Sue K emzak spoke against the rezoning of the area and would like to see a definite plan so property owners would know what they are getting into when they buy the property. Lorna -Lee Arndt recommended R-2 for Crestview and felt nothing should be zoned Business or R-3. Marilyn Quaccia is not a resident of the area, disagreed with Mrs. Arndt that there is not a need for business land in Kodiak. There needs to be a plan, should not just blanket areas with R-2 zoning. Public Hearing closed. Regular Session reconvened. Steve Rennell, P & Z Commission, stated rezoning from R-1 to R-2 is a quantum leap. A lot of uses in R-2 are not family uses. Idea behind different designation is that people in the neighbor- hood would have a better idea of what the uses were going to be. The Commission held three Public Hearings and people in the area definitely want it to be rezoned. Sue Klemzak added that there is a higher density in the area now and the nature of area is changing. There is water and sewer in the area now. *In response to questions from the Assembly, Sid Cozart stated that no one was in favor of R-3 except one individual who was a real estate agent trying to sell property. He was against Business. He reiterated that at the P & Z hear- ings, most people were in favor of R-2, now they're against that. He wants it rezoned now. Motion carried by unanimous voice vote. Mayor Peterson called for a five minute recess. Regular Meeting opened. B. Ord. No. 85-29-0 Rezoning The "Lakeside Subdivision Area". - - Ms. Barker, moved to amend by substitution Ord. No. 85-29-0(AI. Seconded by Mr. White. Motion carried by unanimous voice vote. Amendment has been adopted. - Regular Meeting closed. Public Nearing opened. Lisa Schultz lives on Selief Lane and stated they bought a house in a nice residential area three years ago. Now this is an area where they are building apartments and duplexes which wasn't why they bought there. They don't think the area is planned well. She felt it should be R-1 completely and should be large lots. Dale Soughers stated that if Industrial zoning is given up for R-2 zoning which is higher density, it seems the planning is for housing a lot of people but not planning for them to work. A situation is not being created where these people can work. Maureen Butler spoke against the Ordinance. The area has R-1, R-2, and Industrial zones. She didn't feel that all these zones needed to be developed in such a small aiea. She suggested developing one zone in this area and developing another zone with a green belt would be:more realistic. She felt there is a need K.I.B. Asse ng ..!October 1: 1985 for all these zones but when all are put together, no one is going to be happy. She wants to the area developed properly. Dait Field., a resident of Dark Leas spoke for his family and his parentse on vacation. Hs said that things change over the years. Seven years ago no one wanted industrial in the area. He appreciated the reinstatement of Public Use lands around Beaver Lake for park. He said that he could live with R-1. He was adamantly opposed to Block i put into W-2. He did not want to compromise on the R-2 for this area. ike Anderson stated that he was opposed to the R-2 block.' He said it was too close an Industrial zone and conflicts with • neighbors will occur. The land in this area is Borough land and if it is going to be disposed of, he thinks it should be at an auction or in some other manner where everybody has a chance at it. Marilyn guaccia opposed the rezoning only because it precludes the sale of the land to the Kodiak Housing Authority. Also, she thought there was too much usage in a small area. Debbie Fuelling lives a couple of blocks from Beaver Lake. She appreciated the fact the area around Beaver Lake was zoned for Public Use. She would like to see the whole area zoned as R-1. George Griffing lives on Selief Lane and appreciates the rezoning to Public Use Lands. He does not appreciate the hodge podge of different zoning in the area. He feels the rules are changing and would like to see R-1 in the area. He said the zoning change would adversely affect the value of the people's houses that are already there. Marlene Wanzak spoke in favor of rezoning.to R-2. Lee Carney is a resident of Selief Lane but not a property owner. She appreciated the rezoning of the land around Beaver Lake as it enhances the quality of her life in Kodiak. Yirs Eggemeyer stated that his family had lived in Kodiak for a long time. He said that as far as the Industrial zoning goes, look at downtown Kodiak, business needs to go someplace. Okey Chandler said there was no shortage of houses because one house out of ten was for sale. He could see no reason for crowding R-2 in the area and R-1 was dense enough. Sid Cozart lives about five miles from this area. He said Selief Lane was one of the most unorganized zoning areas he had ever seen in his life. He stated that there was no access to it and there was no.rhyme or reason to the whole thing. Stacy Pillow said for the record that she lived about half a inule from the proposed R-2 area and was for it. Clarence Selig stated that he has been in Kodiak for quite a few years. He was in favor of the rezoning as it has been stated. He thanked the Assembly for thinking about the park lands. - Marlin Knight said he thought initially the Borough Assembly had in mind to rezone the area R-1; a higher overall density than what is proposed now. He stated that it was a third of what was originally proposed by the Borough Assembly and through the Public Hearing process changes had been made. He said that some people thought the Housing Authority was doing something under- handed by presenting a proposal to the Assembly. He said it was done in good faith. They were are not asking for a give-away and they were paying fair market value for the property. He was trying to set the record straight. Ken Parker spoke for the rezoning and thought it was a compromise over what was presented several month ago. He said he was a participant of the Housing Authority's program and could stand to gain from this program i regardless, he thought the rezoning was good. 4 October 3, 1985 Lorna -Lee Arndt spoke against zoning. She thought the area Should be Used for a school. Said if the area wee used for low incoming housing no taxesi be paid for 25 years. Donene Tweeten opposed R-2 in the area. She thanked the Assembly for rezoning Beaver Lake to Public Land use. Janice Nixon spoke in favor of the rezoning the Area to R-2. Scott Arndt stated that Kodiak needs an Industrial area and feels such an area needs to be created. He does not feel Block 3 should be zoned residential. Cliff Vogelsberg opposed R-2 rezoning. He applauded making the lake side property Public Lands. John Jensen lives on Selief Lane. He thanked the Assembly for putting the Public Use lands around the lake. He was in favor of low-income housing but opposed to it being located in this area. Scarlet Parker spoke in favor of the rezoning the area to R-2. Public Hearing closed. Regular Meeting opened. . Wanted the economic base empha- sized for a change. Felt the Fisheries Industrial Technology Center should be first on the list. Lorna Arndt felt the School Repairs should be Number 1 and listed other improvements in the order that she thought of importance. John Witteveen thanked the Assembly for the capital list and supported passage in the order listed. Okey Chandler felt the community needs other things worse than a new hospital. John French doesn't see how we are going to maintain the indus- trial base without a Fisheries Industrial Technology Center. He felt it should be a clear individual priority above the other capital priorities. Steve Rennell felt Solid Waste Disposal Site should be No. 1. Need to follow through on this issue. John Parker thought the capital project No. 9 Borough Apart- ments/Upgrade needed to be changed to catch the attention of the legislature and reflect the true nature of the use of these apartments. Horace Simmons felt the Fisheries Industrial Technology Center should be moved up in front of the Hospital in priorities. K.I.B. COMMENTS: ...This rezone request originates from two sources: a request by the property owner. (Kodiak Island. Boroug)-i) and a motion of the Planning and Zoning Commis- sion. The requests by the property owner and Commission are different for 27 lots (Lots 2 through 28, Block 4) in Lakeside Subdivision First Addition. The Planning.Commission motion on this rezone requested PL --Public Use Lands ..*zoning for these lots. The application from the owner requested the .41—Single-family Residential zone for these lots. A portion of the proposed • rezone area along Beaver Lake has recently received preliminary subdivision approval (Lakeside Slubdivision and Lakeside Subdivision First Addition). It should be noted that this rezone request is totally independent of the two subdivision cases. , • Issues to be_addressed in this rezone include conformance with the comprehen- sive plan, compatibility with existing and potential land uses, separation of incompatible land uses, and traffic impacts and adequate access. Comprehensive Plan The 1968 comprehensive plan identifies the majority of this area as public and .open space and a small portion north of the Municipal Airport as light indus- trial. The requested Public Use Lands, R1 and R2 zones are essentially 'consistent with the Comprehensive plan. More than 60 percent of the rezone •' area is proposed for Public Use Lands, and these areas generally have steep slopes or wetland/marshy conditions that are not suitable for other types of development. The areas proposed for residential zoning districts generally have gentle slopes, are covered predominantly with spruce trees, and appear to be well drained. - Compatibility with Existing and Potential Land Uses •The proposed zoning classifications represent a traditional hierarchy of • zoning districts which should lead to development that is compatible with Case No. 85-052 -3- August 21, 1985 7 existing land uses in the area. The arrangement'of the requested districts should also result in compatible development within the rezone area. This is accomplished through the use of buffer strips, zoned Public Use Lands, that are located between the zoning districts that permit differing intensities of .land use. • • For example, a greenbelt area zoned PL is proposed between those areas currently zoned Industrial and all proposed residential areas. Additional separation of industrial and residential classifications is provided in some areas by a combination of a greenbelt and adjacent road right-of-way. The proposed block,of R2 zoning is separated from proposed R1 areas by Beaver Lake Loop. Lastly, the land uses permitted under R1 and R2 residential zoning along the extension of Selief Lane will be compatible with the existing single-family residential uses along this road. Separation of Incompatible Land Uses As identified above, the proposed zoning classifications provide adequate separation of incompatible land uses (residential and industrial) through provision of greenbelt areas zoned Public Use Lands. Additional separation is provided in some areas by a combination of greenbelts and road rights-of-way. • .-Traffic Impacts The largest impact resulting from this rezone is likely to be traffic. Any development of this area will result in increased traffic on the surrounding road system. At present, all traffic generated along Selief Lane must use Thorsheim or Birch streets to reach the nearest arterial road (Mill Bay). With the extension'of Selief Lane to Von Scheele Way, an additional outlet to Mill Bay Road Will be available for land uses within the rezone area and for existing residences along Selief Lane. As a result, the overall traffic flow situation should be 'improved with the Selief Lane extension. This fact was even recognized in thr 1968 Comprehensive Plan, which projected a Selief Lane extension to Von Scheele Way. 'Therefore, the land uses permitted under the I - proposed rezoning shTld not have adverse traffic impacts on the surrounding road system or land uses. Summary Evaluation of the potential impacts of this rezone leads to the conclusion that the requested zoning classifications are consistent with the comprehen- sive plan, appropriate for the land in question, will result in development . that is compatible with existing development in the surrounding area, will . provide for adequate buffers and separation of incompatible land uses, and will not result in adverse traffic impacts. • Regarding Lots 2 through 28, Block 4, Lakeside Subdivision First Addition, the question of which requested zoning district (R1 or PL) is the most appropriate is debatable. The physical characteristics of the lots, their location, and relationship to surrounding proposed zoning districts would indicate that either requested zone is appropriate. As the lots are designed and have received preliminary plat approval for residential development, the staff recommendation for rezoning these lots is to RI—Single-family Residential. Case No. 85-052 -4- August 21, 1985 One further point should.be made regarding Lots 7 and 8, Block 1, Lakeside Subdivision. Lot 8 is the only lot in this block proposed for R1 zoning and is separated from cyOler proposed residential lots by Selief Lane and Beaver . Lake Drive. If Lot 7 were not zoned PL, Lot 8 would be next to industrial land on those two sides. Staff feels that this isolated lot would not be appropriate. for residential zoning. Other appropriate zones would be Industrial or PL for Lots 7 and 8. However, as platted, these lots do not meet the minimum lot size requirements of the Industrial district. Therefore, the appropriate zoning classification for Lots 7 and 8 is PL --Public Use Lands. ..Findings A. COMMENTS: This rezone request originates from two sources: a request by the property owner (Kodiak Island Borough) and a motion of the Planning and Zoning Commis- sion. The requests by the property owner and Commission are different for 27 lots (Lots 2 through 28, Block 4) in Lakeside Subdivision First Addition. The Planning Commission motion on this rezone requested PL --Public Use Lands zoning for these lots. The application from the owner requested the R1 --Single-family Residential zone for these lots. A portion of the proposed rezone area along Beaver Lake has recently received preliminary subdivision approval (Lakeside Subdivision and Lakeside Subdivision First Addition). It should be noted that this rezone request is totally independent of the two subdivision cases. Issues to be addressed in this rezone include conformance with the comprehen- sive plan, compatibility with existing and potential land uses, separation of incompatible land uses, and traffic impacts and adequate access. Comprehensive Plan The 1968 comprehensive plan identifies the majority of this area as public and open space and a small portion north of the Municipal Airport as light indus- trial. The requested Public Use Lands, R1 and R2 zones are essentially consistent with the comprehensive plan. More than 60 percent of the rezone area is proposed for Public Use Lands, and these areas generally have steep slopes or wetland/marshy conditions that are not suitable for other types of development. The areas proposed for residential zoning districts generally have gentle slopes, are covered predominantly with spruce trees, and appear to be well drained. Compatibility with Existing and Potential Land Uses The proposed zoning classifications represent a traditional hierarchy of zoning districts which should lead to development that is compatible with Case No. 85-052 -3- August 21, 1985 existing land usep in the area. The arrangement of the requested districts should also result in compatible development within the rezone area. This is accomplished through the use of buffer strips, zoned Public Use Lands, that are located between the zoning districts that permit differing intensities of land use. For example, a greenbelt area zoned PL is proposed between those areas currently zoned Industrial and all proposed residential areas. Additional separation of industrial and residential classifications is provided in some areas by a combination of a greenbelt and adjacent road right-of-way. The proposed block of R2 zoning is separated from proposed R1 areas by Beaver Lake Loop. Lastly, the land uses permitted under R1 and R2 residential zoning along the extension of Selief Lane will be compatible with the existing single-family residential uses along this road. Separation of Incompatible Land Uses 1 As identified aboye, the proposed zoning classifications provide adequate separation of incompatible land uses (residential and industrial) through provision of greerlibelt areas zoned Public Use Lands. Additional separation is provided in some areas by a combination of greenbelts and road rights-of-way. Traffic Impacts The largest impact resulting from this rezone is likely to be traffic. Any development of this area will result in increased traffic on the surrounding road system. At present, all traffic generated along Selief Lane must use Thorsheim or Birclii streets to reach the nearest arterial road (Mill Bay). With the extension of Selief Lane to Von Scheele Way, an additional outlet to Mill Bay Road wili be available for land uses within the rezone area and for existing residences along Selief Lane. As a result, the overall traffic flow situation should le improved with the Selief Lane extension. This fact was even recognized irt the 1968 Comprehensive Plan, which projected a Selief Lane extension to Von Scheele Way. Therefore, the land uses permitted under the proposed rezoning should not have adverse traffic impacts on the surrounding road system or land uses. Summary Evaluation of the potential impacts of this rezone leads to the conclusion that the requested zoning classifications are consistent with the comprehen- sive plan, appropriate for the land in question, will result in development that is compatible with existing development in the surrounding area, will provide for adequate buffers and separation of incompatible land uses, and will not result in adverse traffic impacts. Regarding Lots 2 through 28, Block 4, Lakeside Subdivision First Addition, the question of which requested zoning district (R1 or PL) is the most appropriate is debatable. The physical characteristics of the lots, their location, and relationship to surrounding proposed zoning districts would indicate that either requested zone is appropriate. As the lots are designed and have received preliminary plat approval for residential development, the staff recommendation for rezoning these lots is to R1 --Single-family Residential. Case No. 85-052 -4- August 21, 1985 One further point Subdivision. Lot is separated from rTh should be made regarding Lots 7 and 8, Block 1, Lakeside 8 is the only lot in this block proposed for R1 zoning and other proposed residential lots by Selief Lane and Beaver Lake Drive. If Lot 7 were not zoned PL, Lot 8 would be next to industrial land on those two sides. Staff feels that this isolated lot would not be appropriate for residential zoning. Other appropriate zones would be Industrial or PL For Lots 7 and 8. However, as platted, these lots do not meet the minimum lot size requirements of the Industrial district. Therefore, the appropriate zoning classification for Lots 7 and 8 is PL --Public Use Lands. Findings A. Findings as to the Need and Justification for a Change or Amendment The proposed zoning changes to RI—Single-family Residential, R2 --Two- family Residential, and PL --Public Use Lands will be appropriate for the land area in question, provide additional public use lands, provide buffers between differing zoning districts, and provide residential zoning that is consistent with the recent preliminary subdivision approval of Lakeside Subdivision and Lakeside Subdivision First Addition. B. Findings as to the Effect a Change or Amendment Would Have on the Objectives of the Comprehensive Plan The requested zoning classifications will be generally consistent with the objectives of the comprehensive plan. RECOMMENDATION: Staff finds that this request meets all the required findings and therefore recommends that the Commission forward this rezone to the Borough Assembly recommending approval.
