It has come to our attention that you have located a motor home in your back yard, on the lot
referenced above, which is zoned R1 -Single Family Residential (code section enclosed). This
letter is intended to inform you of the regulations of the R1 zoning district, as well as Chapter
17.53, Recreational Vehicle Parks (also enclosed) .
KIBC Section 17.18.020 Permitted Uses, states in part: "The following land uses and activities
are permitted in the single-family residential district F. Single-family dwellings." Since this
property is zoned R1 -Single-family Residential, the use of motor home as a permanent separate
dwelling unit is a violation of the Kodiak Island Borough Code. However, KIBC Section
17.53.050 Recreational vehicles on individual lots does allow provisions for the temporary use
(a maximum of sixty [60] days)of a recreational vehicle on a residential lot, if authorized by a
zoning compliance permit, which can be obtained from our office. The intent of this section is to
provide locations for the temporary use of recreational vehicles by visitors and tourists. In
addition, the City of Kodiak has guidelines regarding recreational vehicles being used as
temporary lodging within the City limits. A copy of Kodiak City Code Chapter 14.20 Mobile
Homes is also included for your information.
This letter is being sent as a courtesy. If this motor home is being used as a temporary dwelling
unit, you need to obtain a zoning compliance permit from this office, as well as a temporary
visitor permit from the City of Kodiak.

Here is the written confirmation you requested regarding the continued use of the
"grandfathered" apartment above the garage.
A review of Borough assessing records show Lots 15A and 16, Leite'Subdivision as
being located in a R14 -Single -Family Residential Zoning District used as a single
family residence with a detached garage with an apartment above. City of Kodiak
records show water, sewer and garbage being paid on two dwellings since before
June 1980. A conversation with the previous owner, Dave Nease, on March 30, 1988
indicated the apartment was being used continuously until taken over by the bank.
Since that time boththe main dwelling and apartment have been vacant. This
vacancy is not construed to be an abandonment or discontinuation of the use
because banks are ndt in the habit of abandoning use, but rather manage the
property as is until they sell it.
Therefore, as long as the apartment above the garage, as established prior to June
1980, remains the same and is used in accordance with Kodiak Island Borough Code
17.36, Existing Nonconforming Uses and Structures, copy attached, the
nonconforming status runs with the property.
