Coprehensive 1an: The 1968 Comprehensive Plan identifies this area as public and opeh space. A small portion of the area lying north of the Municipal Airp&tt is shown as light industrial. 12. Applicahle Regulations: The foliowing sections of Title 17 (Zoning) of .theBoroughCode are applicable to this request: Chapter 17.72 1inendxnents and Changes. Section 17.72.030 Manner of Initiation. Cianges in this title inay be initiated by B. The Planning and Commissionupon its own motion and C. 13y petition of one or more owners of property within an area proposed to be rezoned. COMNENTS: .This rezone'request originates from two sources: a request by the property owner. (Kodiak Island Boroug)-i) and a inotion of the Planning and Zoning Cininis- sion. The requests by the .property owner and Conunission are different for 27 lots (Lots 2 through 28, Biock 4) in Lakeside Subdivision First Addition. The 1anningCommission Inotion on this rezorie requestecl PL --Public Use Lands • zoning :for these lots. The application from the owner requested the • R1--Sing1e-fami1yRsidentia1 zone. for these lots. A portion of the proposed rezone.area along Beaver Lake has recently received preliminary subdivision approval. (Lakeside S1ubdivision and Lakeside Subdivision First Addition). It shuld be noted that this rezone request is totaily independent of the two subdivision cases. •Issues to be.addressd in this rezone include conformance with the comprehen- sive plan, compatibi'lity with existing and potential land uses, separation of incompatible.land uss, andtrafficimpacts and adequate access. Coniprehensive Plan The 1968 comprehensiye plan'identifies the majority of this area as public and .open space and a sxnallportionnorth of the Municipal Airport as liyht indus- trial. The requeste1 Public Use Lands, Ri and R2 zones are essentially consistent with the omprehensive plan. More than 60 percent of the rezone • 'area is proposed for Pullic Use Lands, and these areas generaily have steep siopesor wet1and/inashy conditions that are not suitable for other types of • • developinent. The areas proposed for residential zoning districts generally have gentle slopes,:are covered predominantly with spruce trees, and appear to be well drained Compatibility with Existing and Potential Land Uses •The proposed zoning1assifications represent a traditional hierarchy of • zoning districts which should lead to development that is coxnpatible with Case No. 85-052 -3- August 21, 1985 existing land uses in the area. The arrangementof the requested districts should also result in compatible development within the rezone area. This is accoxnplished through the use of buffer strips, zoned Public Use Lands, that are located between the zoning districts that permit differing intensities of land use. For example, a greenbelt area zoned PL is proposed botween thse areas currently zoned Industrial and all proposed residential areas. Additional separation of industrial and residential classifications is provided in some areas by a coznbination of a greenbelt and adjacent road right-of-way. The proposed biockof R2 zoning is separated from proposed Ri areas by Beaver Lake Loop. Lastly, the land uses permitted under Ri and R2 residential zoning along the extension of Selief Lane will be compatible with the existing single-family resdentia1 uses alongthis road. Separation.f Incompatible Land Uses As:identifiedabove, the proposed zoning classifications provide adequate •.separationofincoinpatible land uses (residential and industrial) through provision of greenbelt areas zoned Public Use Lands. Additional separation is provided in some areas by a combination of greenbelts and road rights -of --way. - Traffic Irnpacts The largest inipact resulting from this rezone is likely to be traffic. Any development of this area wil]. result in increased traffic on the surrounding road system. At present, all trafflc generated along Selief Lane must use Thorsheim or 'Birch streets to reach the nearest arterial road (Mill Bay). With the extensionof Selief Lane to Von Schee].e Way, an additional outlet to Mill Bay Road will be available for land uses within the rezone area and for existing residences a1ong Sellef Lane. As a result, the overall traffic flow situation should beimproved with the Selief Larie extension. This fact was even recognizedin te 1968 Comprehensive Plari, which projected a Selief Lane extension toVon Sch+le Way. •Therefore, the land uses perinitted under the proposed rezoning shoi1d not 1-jave adverse traffic impacts on the surrounding road systemor land uses. S uiumary Evaluation of the potential impacts af this rezone leads to the conclusion that the requested zoning classifications are consistent with the comprehen- sive plan, appropriate for the land in question, will result in development that is compatible with existing development in the surrounding area, will provide for adequate buffers and separation of incompatible land uses, and will not result in adverse trafficimpacts. Regarding Lots 2 through 28,]3lock 4, Lakeside Subdivision First Addition, the question ofwhich requested zoni.ng district (Ri or PL) is the niost appropriate is debatable. The physica1characteristics of the lots, their location, and relationship to surrounding proposed zoning districts would indicate that either requested zone is appropriate. As the lots are designed and have receivedpreliminary plat approval for residential development, the staff - - rezoning these lots is to R1--Single-faxnily Residential. Case No. 85-052 -4- August 21, 1985 One further pointshouldbe made regarding Lots 7 and 8, Biock 1, Lakeside Subdivision. Lot 8 is theonly lot in this biock proposed for Ri zoning and is separated fromot'ier proposed residential lots by Selief Lane and Beay.er Lake Drive. If Lot 7 were not zoned PL, Lot 8 would be next to industrial land on those two sides. Staff fee].s that this isolated lot would not be appropriate. for resientia1 zoning. Other appropriate zones would be Industrial or PL for Lots7 and 8. However, as plattecl, these lots do not xneet the ininimuin lot sizerequireinents of the Industrial district. Therefore, the appropriate zoriing classification for Lots 7 and 8 is PL --Public Use Larids. Findings A. Findings as to the Need and Justification for a Change or Axnendment The'proposed zoning changes to R1 --Single-family Residential, R2 ---Two- family Residential, and PL --Public Use Lands will be appropriate for the : land area in question, provide adclitional public use lands, provide buffers between differing zoning districts, and provide residential zoning that is consistent with the recent preliminary subdivision approval of Lakeside Subdivision and Lakeside Subdivision First Addition. B..- Findings as to the Effect a Change or Amendnient Would Have on the Objectives of .the Cornprehensive Plan The requested zoning classifications will be generaily consistent with 'theobjectives otthe comprthensiveplan. Findings as to the need and justification for a change or amendment. The proposed zoriing changs to R1--Single-fainily Residential, I --Industrial, and PL --Public Use Lands will be appropriate for the land area in question, provide additional public use lands, provide buffers between differing zoning districts, and provide residential zoning that is consistent with the recent preliminary subdivision approval of Lakeside Subdivision. TI-xe Cornmission, in recommending that Biock 3, Lakeside Subdivision First Addition be zoned I --Industrial instead of R2--Two-fainily Residential, found that there was inadequate separation between potentially incompatible industrial and residential land uses. }3. (Kodiak Island Borough) in accordance with Chapter 17.72 (Ainendments and Changes) of the Borough Code. A -- Findings as to the Need and Justification for a Change or Amendinent. The proposed zoning changes to R1 --Single-family Residential, I --Industrial, and PL --Public Use Lands will be appropriate for the land area in question, will provide additional public use lands, will provide buffers between differing zoning districts, and will provide residential zoning that is consistent with the recent preliminary subdivision approval of Lakeside Subdivision. Pertaining to the rezoning of Biock 3, Lots 1-17, froin RR1 to Industrial instead of R2, essentially with those lots the proposed zoning classification would not provide adequate separation of incompatible land uses. Lot 1, Biock 2, was changed froB the requested R1 to PL to increase the buffer between residential and industrial zoning districts. The motion was seconded and CARRIED ly unanimous roll call vote. Commissioner Kxiight abstained. - E) COMNISSIONER JAMES MOVED TO ACCEPT THE FOLLOWING FINDINGS OF FACT FOR CASE 85-043. Request for the rezoning of the remaining portion of Tract G, 0.5. Existing Zoning: C --Conservation, I --Industrial, and RR1--Rural Residential cDne. 6. Zoning History: The 1968 Comprehensive Plan shows this area as residen- tial unclassified and a small portion as public and semi-public. Ordinance 77.f15_0 zoned lands not previously classified to Conservation. Those areas now zoned RR1 were rezoned froin Unclassified to RR by Ordinance 8049-0. Lot Size: Approximately 89 acres total. 9. Existing Land Use: Vacant open space that is densely forested. There are marshy aieas around Beaver Lake. Case No. 85-052 -2- August 21, 1985 10. Surrounding Land tJse and Zoning: North: South: East: West: See presentation map. 11. Comprehensive Plan: The 1968 Comprehensive Plan identifies this area as public and open space. A stnall portion of the area lying north of the Municipal Airport is shown as light industrial. 12. Applicable Regulations: The foliowing sections of Title 17 (Zoning) of the Borough Code are applicaiDle to this reguest: Chapter 17.72 Amendments and Changes. Section 17.72.030 Manner of Initiation. Changes in this title uiay be initiated by B. The Planning and Coimnission upon its own inotion and C. ]3y petition of one or inore owriers of property within an area proposed to be rezoned. COMNENTS: This rezone request originates from two sources: a request by the property owner (Kodiak Island Borough) and a motion of the Planning and Zoning Coitunis- sion. The requests by the property owner and Coininission are clifferent for 27 lots (Lots 2 through 28, Biock 4) in Lakeside Subdivision First Addition. The Planning Coxnmission motion on this rezone requested PL --Public Use Lands zoning for these lots. The application from the owner requested the R1--Single-faxnily Residential zone for these lots. A portion of the proposed rezone area along Beaver Lake has recently received prelixninary subdivision approval (Lakeside Subdivision and Lakeside Subdivision First Adclition). It should be noted that this rezone request is totally independent of the two subdivision cases. Issues to be addressed in this rezone include conforinance with the comprehen- sive plan, compatibility with existing and potential land uses, separation of incompatible land uses, and traffic impacts arid adequate access, Comprehensive Plan The 1968 cornprehensive plan identifies the iaajority of this area as public and open space and a small portion north of the Municipal Airport as light indus- trial. The requested Public Use Lands, Ri and R2 zones are essentially consistent with the comprehensive plan. More than 60 percent of the rezone area is proposed for Public Use Lands, and these areas generaily have steep siopes or wetland/tnarshy conditions that are not suitab1e for other types of development. The areas proposed for residential zoning districts generaily have gentle siopes, are covered predoininantly with spruce trees, and appear to be well drained. Compatibility with Existing and Potential Land Uses The proposed zoning classifications represerit a traditional hierarchy of zoning districts which should lead to development that is coinpatible with Case No. 85-052 -3- August 21, 1985 existing land use in the area. The arrangement of the requested districts should also result in coxnpatible development within the rezone area. This is accomplished through the use of buffer strips, zoned Public tJse Lands, that are located between the zoning districts that perinit differing intensities of land use. For example, a greenbelt area zoned PL is proposed between those areas currently zoned Industrial and all proposed residential areas. Additional separation of industrial and residential classifications is provided in some areas by a combination of a greenbelt and adjacent road right-of-way. The proposed biock of R2 zoning is separated from proposed Ri areas by Beaver Lake Loop. Lastly, the land uses permitted under Ri and R2 residential zoning along the extension of Selief Lane will be compatible with the existing single-family residential uses along this road. Separation of Incompatible Land Uses As identified aboye, the proposed zoning classifications provide adequate separation of incompatib].e land uses (residential and industrial) through provision of greeiibe1t areas zoned Public Use Lands. Additional separation is provided in some areas by a combination of greenbelts and road rights-of-way. Traffic Impacts The largest impact resulting from this rezone is likely to be traffic. Any development of ths area will result in increased traffic on the surrounding road system. At present, all traffic generated along Selief Lane must use Thorsheim or Birc1i streets to reach the nearest arterial road (Mill Bay). With the extension of Selief Lane to Von Scheele Way, an additional outlet to Mill Bay Road wi1. be available for land uses within the rezone area and for existing residences along Selief Lane. As a result, the overall traffic flow situation should le improved with the Selief Lane extension. This fact was even recognized irt the 1968 Comprehensive Plan, which projected a Selief Lane extension to Von Scheele Way. Therefore, the land uses permitted under the proposed rezoning should not have adverse traffic iinpacts on the surrounding road system or land uses. Suxnmary Evaluation of the potential impacts of this rezone leads to the conclusion that the requested zoning classifications are consistent with the comprehen- sive plan, appropriate for the land in question, will result in development that is compatible with existing development in the surrounding area, will provide for adequate buffers and separation of incompatible land uses, and will not result in adverse traffic impacts. Regarding Lots 2 through 28, Biock 4, Lakeside Subdivision First Addition, the question of which requested zoning district (Ri or PL) is the most appropriate is debatable. The physical characteristics of the lots, their location, and relationship to surrounding proposed zoning districts would indicate that either requested zone is appropriate. As the lots are designed and have received preliininary plat approval for residential development, the staff recoinmendation for rezoning these lots is to R1 --Single-family Residential. Case No. 85-052 -4- August 21, 1985 One further point Subdivision.. Lot is separated fron rTh / should be made reqarding Lots 7 arid 8, Biock 1, Lakeside 8 is the only lot in this biock proposed for R3. zoning and other proposed residential lots by Selief Larie and Beaver Lake Drive. If Lot 7 were not zoned PL, Lot 8 would be next to industrial land on those two sides. Staff feels that this isolated lot would not be appropriate for residential zoning. Other appropriate zones would be Industrialor PL or Lots 7 and 8. However, as platted, these lots do not rneet the minimum lot size requirements of the Industria]. district. Therefore, the appropriate zoning classification for Lots 7 and 8 is PL --Public Use Lands. Findings A. Findings as to the Need and Justification for a Change or Aineridment The proposed zoning changes to R1 --Single-family Residential, R2--Two- fainily Residential, and PL --Public Use Lands will be appropriate for the land area in question, provide additional public use lands, provide buffers between differing zoning districts, and provide residential zoning that is consistent with the recent prelixninary subdivision approval of Lakeside Subdivision and Lakeside Subdivision First Addition. B. Finclings as to the Effect a Change or Ainenchnent Would Have on the Objectives of the Comprehensive Plan The requested zoning classifications will be generaily consistent with the objectives of the comprehensive plan. RECOMNENDATION: Staff finds that this request meets all the required findings and therefore recoxnirtends that the Coinmission forward this rezone to the Borough Assembly reconiinending approval. APPROPRIATE MOTION: Should the Co!ninission agree with tlie staff recommendation, the appropriate motion is specified below: "Move to recoininend that the Borough Assembly approve the rezoning of Lots 1 through 9 and 11 through 19, Biock 2, Lakeside Subdivision revised preliminary plat (5-84-016 revised 4/22/85) from I ---Industrial to R1--Single- faxnily Resideritial; Lot 10, Biock 2; Lot 10, Biock 3; and Lots 7 and 8, Biock 2, Lakeside Subdivi- sion revised preliuiinary plat (S-84-016 revised 4/22/85) from I --Industrial and C --Conservation to PL--Publjc Use Lands; Lots 1 through 17, Biock 3, Lakeside Subdivision First Addition (S-85-012) from RR1--Rural Residential One to R2--Two-fainily Residential; Lots 2 through 28, Biock 4, Lakeside Subdivision First Addition (S-85-012) from RR1--Rural Residential Orie to R1 --Single-family Residential; Case No. 85-052 -5-.
