E. Final Approval - Vacation of Alleyway - Leite Addn., Block 7, Lots 3-9 and
18-24 (Case 97-A) Damery. This'case was approved several years ago with
stipulations prior to recording. The Attorney reviewed the recent request and
noted that the same holds true at this time, the previous stipulations will have
to be taken care of - those are approval of the City Engineer, signatures of
the new owners of the Franklin lots, a plat, resolution and then recording.
The Commission had no objections to this being continued at this time and it
was noted that the signatures of the new owners have been obtained and that the"
plat will be presented and resolution drawn.
F. Review of Tidelands Application - North Pacific Trucking and Contracting -
Roy Jones. The plat was presented for review by the Commission in order that
they were aware of the application and the location. No objections were voiced
on either the application or location in Kalsin Bay.
G. Exception Request - Block 3, Lot 8, Leite Addn., Michael and Kathleen May.
A letter was read requesting an exception to the minimum lot width and noting` -
that the original home located on the lot had burned and the owners wanted-fo
rebuild at this time with the placement of a modular unit. The lot does have
the required area but is 50 feet wide rather than the required 60 foot width.
Mr. Edris moved for approval of the exception request, seconded by Mr. Constance..,
Motion passed by unanimous roll call vote.
IX SUBDIVISIONS, FINAL
A. Subdivision, final review and approval - Tom Felton - Tract B. U. S. Survey
2735 - rgbp;vlat was reviewed by -the Commission. The purpose of the
subdivision of this survey was for sale of the forty acres. Pair. Constance
moved for approval of the final plat of Tract B., U. S. Survey 2735, seconded
by Mr. Erwin. Motion passed by unanimous roll call vote.
X PLANNING & ZONING ITETvIS
A.
Mr. Constance re Building in Urban Renewal Area - Mr. Constance stated that
he has had many problems in setting up the new bakery and that word has been.
received that the set back must be more than first anticipated. His plan calls
for parking space for 26 cars and would allow plenty of space for the trucks.:
He wondered how other business Buildings had managed to. overcome some of the
obstacles and regulations placed on the lots by Alaska State Housing. It was
suggested to Mt. Constance that he seek a letter from the City of Kodiak in
which a request would be made for an exception to the regulations.
B. Mr. Welch re Changes in the Zoning Ordinance. Mr. Welch mentioned the fact
that he has been approached by many people concerning the zoning regulations.
There have many requests to have the R-1 Zones cut back in order to allow •
persons to build duplexes and thereby gain some assistance in meeting the high
cost of building. During the discussion it was brought out that there is a
definite need for changes; however, the entire R-1 zoning should not be done
away with completely. It was suggested that a very close look should be taken
on this matter and a work session date was set for June 2nd, 1971, at 7:30 P.M.
in the Offices of the Borough.

Gentlemen:
This is a request for an exception to put a modular home
on our property known as Lot 8, Block 3 of the Leite Addition.
The lot dimensions are 50 x 210 and the requirements for a new
residence indicate that the lot must be 60 feet wide.
The house Mike and I originally had was completely
destroyed by fire on October 12, 1969 and we would therefore like
to re -build on this lot.
The modular home dimensions are 24 feet by 60 feet, so
all the necessary set -back requirements will be met. There will
be 13 feet of space between the house and lot line on each side.
Your approval of this exception will be very much
appreciated.

The Special Meeting was called to order at 7;240 P.M. by Chairman Welch.

fifteen people in the audience.

III PURPOSE OF SPECIAL MEETING
A. Public Hearing - Additional Use in Unclassified Zone - Placement of
Sewer Treatment Plant, City of Kodiak. Prior to the public hearing being
opened Mr. Walker informed the Commission and the Audience that Mr. Chapman fron
"-the Egnineering firm of Tryck, Nyman and Hayes and Mr. Jones from the City
had planned to attend this meeting; however due to bad weather Mr. Chapman
hand been unable to make it into Kodiak. Mr. Walker recommended that the
public hearing be postponed until Mr. Chapman!s arrival. At this time people in
the audience asked questions about the plant and proposed location. The
general questions were answered by Mr. Walker and members of the Commission.
During the discussion Mr. Hinkle moved that since a few of the questions could
not be answered that this item be tabled until a later date when Mr. Chapman
could attend, seconded by Mr. Holt. The question was called and passed by
unanimous voice vote. As a matter of record, a petition signed by, thirty-six
people was presented to the Commission.
B. Public Hearing on Setback Variance Request - Michael M. and Kathleen May,
Block 3, Lot 8, Leite Addition. The regular meeting was closed and a public
hearing opened on the request. No comments were received. The public hearing
was closed and the meeting reconvened. Mr. Holt moved, seconded by Mr. Hinkle,
___t}at the variance be granted. The question was called and passed unanimously.`
C. Rezoning Request by Mr. Williams, Erskine Addn., From R-2 to R-3. Letter of
request was read by the Clerk and the area was located on the zoning map.
The Commission was informed that the information was being reviewed by Mr.
Madsen, Borough Attorney. Mr. Hinkle moved to postpone until an answer was
received from Mr. Madsen, motion died for lack of a second. Mr. Holt moved
to have a public hearing scheduled on the 17th of MQ., seconded by Mr. Hinkle'
with the motion to add if the answer from Mr. Madsen was received in time to
advertize).. The question was called and passed unanimously.

VIII SUBDIVISION, PRELIMINARY
A. Vacation and Replat of Allman Addition, Block 1) Lot 15 through 22,
Harold Sargent and John Fray. This request was being made in order to replat
the smaller lots, adding additional land in the back that would extend the
lot line to the proposed City easement along the lake and to allow for developmE
of business lots. Mr. Erwin moved for approval of a public hearing on the
request, seconded by Mr. Wheeler, motion passed by unanimous roll call vote.
B. Subdivision of Portion of U.S. Survey 3066 and Survey 2739, Bill Bardot.
The preliminary plat was studied and it was pointed out the three lots and
the boundary lines. It was stated that this was a subdivision rather than a
vacation and replat as the streets, water and sewer lines are already in this
subdivision. Mr. Wheeler moved for approval of the preliminary plat, seconded
by Mr. Erwin, motion passed by unanimous roll call vote.
IX SUBDIVISIONS, FINAL
A. Approval of Final Plat, Wright/Welborn, U.S. Survey 3218. The final plat was
studied. Mr. Hinkle moved for approval of the final plat of U.S. Survey 3218,
Vacation and Replat, contingent upon the approval of the Borough Engineer,
seconded by Mr. Wheeler. Motion passed by unanimous roll call vote.
X PLANNING & ZONING iTEMS
A. Letter received requesting a Setback Variance was read, Mr. & Mrs. May request
a setback variance for placement of modular unit which would be in line with
the other residences and Mr. Hinkle moved for approval of public hearing to
be held at the special meeting, seconded by Mr. Wheeler. The area in question
Lot 8, Block 3, Leite Addition.
B. Mr. Hinkle asked for discussion on the possibility of the Commission requesting
the rezoning of those lots that border on Benson & Mill Bay road from present
zoning to Business. This would allow the expansion of the business area and
would encourage out of town business interest to develop in Kodiak. He was
interested in the area contiguous to the Thorsheim Subd., that area just
past the library and teen center as well as the lots bordering the road.
Mr. Hinkle moved that the Commistion rezone to Business the following lots:
Aleutian Homes Subdivision, Block 8, Lots 1 through 8 and Lots 16 through 29;
Block 11, Lots 1 through 6 and also to include Lots 9, 10, 11, 12, 13 and
14 of Block 1, Allman Addition, seconded by Mr. Wheeler. Mbtion passed by
unanimous roll call vote.
XI AUDIENCE COMMENTS
One rnernber in the audience voiced the opinion that this was the logical step
to take as there are presently very few business lots available in downtown Kodiak.

Public Hearing on the School Budget for the 28th of April, 1972. A call was made

to be prepared for this date.

Gentlemen:
As the fee owner of Lot 8, Block 3, Leite Addition to
the City of Kodiak, I request a set back variance for the above
described lot.
The adjoining properties are improved with residences
set back approximately 15 feet from the public roadway. I request
a variance that would allow the construction of a modular unit
15 feet from the front lot line which would conform to the surround-
ing improvements.
The rear portion of the lot slopes downward to the level
of Potatopatch Lake which would make construction difficult,
requiring fill and increased foundation costs.
