Mr. Pugh moved that we grant a variance from the minimum lot requirements on
lot 19, block 2, USS 1681, for the same reasons he gave on the above request.
Seconded by Mrs. Crowe. Motion PASSED by unanimous roll call vote.

STAFF REPORT: Mr. Milligan gave a staff report based on a memorandum preparec
by the planning department. Mr. Hovanec has some questions so you may wish
to wait on this case until he gets here.
Mr. Busch stated that the Commission would wait on this item until Mr:
Hovanec showed up.
2. S-79-035. Vacation of School Reserve of Port Lions Alaska Subdivision,
Serial #65-1733. (State of Alaska)
STAFF REPORT: Mr. Milligan presented the staff report based on a memorandum
prepared by the planning department.
Mr. Busch closed the regular meeting and opened the public hearing.
Hearing no comments Mr. Busch closde the public hearing and reopened the
regular meeting.
Mr. Pugh moved that we approve the vacation replat of the School Reserve in
Port Lions Alaska Subdivision, Serial #65-1733 the land area as described
in the June 6, 1979, letter from the State of Alaska department of Natural
Resourses to Mayor Betty Wallin from G.S. Best. Seconded by Mr. Ball.
Motion PASSED by unanimous roll call vote.
B. OTHER
1. 0-79-036. Purchase of Borough Land regarding Parcel P-1, Tract A, Bells
Flats Alaska Subdivision. (Brechan Enterprises)
STAFF REPORT: Mr. Milligan presented the staff report based on a memorandum
prepared by the planning department. Mr. Milligan suggested that the land
be leased instead of being sold. He suggests a 10 to 20 year lease.
Mr. Brechan spoke on his lease. He would like to lease again, but he would
rather buy the land. The decision to sell is up to the Borough. He also
discussed his redevelopment plan for the property.
Discussion between Mr. Brechan and the Commission.
Mr. Milligan commenting on the redevelopment plants, stated the site has
been used for a batch plant more than a borrow site gravel pit.
Mr. Pugh moved to recommend to the Borough Assembly that Parcel P-1, Tract A
Bells Flats Alaska Subdivision be put up for sale at a public auction.
Seconded by Mr. Ball. Motion FAILED with a 3-2 vote, Mr. Ball, Mr. Busch,
and Mr. Pugh voted YES and Mr. Erwin and Mrs. 'Crowe voted NO.
Mrs. Crowe moved to recommend to the Borough Assembly the lease of the
proposed property for 10 years with the stipulation the following the ex-
piration of the lease that Brechan follow his proposed development plan with
current gravel prices included. Mr. Busch asked Mrs. Crowe to restate her
motion. I move we lease to Brechan for a period of 10 years the property
parcel P-1, Tract A, Bells Flats Alaska Subdivision. Seconded by Mr. Erwin.
Mr. Ball would like a stipulation added to the motion, he would like Brechan
to get first option to buy the land after the lease expires or to release
the land again. Agreed. Mr. Pugh seconded the amendment to the original
motion made by Mrs. Crowe.

A RESOLUTION OF THE KODIAK ISLAND BOROUGH PLANNING AND ZONING COM-
MISSION GRANTING A VARIANCE FROM THE MINIMUM LOT SIZE PROVISIONS OF SECTION
17.42.010 OF THE KODIAK ISLAND BOROUGH CODE OF ORDINANCES. (William Hogan)
WHEREAS, a petition was received from Mr. William Hogan requesting a
variance to permit the seperate sale and development of lot 19, block 2, U.S.S.
1681. And;
WHEREAS, notice was published, notices were mailed and a public hear
ing was held. And;
WHEREAS, the Commission found replatting the property would result
in an unusual lot configuration and would create parcels with double frontage.
And;
WHEREAS, the Commission found replatting the three lots would create
two lots of a size and configuration inconsistant with the established loting
configuration in the neighborhood. And;
WHEREAS, the Commission found granting the variance would not alter
the character of the neighborhood and would preserve the present densities.
And;
WHEREAS, the Commission found granting the variance would not be
detremental to the objectives of the Comprehensive Plan.
NOW THEREFORE BE IT RESOLVED by the Kodiak Island Borough Planning
and Zoning Commission this request for a variance to reduce the minimum lot
size for seperate sale and development of lot 19, block 2, U.S.S. 1681 is
approved.

STAFF REPORT: Mr. Milligan suggested he present case #'s Z-79-027,
Z-79-030, and Z-79-0]}. With the approval of the Vice Chairman. Mr.
Milligan presented the staff report on the above mentioned cases as
prepared by the Planning Staff.
Vice Chairman Anderson closed the regular meeting and opened the
public hearing.
Mrs. Betty Bishop shared her involvement in these cases as realtor and '
the research that she has encountered. Discussion between Mrs. Bishop .
and Commission.
Hearing on one else speaking either for or against these variance
requests, the Vice Chairman closed the public hearing and re -opened
the regular meeting.
Mr. Perez moved that I-79-027 which consists of Lot 2, Block 2, USS
1681 be granted a variance. Seconded by Mrs. Crowe. Some_discussion,
followed between Commissioner's. Motion FAILED 3-2, with Mr. Pugh
and Mr. Erwin casting NO votes.
Mr. Pugh moved that at our next regular meeting that we hold a public-
hearing
ublicheariDg to repeal that section of the Ordinance which requires that
two non-COnfVrming lots be combined if owned by the same owner.
Seconded by Mr. Erwin. Motion passed by unanimous roll c.all vote.
Items under the same request were moved by Mrs. Crowe to place these

Discussion between Mr. Pugh and Mr. Gordon.
Mr. Pugh made the motion, in as much as the City has not signed the
Building permit that the Borough contact the City and/Or the Inter-
national Sea Foods and inform them that until such time that the Plan-
ning Commission makes an interpretation of the zoning ordinance at
the next regular meeting that we are withholding permission on the
building permit in regards to the parking ordinances. Seconded by
Mr. Perez. Motion passed by unanimous roll call vote.
Mr. Pugh requested that the Borough Attorney be present at the
August 15, 1979 meeting.
Mrs.Lechner request that the City Attorney be notified about the
meeting. (Hal Horton)
Mr. Milligan states, "we will issue a letter tomorrow based on your
order that any permits that are approved are null and void until
after you have rendered an interpretation of the parking ordinances.
2. Monday evening you asked that we prepare a draft Resolution to the
President of the United States. Mr. Pugh and myself have drafted a
Resolution so that you may choose between the two of them or mix them
around to say what you want it to.
Mr. Pugh moves that we adopt Resolution No. 79-06-R, Seconded by Mrs.
Crowe. Motion passed by unanimous roll Call.Vnt8.
Alderwood plat will now go to the Special meeting for the Borough
Assembly to be held Saturday, July 21, 1979,
4. The owners of the Crosswidns would like to discuss with you at a
work session to replatting of that piece of property and possibly
the rezoning of the property. They would like to be ready by the
September meeting. Mr. Anderson suggested they come to the July
25 �97� work session.

5. Mr. Simmons would like to talk about rezoning some property in Port
Lions. He will be at the next work session which is July 25, 1979.
6. The Welborn matter was refered to the Planning Commission for public
hearing. Assembly has asked that a public hearing be held on the
Borrow Site Lease.
X. COMMISSIONER'S COMMENTS
1. Mr. Erwin is concerned with the building permits and would like a
Check list at the next work session, July 25, 1979, Mr. Erwin
would like the Commission to review all industrial and commercial
building permits before they are approved. Also we need an ordinance
amendment for the next regular meeting. (Public hearin)

REQUEST:
This is request for a variance from the minimun lot width area provisions
of Section 17.18.030 of the Kodiak Island Borough Code of Ordinances. Which
requires a minimum lot width of sixty (60) feet and a minimum lot area of .
seven thousand two hundred (7,200) square feet in an R-1 zoning use district.

SITE:
The petitioned property is located on lot 19, block 2, Leite Addition.
The site fronts on Mission Road. The site is basically level, it has been
' cleared and has public sewer and water available.
HISTORY:
The Leite Addition like many subdivisions in Kodiak was plated prior to
• adoption of the present zoning ordinance minimum lot .area and width restriction. '
Thus the lots are sub-standard'or non -conforming by todays standards.
ANALYSIS:
The petitioned property has a minimum width of 49.51 feet which is 10.49
feet below the minimum and a minimum area of 6,164.88 square feet which is
1,336.488 square feet below the. minimum.' .
Section 17.42.010 of the Kodiak Island BorOugh Code of Ordinahces, states:
"One -family dwelling--EXisting use. 'The requirements as to minimum lot '
... area shall not be construed to prevent the use -for one -family dwellings of
any lot, parcel of land, other than in the B, I.or IR district, in the event
that such lot'or parcel of land,was, on the effective date of prior code Chapter
5 subchapter'2, legally subdivided and separatelyowned, deeded by a deed or '
recordi.orsubjeptto a recorded contract of sale.in full fOrceand effect."
This section haS been interpreted to men tftat if an individual ownes
one lot which,is sub -standard to the present minimum lot requirements the
lot may be developed or sold as.a separate entity. However, if an individual
owns two or more lots whiCh-are contiguous te ohe another they must be sold
as a single unit.or re -plated to conform with the present standards.

Lots Under Common Ownership
You have inquired whether the Borough's zoning ordinance
permits an owner of contiguous non -conforming lots to use
each such lot individually for a single-family dwelling, or
whether the owner must consolidate the lots into lots of
conforming size before developing them.
I conclude that the Borough's zoning ordinance requires.that
an owner of contiguous non -conforming lots consolidate those
lots into lots having at least the minimum area required
under the current zoning ordinance before he may develop
them.
Kodiak Island Borough Code 17.42.010 provides:
The requirements as to minimum lot area shall not be
construed to prevent the use of one -family dwellings of
any lot, parcel of land, other than in the B, I or IR
district, in the event that such lot, parcel of land
was, on the effective date of prior Code Chapter 5,
subchapter 2, legally subdivided separately owned,
deeded by a deed or record, or subject to a recorded
contract of sale in full force and affect.
This section permits one to construct a single family.‘.
dwelling on a lot within certain zone districts although the
lot does not conform to current minimum lot area requirements,
provided the lot was platted prior to the effective date of
the current minimum lot area requirements, and provided
further that the lot be separately owned, or in the process
of being conveyed into separate ownership.

On its face section 17.42.010 seems clear. Separate ownership
of a non -conforming lot is a necessary prerequisite to
developing that lot. This intrepretation also is consistent
with a purpose of 17.42.010. Provisions such as 17.42.010
that allow the development of lots of non -conforming size
are designed to prevent hardship to property owners who, but
for such a provision, would find their property totally
undevelopable. If a person owns two or more contiguous non-
conforming lots, he may render them developable under current
zoning regulations merely by replatting them to form a
lesser number of lots that meet the current lot area requirements..
Since increasing lot area requirements does not imposeythe
burden on owners of contiguous non -conforming lots that it
imposes on the owner of an isolated non -conforming lot, the
owner of contiguous lots is not entitled to the benefit to
the non -conforming use provision.

to other properties in the vicinity nor be detrimental to the public health, safety
or welfare in that: The lots are now in conformity with the surrounding
area. All of Leite Addition contains lots of approximately the same
size.
4. That the granting of the variance will not be contrary to the objectives of the
comprehensive plan for the following reasons:
This is an older neighborhood of single family dwellings, all on lots
of about 5,000-6,000+ square feet. This variance will allow three
families to build single family dwellings with a reasonable lot cost,
and this will serve to upgrade the neighborhood.
NOTE: If this variance is granted, it will not permit a use prohibited in the use
district in which the above described premises is located.
