A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY DECLARING CERTAIN
BOROUGH LAND SURPLUS FOR MUNICIPAL PURPOSES AND AUTHORIZING THE EXCHANGE OF
LANDS FOR THE LARSEN BAY SCHOOL CLASSROOM ADDITION.
WHEREAS, additional land is required to provide the proper building
setbacks for the Larsen Bay School addition in conformance with the Uniform
Building code and Kodiak Island Borough Zoning Code; and
WHEREAS, the City of Larsen Bay is the adjacent land owner and the
Borough has entered into negotiations to exchange land for the purpose of
constructing the Larsen Bay School addition; and
WHEREAS, the Borough is offering in exchange a deed restricted
portion of a R1 -Single Family zoned land, and a substandard building
previously utilized as a school; and
WHEREAS, the Borough will receive a portion of a R1 -Single Family
Residential lot; and
WHEREAS, the Kodiak Island Borough Planning and Zoning Commission
has held an advertised and noticed public hearing and recommends approval of
the land exchange.
NOW, THEREFORE, BE IT RESOLVED, that the Kodiak Island Borough
Assembly declares a portion of Block 11, Tract A, Larsen Bay Townsite surplus
for municipal purposes and directs the Mayor consummate the exchange.
BE IT FURTHER RESOLVED, that the exchange of property be based on
similar property values with costs associated with surveying and platting be
borne by the Kodiak Island Borough.

CASE 86-093 Planning and Zoning Commission review of an exchange of
land between the Kodiak Island Borough and the City of Larsen Bay

Planning and Zoning Commission Recommendation
The Planning and Zoning Commission at their November 19, 1986
meeting is recommending approval of a land exchange between the
Kodiak Island Borough and the City of Larsen Bay.
Background
In reviewing site design alternatives for the Larsen Bay School
addition, it became apparent that the present site offered many
limitations to building. The topography of the parcel requires the
new wing be built on the lot line.
Because of the setback requirements of structures from the property
line as determined by the Uniform Building Code and Kodiak Island
Borough Zoning Code, additional lands are needed. The parcel to be
acquired is adjacent to the school site and owned by the City of
Larsen Bay. This parcel is 8,400 square feet.
The parcel the Borough is offering for trade is a portion of Tract
A, Larsen Bay Townsite, and contains 16,800 square feet. The
property was deeded to the Borough by the Larsen Bay Native
Corporation to be used for school purposes only. Efforts are
underway to lift those restrictions from the portion of the lot to
be traded.
The City of Larsen Bay has expressed interest in this property and
the associated structure which will be utilized by the City for
public purposes. The structure is currently utilized as a school
and will be replaced by the new wing. The Borough is not interested
in the building and it probably would have been destroyed. The City
of Larsen Bay will receive title to the building.

III. Assembly Action
Kodiak Island Borough Code Section 18.80.020(1) states: After
receipt of the recommendations provided by the Planning and Zoning
Commission, "the assembly may find the Borough real property to be
exchanged is no longer required for municipal purposes and direct
the exchange be consummated in a manner and by terms established by
resolution.
IV. Recommendation
Staff recommends that the property to be exchanged is surplus to
Borough needs and the exchange should be consummated in a manner and
based on terms established in the attached resolution.

A RESOLUTION OF THE LARSEN BAY CITY COUNCIL APPROVING VACATION
OF "F" STREET AND AGREEING TO THE EXCHANGE OF CERTAIN CITY LANDS WITH THE
KODIAK ISLAND BOROUGH FOR EXPANSION OF THE LARSEN BAY SCHOOL.
WHEREAS, the expansion of the Larsen Bay School would utilize
properly owned by the City of Larsen Bay; and
WHEREAS, the Kodiak Island Borough has requested the vacation of
"F" -Street and the exchange of land owned by the City of Larsen Bay for
land owned by the Kodiak Island Borough; and
WHEREAS, the vacation and exchange of said properties is of
equal size and value, and
WHEREAS, the utilization of the property is for public purposes.
NOW, THEREFORE BE IT RESOLVED, that the City Council of Larsen
Bay has reviewed and approves the vacation of "F" Street and exchange of
property with the Kodiak Island Borough for the purpose of school
expansion.
BE IT FURTHER RESOLVED, the Kodiak Island Borough will incur
surveying, platting and recording costs..

After a physical inspection and evaluation of the lot portions being
considered for a trade between the City of Larsen Bay and the Kodiak
Island Borough, I offer the following renditions of value:
* Parcel N1: The northwest corner of Block 11, Larsen Bay
Townsite, measuring 130' by 140' and containing approximately
18,200 square feet. Estimated Value - 51180, one thousand.one
hundred eighty dollars.
* Parcel *2: The easterly one half of Lot 5 Block 12, Larsen .
Bay Townsite, measuring 50' by 210' and containing approximately
10,500 square feet. Estimated Value - 5680, six hundred eighty
dollars.
Parcel 0 3: The existing school building located on parcel 81.
Estimated Value - $12,000, twelve thousand dollars.
The building value is based on replacement cost less accrued
depreciation and an estimated cost of S15-20,000 for the removal of
asbestos bearing material within the structure.(This estimate was supplied

A RESOLUTION OF THE KODIAK ISLAND BOROUGH PLANNING AND ZONING
COMMISSION RECOMMENDING THE EXCHANGE OF BOROUGH PROPERTY TO ACQUIRE LAND FOR
THE LARSEN BAY SCHOOL ADDITION.
WHEREAS, the Borough has entered into negotiations to acquire lands
adjacent to the Larsen Bay School for construction of a proposed classroom
expansion, and

WHEREAS, the Borough is offering publically own land in Larsen Bay
in exchange for said parcel; and
WHEREAS, the exchange of real property is in the public's best
interest'as the land to be acquired is critical for public facility expansion;
and
WHEREAS, a method for determining values of the properties to be
exchanged has been provided by the Borough Assessor; and
WHEREAS, evidence of marketable titles of the parcels exist in the
property records of the Borough Assessors Office; and
WHEREAS, the recommended terms and conditions of the exchange are
based on a parcel for parcel transfer; and
WHEREAS, the Kodiak Island Borough will be responsible for
administrative costs and costs associated with surveying, platting and
recording; and
WHEREAS, alternatives considered in reviewing school expansion sites
were limited due to topography and associated costs.
NOW, THEREFORE, BE IT RESOLVED, that the Kodiak Island Borough
Planning and Zoning Commission recommends approval of an exchange of Borough
owned land for the acquisition of land for school expansion in Larsen Bay.

COMMISSIONER KNUDSEN MOVED TO ADOPT THE FOLLOWING FINDINGS OF FACT:
1. That the use as proposed in the application, or under appropriate
conditions or restrictions, will not (A) endanger the public's
health, safety or general welfare, (B) be inconsistent with the
general purposes and intent of this title and (C) adversely
impact other properties or uses in the neighborhood.
A. It appears that the proposed use will endanger the public's
health, safety or general welfare because commercial land
uses (e.g., outdoor storage) have the potential to detract
from the use of the land and adjoining properties for
residential purposes. This is evidenced by the complaints
already received regarding outdoor storage on this property
and public testimony against the storage.
B. The proposed use will be inconsistent with the general
purposes and intent of Title 17 and with the specific
description and intent of Chapter 17.19, the R2--Two-Family
Residential Zoning District. Section 17.03.080 specifies
that uses not listed as a permitted uses are prohibited.
Outdoor storage is not listed as a permitted use in the R2
Zoning District. Moreover, the description and intent of
the R2 Zoning District (Section 17.19.010) specifies that
the intentions of this district are to encourage the
construction of single and two-family dwellings, to prohibit
commercial and industrial land uses which wodld interfere
with the development or continuation of single and
two-family dwellings in the district, and to encourage the
discontinuance of existing uses that are not permitted under
the provision of this chapter. The applicant's exception
request is not consistent with this description and intent
of the R2 Zoning District. The use is commercial and one
appropriate option is an investigation into a rezone of the
site to a classification that permits the land uses desired
by the applicant.
C. The proposed use could potentially have adverse impacts on
other properties in the area. In addition to the potential
land use conflicts between commercial and residential uses
(e.g., noise, traffic, hours of operation, etc.) granting
this exception will set a precedent for changing the
expected use and lifestyle (i e , medium density, one.and
two family residential) of the R2 Zoning District. This is
especially true given the existence of the topsoil screening
operation. This exception, if approved, will be the second
commercial use of this land. This can give the impression
that the intended future use of this tract is commercial
rather than residential. If this is the case, the rezoning
of this property should beinvestigated at some point.
D. The applicant has failed to prove that this residential lot
warrants an exception to the Borough Code.
The motion was seconded and CARRIED by unanimous roll call vote.

recreation and open space. The 1984 Larsen Bay Comprehensive Plan
depicts this area for public land uses.

1984 Larsen Bay Comprehensive Development Plan identifies the area as
conservation.
12. Applicable Regulations: The following sections of Title 18 (Borough
Real Property) of the Borough Code are
applicable to this request:
Section 18.80.020 states:
Real property considered for exchange shall be reviewed by the
planning and zoning commission. The planning and zoning commission
shall recommend to the assembly, by resolution, their recommendations
regarding the exchange.
COMMENTS:
Borough property to be exchanged:
That Portion of Block 12 that is to be disposed to the City of Larsen Bay
is restricted by deed for school purposes only. The deed goes on to state
that should the Borough relinquish the property, ownership would transfer
to the City of Larsen Bay.
An old school building exists on this parcel. It too would be traded.
This building would normally be demolished when the new Larsen Bay school
expansion is completed, but the value of the structure is desirable as a
community building and interest in it has been expressed by the City of
Larsen Bay.

City of Larsen Bay property to be exchanged:
Though smaller in size than the Borough's parcel, the value of this lot is
in providing ample building setbacks from the property lines required under
the Uniform Building Code as well as the Kodiak Island Borough Zoning
Ordinance. This parcel is more suited for the school addition than land
owned by the Kodiak Island Borough.
Property Values:
The proposed value of the properties is provided on an attached memo by the
Borough Appraiser. The Borough's land is valued at $1,180.00 and the City
of Larsen Bay's land is valued at $680.00. The values are somewhat close
but the value of the trade lies in the fact that the City owned parcel
provides a buildable site opposed to Borough land that is limited by slope.
RECOMMENDATION:
Staff concludes that such an exchange of property is in the best interest
of the Borough as the most suitable site for the Larsen Bay school
expansion.
APPROPRIATE MOTION:
Should the Commission agree with the staff recommendation, the appropriate
motion is:
Move to adopt Resolution 86-07-R recommending the Kodiak Island
Borough Assembly exchange Borough -owned land (Portion of Block 11,
Tract A, Larsen Bay Townsite) for land owned by the City of Larsen Bay
(Portion of Lot 5, Block 12, Tract A, Larsen Bay Townsite) in order to
construct the Larsen Bay School Addition.

After a physical inspection and evaluation of the lot portions being
considered for a trade between the City'of Larsen Bay and the Kodiak
Island Borough, I offer the following renditions of value:
* Parcel #1: The northwest corner of. Block 11, Larsen Bay
Townsite, measuring 130' by 140' and containing approximately
18,200 square feet. Estimated Value - $1180, one thousand one
hundred eighty dollars.
* Parcel #2: The easterly one half of Lot 5 Block 12, Larsen
Bay Townsite, measuring 50' by 210' ,and containing approximately
10,500 square'feet. Estimated Value - $680, six hundred eighty
dollars.
Parcel # 3: The existing school building located on parcel #1.
Estimated Value - $12,000, twelve thousand dollars.
The building value is based on replacement cost less accrued
depreciation and an estimated cost of $15-20,000 for the removal of
asbestos bearing material within the structure.(This estimate was supplied
by the Facilities Department as a.rough estimate only.)
* These appraised values reflect the sale of properties with similar
restrictions as the subject properties.. They do not necessarily
correspond to fee simple market value of unrestricted properties in
Larsen Bay.

A RESOLUTION OF THE KODIAK ISLAND BOROUGH PLANNING AND ZONIN
COMMISSION RECOMMENDING THE EXCHANGE OF BOROUGH PROPERTY TO ACQUIRE • FOR
THE LARSEN BAY SCHOOL ADDITION.
WHEREAS, the Borough has entered into negotiations to acquir- lands
adjacent to the Larsen Bay School for construction of a proposed class oom
expansion, and
WHEREAS, the Borough is offering publically own land in

in exchange for said parcel; and

WHEREAS,.Ithe exchange of real property is in the public's be -t
interest as the land to be. acquired is critical for public facility ex•ansion;
and
WHEREAS,la method for determining values of the properties t. be
exchanged has beeniprovideb by the Borough Assessor; and
WHEREAS, evidence of marketable titles of the parcels ex
property records

WHEREAS, I, the recommended terms and conditions of the exchan

administrative costs and costs associated with surveying, platting and

were limited due to' topography and associated costs.
NOW, THEREFORE, BE IT RESOLVED, that the Kodiak Island Bozo
Planning and Zoning Commission recommends approval of an exchange of
owned land for the acquisition of land for school expansion in. Larsen
