After recently discussing our intentionsAof adding a10' x 10'
bedroom into our existing garage with Mr. Bob Schulze, we
discovered the garage is located in the rear setback. This letter
is in response to the memorandum dated November 5, 1993 in our
file.
From our investigation, we have concluded that Mr. and Mrs.
Burl Clymer were the second owners of Lot 13 in the Leite
Subdivsion, we are the fourth owners. When they purchased this
non -conforming lot, the property had ka small house built in 1948
with a quonset hut located at the rear of the house. In 1984, they
began renovating.
Their first project consisted of knocking down the quonset hut
and extending the house, adding a bedroom, bath, and garage. On
June 22, 1984, Mr. Burl Clymer was issued a zoning
compliance/building permit #5262 for the above. On this permit, it
clearly states the corner markers needed to be in place to verify
the set backs. Even though the garage was built into the setbacks,
the frame, plumbing, and electrical was approved by the Chief
Building Official on September 24, 1984.
Before the Clymers added a greenhouse in front of the house,
a variance was granted. On January 16, 1986 the addition was
approved (zoning compliance/building permit #86004).
In January, 1987, the roof on the 1984 addition (garage,
bedroom, and bath) began to leak. The Clymers applied for a
building permit (#87008) to change the flat roof to a peaked roof.
Once again, a building official was on the property, and the roof
was approved.
In less than three years, a building official was on the
property at least three times. In fact, two visits specifically
involved the garage in question. One of which approved the
structure.

The approved garage is two feet from the property line. We
can find a variance for the greenhouse addition, but not for the
garage. Unfortunately, we can not ask Mr. Clymer since he has
passed away. For almost ten years, the approved garage has been
allowed to stand without objection.

According to the Assessing file, in 1983 there existed a quonset
shed at the rear of the house. In June of 1984 zoning complaince
and building permits were issued for an addition onto the rear of
the house. Eventhough the zoning compliance permit accompaning
the building permit (#5262) clearly indicates the code
requirement (at that time) for a 25 ft. rear yard setback and the
building permit itself specifically references property corner
identification for verification of setbacks, the garage attached
onto the rear of the house apparently was built within .2 feet of
the rear lot ;kine . There is - no indication in the file that a
variance was applied for.
