Lot 13, Leite Subdivision Dear Mr. Clymer:, As you are aware, the Planning and Zoning Commission granted your request for a variance to construct a greenhouse on July 18, 1984. This variance allowed the greenhouse to encroach seven (7) feet into the required twenty-five (25) foot front yard setback. As we discussed on January 10, 1986, the Borough records do not show that zoning compliance. or a building permit have been issued for the greenhouse even though it has been built. As agreed in our conversation, please come in to the Community Development Department to obtain zoning compliance and a building permit. Mr. Crowe noted that fourteen public hearing notices had been sent out and, that two notices had been returned in favor of the request as long as Tract "A" was not proposed for further subdivision at this time. BURL CLYMER, applicant, pointed out to the Commission that the main purpose of the construction is for solar heating. MR. TONY PEREZ spoke in favor of granting the variance. Purpose: The purpose of this request is to permit construction of a passive solar greenhouse. 5. Existing Zoning: R1 6. Zoning History: The 1968 Comprehensive Plan indicates the zoning of this lot as R1. Departmental files show no additional activity. 7. Location: Lot 13, Leite Subdivision; 1311 Mission Road. 8. Lot Size: 4,669 square feet. 9. Existing Land Use: Single-family residence. 10. Surrounding Land Use and Zoning: North: Lot 5, Leite Subdivision; Zoning -R1; Use -vacant South: Mission Road East: Lot 12, Leite Subdivision; Zoning -R1; Use -vacant West: Lot 14, Leite Subdivision; Zoning -R1; Use -R1 11. Comprehensive Plan: The Comprehensive Plan shows this area as "medium";density residential. 12. Applicable Regulations: Chapter 17.18 (Single-family Residential), Section 17.18.050A (Yards) of Borough code states that the minimum front setback shall be 25 feet. COMMENTS: The applicant proposes to construct a greenhouse onto the front of his house to takeiadvantage of both the sun's heat as well as that of a fireplace. Both are found on the south side of the home. He will encroach seven feet into the required front yard setback of 25 feet. RECOMMENDATION: Staff recommends approval of this request because it meets all the requirements of'granting a variance.
