Request fora variance from Section 17.18.050B (Side Yards) of the Borough Code to permit an existing community building to be restructured as a zero lot line development in an R-1--Single-Family Residential Zoning District. Lot 4, Block 12, Tract A, U.S. Survey 4872, Larsen Bay Townsite. (City o1 Larsen Bay) TO WHOM IT MAY CONCERN: The Kodiak Island Borough Planning and Zoning Commission at their meeting on April 19, 1989, granted the request for the variance cited above. THIS APPROVAL DOES NOT ALLOW ANY CONSTRUCTION TO BEGIN. Zoning compliance and/or a building permit must first be obtained. Please contact this office for further details. An appeal of this decision may be initiated by any person or party aggrieved by filing a written notice of appeal with the Larsen Bay City Clerk within ten days of the date of the Commission's decision. The notice of appeal must state the specific grounds for the appeal. Therefore, the Commission's decision will not be final and effective until ten days following the decision. Failure to utilize this variance within twelve (12) months after its effective date shall cause its cancellation. Please bring this letter when you come to our office to obtain zoning compliance for any construction on the lot. The Commission also adopted the following findings of fact in support of their decision: 1. Exceptional physical circumstances or conditions applicable to the property or intended use of development, which generally do not apply to other properties in the same land use district. The exceptional physical circumstance which applies to the intended use of the property is the fact that the existing structure supports multiple public and community functions. It is common in rural villages for a single structure to have many related uses. Public facilities are not usually located in the R1--Single-Family Residential Zoning District which places numerous restrictions on development and, in this case, property subdivision. Kodiak Island Borough City of Larsen Bay April 20, 1989 Page Two 2. Strict application of the zoning ordinances would result in practical difficulties or unnecessary hardships. Strict application of the Zoning Ordinance would not permit the subdivision of Lot 4, Block 12, Tract A, U.S. Survey 4872, Larsen Bay Townsite, to allow for separate ownership of portions of the existing community building located on it. This is an unnecessary hardship because the use of public and community facilities are often similar to those uses permitted in the B --Business Zoning District, such as offices, shops, services, etc., and the B --Business Zoning District permits zero lot line development. The granting of the variance will not result in material damages or prejudice to other properties in the vicinity nor be detrimental to the public's health, safety and welfare. Granting of the variance will not result in material damage or prejudice to other properties In the area and will not be detrimental to the public's health, safety, and welfare. The will be no change in the nonconforming status of the existing structure as a result 01 this variance. Allowing the subdivision of Lot 4 will permit the Tribal Council to acquire a portion of the existing building. This will actually enhance the community as the Tnbal Council provides services and activities for the residents of Larsen Bay. 4. The granting of the variance will not be contrary to the objectives of the Comprehensive Plan. Granting of the variance will not be contrary to the objectives of the comprehensive plan because the plan calls for use of the property for public purposes. Ownership and use of a portion of the building by the Larsen Bay Tribal Council will be consistent with those objectives. COMMENTS: The purpose of this request is to allow a zero lot line redevelopment to occur on Lot 4, Block 12, Tract A, U.S. Survey 4872, Larsen Bay Townsite. The City of Larsen Bay would like to transfer half of the existing municipal building to the Larsen Bay Tribal Council. In order for this to take place however, the Tribal Council must acquire the underlying property along with the building. The applicant wishes to subdivide the property to facilitate the transfer, however a variance must first be obtained to allow for the resulting zero lot line development. In order for the Commission to grant a variance, all of the following conditions must be satisfied: FINDINGS OF FACT 1.
