Newland, JoAnn 5/21/83 Box 356 Kodiak i I would like to appeal the recent decision made at the -5-18-83 KIB Planning and Zoning Commission meeting.. 11y original request for a conditional use permit to operate a. day care center for approximately (20) children in a single family home on Lot 5, Block 1, Leite addition is hereby amended to reduce the total children'the Boro stat- ed as requested in• the home and to clarify concerns of local residents. i 1 �' { As the state DCAP is authorized to license (10) children', my intent was to provide more comprehensive service to a greater number of children, -approx- imately (20). Hbw,that request was publicized eventually listed "up to 45" ; children was notIthe service I intended. j i i Prior to that public hearing on 5-18-83, my family had assisted] modify- ing our dwellingrby the following methods: i The residence is R-1, but had been previously structured'to house (2) families. 'We have never'had any intention of converting the home to strictly a day care facility, but to operate the center while resid- ing within the home. We renovated to the point of placing stairs inside the dwelling to provide access to both levels without going , out of doors. Along with'the ordinary and necessary painting, plastering, carpeting and the like, we also completely fenced in the back yard (2095 sq. ft.) and installed a deck, a. swingset/gym and merry go round. One side of the house has a double wide drive 30 x- 24, and the other a single' drive 30 x 8, providing parking for 8-12 vehicles within 960 sq. ft. The exclusive child care,portion of the home contains (3) activity rooms of 288 sq. ft., 176 sq. ft. and 120 sq. ft. The downstairs also contains an 84 sq. ft. "sick room", 120 sq. ft, kitchen and 99 'eq.'ft.:bathroom. Upstairs where the family residence is contain- ed we havej(2) bathrooms for the,childrens use. 1 In accord with the stipulations for a conditional use permit,!we have made I every effort to conform with maintaining this residential property in keep- ing with the surrounding area. The immediate (3) block area holds (2) churches - Berean Baptist and Seventh Day Adventist, (which houses Small World Day Care) the Baranoff Park and a multitude of family owned'fishing businesses operated from the home with residential lots used as gear storage for business. We have posted within the center the required Fire Department Certification along with State;Department of Environmental Conservation Eating and Drinking Establishment Permit to comply with all existing regulations and codes. We feel our close proximity to the park and public schools ,with a main artery as.Rezanoff, is to be an advantage in relieving congestion'that?. might otherwise occur in any residential area within this city, we are' easily accessible by Rezanoff, 8th St., 9th St., Ismailov and Mission., toads. Mr. Newland observed on Friday morning in front of our residence the follow- ing # of vehicles at the times stated: 1 6:30 - 7:30 - (2) cars drove by 7:30 - 8:30 . - (4) cars drove by 3:30 - 4:30 - (4) cars drove by 4:30 - 5:30 - (5)'pars drove by a Although a portion:of Ismailov which does not pass in front of our house is used often to connect Mission to Rezanoff,but as stated only relieves congested traffic unrelated to our business. We have developed established procedures related to reducing noise and containing outdoor play strictly to. the specified fenced area.We plan to operate only during regular daytime work hours, i.e. 6:30 a.m. to 6:30 p.m. and thereby avoid disruption to the neighborhood. We arrived at a figure of (20) children based on the fact that; our current enrollment is significantly (2) children per family, at the most- 8 or 10 cars twice a day (piclaup and drop off). Only with (20) children will the center be affordable for myself and one aide. We would like to extend an open invitation to our neighbors to review the premises. To the Bora Assembly, who may be completly unfamiliar with our operation as they are not residing in this neighborhood, to visit our center and formulate their own opionions prior to review of this appeal. Requested Action - Conditional Use Permit Approval. 4. Purpose - To allow the operation of a day care facility from a single family residence at 1326 Ismalov Street. 5. Existing Zoning - R1 -Single Family Residential. 6. Zoning History - The zoning history for this property is similar to the previous case in that this lot was included in the December 1976 request to be rezoned from R1 -Single Family Residential to R2 -Two Family Residential. The request was denied by the Kodiak Island Borough Assembly at their January 14, 1977 public hearing. (Case Z -415-A). 7. Location - On Ismalov Street between Rezanof Drive and Mission Road, two blocks southeast from Baranof Park. 8. Size - 6,313 square feet. 9. Existing Land Use - 1,380 square foot single family residence used as the Newland family residence. Case 83-046 Page 2 May 11, 1983 10. Surrounding Land Use and Zoning - North - Single Family Residential & R1 South - Single Family Residential & R1 East - Single Family Residential & R1 West - Single Family Residential & R1 11. Comprehensive Plan - The Comprehensive Plan identifies this property as Medium Density Residential. 12. Applicable Regulations - 17.18.030(A) permitted uses and 17.67.010 through 17.67.080 Conditional use permits. COMMENTS The permitted uses in an R1 -Single Family Residential Land -Use District do not expressly permit Day Care Centers and therefore this conditional use permit is requested by Mrs. Newland to be allowed to operate such a facility. All necessary permits and approvals have been obtained by the applicant from the State of Alaska and City of Kodiak. Copies of these permits are included in this staff report for your review. It is our understanding that initially 20 children are expected to be utilizing this facility with a future possible:growth to: 45 children. With 960 square feet of land area available for off street park- ing, staff finds that the applicant can meet the off street park- ing requirements for this type of use. A total of eight (8) off street parking spaces are available and six (6) spaces are required if 4 employees are used in the operation of the day care facility, plus two spaces for the residence. In granting the Conditional Use Permit the Commission must also make the following findings: A. That the conditional use will preserve the value, spirit, character and .integrity of the surrounding area; B. That the conditional use fulfills:;all other.re- quirements of this chapter pertaining to the conditional use in question; C. That granting the conditional use permit will not be harmful to the public health, safety, convenience and comfort; D. That sufficient setbacks, lot area, buffers or other safeguards are being provided to meet the conditions listed in subsections A through C of this section; and E. If the permit is for a public use or structure, the Commission must find that the proposed useoor structure is located in a manner which will maximize public benefits. The.rear yard area of Lot 5 be the only area used by the children for a play area; and 2.
