REASON FOR REQUEST Property owner asserts unrestricted right to use accessory building and available lot area for placement and storage of commercial fishing gear. The only documented right to use accessory building for commercial fishing gear storage is a condition of approval for a variance permitting a 20' X 40' addition to an existing 40' X 40' accessory building to encroach into a setback. No previous right to store gear in the accessory building is documented in department files. Staff has acknowledged the condition of approval established by the Commission, even though the authority of this action is not without question. Staff is willing to accept the condition of approval, due to the passage of time and incompleteness of the record surrounding this particular aspect of the decision. Staff believes that some corresponding restriction upon the right to use the available lotarea for placement and storage of commercial fishing gear is implicit in this view of the circumstances relating to this lot. Staff requests assistance to make a discrete determination of the extent of remaining rights to place fishing gear on this residential lot as requested by the property owner. The Kodiak Island Borough Planning and Zoning Commission at their meeting on September 18, 1985, adopted the following findings of fact in support of their August 21, 1985 decision granting the above -cite variance: 1. The unique physical condition applicable in this case is the existing nonconforming accessory structure. 2. Strict application of the zoning ordinance would require the addition to be removed. This is an unnecessary hardship and practical difficulty. 3. Granting of the variance will not be detrimental to the public's health, safety and welfare because all outdoor storage must be relocated within the structure. This will eliminate a potential attractive nuisance to children. 4. Granting of this variance will not be contrary to the objectives of the Comprehensive Plan. 5. Implicit in this recommendation for the future development of this area are other development standards such as adequate road widths and rights-of-way, as well as considerations of traffic circulation and safety. The proposed use will endanger the public's health, safety, or general welfare since rock extraction in a residentially zoned area will result in blasting, noise, dust, trucks and other heavy equipment using roads intended for residential access, an increased potential for erosion, increased runoff, and general disruption to the residential nature of the surrounding area. 2. Theproposed use will be inconsistent with the general purposes and intent of Title 17 and with the specific description and intent of Chapter 17.17, the RR1--Rural Residential One District. 3. The proposed use will adversely impact other properties in the area. As identified in A above, rock extraction results in blasting, noise, dust, disruption, traffic safety concerns, and potential runoff and erosion problems. Lot 6, Block 3, Leite Addition; 1723 Mission Road. (Terry Lowenberg) Twenty public hearing notices were mailed on July 1, 1985. 1. Applicant: Terry Lowenberg, P.O. Box 767, Kodiak, AK 99615. 2. Land Owner: Same. 3. Request: A variance from Section 17.51.050 (Area Requirements) of the Borough Code to permit an existing addition to an accessory building, that exceeds 10 percent of the lot area, to remain on the lot in an R1, Single-family Residential, district. 4. Purpose: To allow an existing addition to an accessory building that exceeds 10 percent of the area of the lot to remain on the site. 5. Existing Zoning: R1 --Single-family Residential. 6. Zoning History: The 1968 Comprehensive Plan shows this area as R1 --Residential. No further zoning actions to date. 7. Location: 1723 Mission Road. Lot 6, Block 3, Leite Addition. 8. Lot Size: 11,361 square feet. 9. Existing Land Use: The lot contains a single-family residence and the existing accessory structure and addition. Comprehensive Plan: The 1968 Comprehensive Plan identifies this area as medium -density residential. 12. Applicable Regulations: Section 17.51.050. This section specifies that an accessory structure shall not exceed 10 percent of the area of a lot. COMMENTS: Approval of this variance application will legitimize an existing addition to an accessory structure on the lot. The existing structure is 1,600 square feet (40 x 40) and the addition is 800 square feet (20 x 40). The accessory building and addition comply with the setback requirements for the lot. Building Permit #4855 for a 40 x 40 accessory structure was issued on February 26, 1982. Staff can find no record of a building permit issued for the 20 x 40 addition which was constructed over the 1985 Memorial Day weekend. The original accessory building is a grandfathered, nonconforming structure because it was built prior to the adoption of Ordinance No. 82-14-0. This ordinance established that an accessory structure shall not exceed 10 percent of the area of the lot. The original accessory building occupies 14 percent of the lot and the addition covers an additional 7 percent. In order for the Commission to grant a variance, all of the following conditions must be satisfied: 1. Exceptional physical circumstances or conditions applicable to the property or intended use of development, which generally do not apply to other properties in the same land use district. Lot 6, Block 3, Leite Addition, contains 11,361 square feet and is a level lot. There do not appear to be any unique physical circumstances (e.g., soils, slope, substandard lot size, or irregular lot shape) or conditions which apply to this lot but do not generally apply to other properties in the same R1 district. 2. Strict application of the zoning ordinances would result in practical difficulties or unnecessary hardships. The strict application of the 10 percent lot coverage rule for accessory structure would not allow the addition to remain on the lot. This does not create a hardship as the property owner assumed this risk by construc- ting the addition without first obtaining a building permit. CASE 85-042 -2- July 17, 1985 3. The granting of the variance will not result in material damages or prejudice to other properties in the vicinity nor be detrimental to the public's health, safety, and welfare. Allowing accessory structures to exceed 10 percent of lot area can lead to the accessory structure becoming the principal structure on the lot. Large-scale accessory uses are also not compatible with predominantly single-family residential uses and detract from the appearance and character of the neighborhood. Further, staff has received a verbal indication from a U.S. Army Corps of Engineers representative that the additional fill placed in Potato Patch Lake as a part of the accessory building construction failed to receive a permit for placing fill in a wetland. This action could potentially endanger the public's health, safety, or general welfare. Additionally, no permits have been issued or inspections performed on the addition to ensure compliance with building and fire codes. 4. The granting of the variance will not be contrary to the objectives of the Comprehensive Plan. Granting of this variance will not be contrary to the objectives of the comprehensive plan which identifies this area for medium -density residen- tial development. 5. That actions of the applicant did not cause special conditions or financial hardship from which relief is being sought by the variance. In this instance, actions of the applicant caused the conditions from which relief is being sought by a variance. The addition was constructed without first obtaining zoning compliance and being issued a building permit. 6. That the granting of the variance will not permit a prohibited land use in the district involved. Accessory buildings are permitted in the R1 district provided that they do not exceed 10 percent lot coverage. RECOMMENDATION: Staff finds that this request DOES NOT MEET all the conditions necessary for a variance to be granted pursuant to Chapter 17.66 (Variance) of the Borough Code.
