that the City can revoke it's permission at any time.
