At Assemblyman Merriman's request, Mayor Selby explained this ordinance was introduced as a result of a problem with a contrac- tor who removed considerable amounts of debris from the Coast Guard Base and transported it to Bells Flats to be burnt. He said this ordinance would prevent the transportation of debris from one lot to a different lot (except for the landfill) for disposal. Linda Freed explained how this change would effect the filing of a subdivision preliminary plat. Imanual Bercee, local surveyor, stated that the surveyors in Kodiak have several things which they would like to see addressed and possibly changed in Ordinance 89-18-0. The surveyors have not had time to write these proposals, he said, but they would have these recommendations prepared for the next meeting. He said he felt strongly about the initial concept and felt this is what the assembly wanted, but he hoped before the second reading that the assembly could get into a good hard discussion about the consolidation of departments and make any necessary changes to assure the concept works. Wetlands Filling and drainage of water bodies, floodways, backshores or natural wetlands shall be consistent with ACMP Standards 6 AAC 80.070 (Energy Facilities) and 6 AAC 80.130 (Habitats). Consistent: Not applicable. This action does not involve any filling or drainage of water bodies. COMMENTS: The purpose of this request Is investigate the rezoning of Lots 11 and 13, Block 2; Lot 2, Block 9; Lots 1 and 2, Block 11; Lots 2, 3, 4, and 6, Block 12; Lot 4, Block 14; and Lot 1, Block 15, Tract A, U.S. Survey 4872, Larsen Bay Townsite. The scope of this investigation was expanded by the Planning and Zoning Commission at their regular meeting of April 19, 1989. The scope of the original request addressed Lots 4 and 6, Block 12, Tract A, U.S. Survey 4872, Larsen Bay Townsite. The reason for expanding the scope 01 this request was to include as many city -owned properties in the rezone as possible, while identifying those lands which were identified in the Larsen Bay Comprehensive Plan for public use. These lots are currently zoned R1—Single-Family Residential. Lots which are being used for public purposes and contain public facilities are, by and large, nonconforming under the R1 -Single -Family Residential Zoning District. This land use district places a number of constraints upon the further development of these lands for public purposes. Case 89-019 Page 7 of 11 P&Z: May 17, 1989 ITEM VI -A CONFORMANCE WITH THE COMPREHENSIVE PLAN As noted previously, the comprehensive plan indicates that the eleven (11) lots identified in the staff report should be used for public uses. The current zoning classification of R1--Single-Family Residential is not consistent with most public uses of land. Development of land zoned PL--PublIc Use Lands requires the submission of a detailed site plan to the Planning and Zoning Commission for review and approval prior to development. This will help to assure that future development is consistent with the comprehensive plan and responsive to public needs. ZONING/USE Staff has researched the history of the zoning in Larsen Bay. Like the other villages in the Kodiak Island Borough, all lands within the townsite boundary were rezoned from C --Conservation to R1--Single-Family Residential by Ordinance 77-19-0. Although this zoning classification did not relate to specific existing or anticipated land uses in each village, it did conform to the predominant land use in the villages, which is single-family residential. Of the eleven (11) lots addressed in the staff report, two (2) lots are not owned by the City of Larsen Bay. A church is located on Lot 2, Block 9, and the land is owned by Far North Missionary Fellowship. Staff recommends that this lot be eliminated from further consideration for rezoning 10 the PL—Public Use Lands Zoning District. It would be more appropriate to leave this lot in the R1--Single-Family Residential Zoning District. Lot 13, Block 2, is owned by the Russian Orthodox Church. This lot is used for a church and as a community cemetery. A cemetery is a permitted use in the PL --Public Use Lands Zoning District, even though the land is not government owned. Unfortunately, churches are not a permitted use in the PL -- Public Use Lands Zoning District, as noted earlier. Therefore, staff recommends that this lot not be included in the rezone. The cemetery will remain a nonconforming use, while the church will continue to be a conforming use in the R-1--Single-Family Residential Zoning District. It would be appropriated to rezone the following lots to the PL—Public Use Lands Zoning District: Lots 2 and 3, Block 12, are indicated in the Borough records as being vacant and developed with a single-family residence, respectively. Discussions with Larsen Bay's Mayor, Charles Christensen, indicate that Lot 2 is the location of the City's fire -apparatus storage. In addition, the structure on Lot 3 is also used for municipal purposes. Lot 4, Block 14, is listed in Borough records as being developed for institutional use. Local sources of information indicate that the property is vacant and presently undevelopable due to the presence of surface water on the site. Lot 2, Block 11 and Lot 6, Block 12, are used for school facilities. Lot 4, Block 12, is the location of both municipal and tribal facilities. All of the remaining lots (Lot 11, Block 2; Lot 1, Block 11; and Lot 1, Block 15) are vacant. Lot 11, Block 2, is currently used as a community garden. Case 89-019 Page 8 of 11 P&Z: May 17, 1989 ITEM VI -A LAND SUITABILITY The Tots identified in this staff report are generally level enough that development for public purposes should not be inhibited. Level topography is a desirable characteristic for most land uses. Lot 4, Block 14, and Lot 1, Block 15, are marked by apparent wetlands covering about half of the area of each lot. The remaining lots do not appear to be adversely affected by the existence of wetlands. Even so, the PL—Public Use Lands Zoning District is an appropriate zone for the development of parks and the maintenance of open space as noted in Section 17.33.020K (Permitted Uses) of the Borough Code. Individual lot sizes range from 10,776 square feet to 110,080 square feet. Lot widths range from approximately eighty (80) to two hundred forty (240) feet. These lot sizes are adequate for the development of institutional and public structures and for the provision of off-street parking. All lots exceed the minimum lot size, of 7,200 square feet required by the PL --Public Use Lands Zoning District. (However, the location of the existing structures on most, if not all, of the developed lots will not meet the setbacks of the PL -Public Use Lands Zoning District.) RECENT DEVELOPMENT TRENDS IN THE AREA The development trend in Larsen Bay, as in other villages within the Kodiak Island Borough, is one of mixed use development. This allows for maximum flexibility in the siting of new development and also provides a measure of consistency with development which occurred prior to the application of land use regulations. Departmental files indicate that Lot 1, Block 14 was rezoned from R1--Single-Family Residential to B -- Business by Ordinance 88-19-0 on August 4, 1988 (Case 88-035). TRAFFIC IMPACTS Traffic, access, and parking are some of the most significant issues to be evaluated in consideration of a rezone. On some of the lots identified in this case however, the use of the land for public purposes precedes the rezoning to a consistent land use classification. Aerial photographs indicate that a number of the existing facilities do not have adequately developed parking facilities. Because these are, for the most part, nonconforming structures, the provision of additional parking should not be required until the property owner proposes to redevelop these lots in such a way that the nonconformities are either increased or enlarged. Access to the lots identified in this staff report appears to be good. Currently all lots are accessed by graded city roads and/or established trails over public lands. A number of the lots have better than average access because they are corner lots. Traffic volume should not be affected by this. rezone. The existing structures have a history of public use, and the traffic in Larsen Bay will only increase as a function of community growth or economic development not because of a rezone such as this. SUMMARY As noted in the staff report, Lots 11 and 13, Block 2; Lots 1 and 2, Block 11; Lot 2, Block 9; Lots 2, 3, 4, and 6, Block 12; Lot 4, Block 14; and Lot 1, Block 15, Tract A, U.S. Survey 4872, Larsen Bay Townsite are designated as public development in the 1984 Larsen Bay Comprehensive Plan. The existing use of Case 89-019 Page 9 of 11 PBZ: May 17, 1989 ITEM VI -A all lots evaluated in this staff report, with the exception of Lot 2, Block 9 and Lot 13, Block 2, are consistent with the proposed PL --Public Use Lands Zoning District. Land uses on Lot 2, Block 11; Lots 2, 3, 4, and 6, Block 12; are Inconsistent with the existing R1 -Single - Family Residential Zoning District. The church on Lot 2, Block 9 and the church on Lot 13, Block 2 are consistent with the R-1--Single-Family Residential Zoning District and, therefore, should not be rezoned. The developed lots in this study are for the most part characterized by nonconforming structures due to location of structures on the lots and inadequate parking facilities. A variance would be required if the property owner(s) wish to enlarge or alter the nonconforming structures regardless of whether they are located in the R1--Single-Family Residential or PL --Public Use Lands Zoning District. By recommending the rezone of Lot 11, Block 2; Lots 1 and 2, Block 11; Lots 2, 3, 4, and 6, Block 12; Lot 4, Block 14; and Lot 1, Block 15, Tract A, U.S. Survey 4872, Larsen Bay Townsite, from R1--Single- Family Residential to PL -Public Use Lands, the Planning and Zoning Commission intends to: (1) encourage the Increased use of the land for public purposes; (2) eliminate nonconforming land uses caused by inappropriate zoning; and (3) increase conformance with the comprehensive plan. Section 17.72.020 states that the Commission shall incorporate the following criteria into their report to the Assembly: FINDINGS OF FACT 1. Findings as the Need and Justification for a Change or Amendment. The rezone of Lot 11, Block 2; Lots 1 and 2, Block 11; Lots 2, 3, 4, and 6, Block 12; Lot 4, Block 14; and Lot 1, Block 15, Tract A, U.S. Survey 4872, Larsen Bay Townsite from R1--Single-Family Residential to PL --Public Use Land is necessary and Justified because the PL --Public Use Land Zoning District permits development that: A. is consistent with the comprehensive plan; B. is suitable for the existing lots, given the prevailing lot sizes, lot widths, and location of existing structures; and C. will not create nonconforming land uses on the nine (9) lots recommended for rezoning. Findings as to the Effect a Change or Amendment would have on the Objectives of the Comprehensive Plan. The 1984 Larsen Bay Comprehensive Pian shows this area to be Public Use Lands. The zoning of these nine (9) lots as R1--Single-Family Residential is inconsistent with the intent of the comprehensive plan. It is the Commission's intent that this rezone will: (1) encourage the Increased use of the land for public purposes; (2) reduce nonconforming land uses caused by Inappropriate zoning; and (3) increase conformance with the comprehensive plan. This rezone will not bring these Tots into complete compliance with the zoning code. Enlargement or alteration of nonconforming structures will only be permitted through Commission approval of a variance. Through the variance process, all development proposals will be evaluated against the standards of the PL --Public Use Lands Zoning District. Case 89-019 Page 10 of 11 P&Z: May 17, 1989 ITEM VI -A RECOMMENDATION: Staff finds that this rezone request meets all the required findings and, therefore, recommends the Commission forward the rezoning of Lot 11, Block 2; Lots 1 and 2, Block 11; Lots 2, 3, 4, and 6, Block 12; Lot 4, Block 14; and Lot 1, Block 15, Tract A, U.S. Survey 4872, Larsen Bay Townsite, to the Borough Assembly recommending approval. Dredge and Excavation Material Dredging and filling shall be consistent with ACMP Standards 6 MC 80.040 (Coastal Development) and 6 AAC 80.110 (Mineral and Mining Processing). Consistent: Not applicable. This activity does not involve accessory development. 7. Wetlands Filling and drainage of water bodies, fioodways, backshores or natural wetlands shall be consistent with ACMP Standards 6 MC 80.070 (Energy Facilities) and 6 AAC 80,130 (Habitats). Consistent: Not applicable, This action does not involve any filling or drainage of water bodies. COMMENTS: The purpose of this request is investigate the rezoning of Lots 4 and 6, Block 12, Tract A, U.S. Survey 4872, Larsen Bay Townsite. The City of Larsen Bay has been using these properties for public purposes for many years. The existing zoning is R1--Single-Family Residential. This results in nonconforming uses of land and restricts future development of the facilities. Initially, the community was interested In rezoning Lot 4 to B--Buslness in order to accommodate a planned zero lot line development without having to obtain a variance, The community recognizes, however, that the B --Business Zoning District permits a much wider range of land uses than the community would like to see in this area. A rezone to B—Business is also inconsistent with the 1984 Larsen Bay Comprehensive Pian. CONFORMANCE WITH THE COMPREHENSIVE PLAN As noted previously, the comprehensive plan indicates that the two lots In question should be used for public uses. The current zoning classification of R1—Single-Family Residential is not consistent with the existing use of the property for public purposes. The current classification inhibits further development of the property for public uses without first obtaining approval from the Planning and Zoning Commission. Case 89-019 Page 4 of 7 P&Z: April 19, 1989 ITEM VI -C ZONING/USE Staff has researched the history of the zoning in Larsen Bay. Like other villages within the Kodiak Island Borough, all lands within the townslte boundary were rezoned from C --Conservation to R1--Single-Family Residential by Ordinance No. 77-19-0. Although this zoning classification did not relate to specific or anticipated land uses in each village, it did conform the predominant land use in the villages which is residential. The building on Lot 4, Block 12, Tract A, U.S. Survey 4872, Larsen Bay Townsite is currently used as a community building. This specific use is not compatible with the description and intent of the R1--Single- Family Zoning District. A pre-school facility is located on Lot 6, Block 12, Tract A, U.S. Survey 4872, Larsen Bay Townsite. This use is also incompatible with the description and intent of the R1 zone. LAND SUITABILITY Both lots are level over about eighty (80) percent of their respective areas. The best areas for development are located along the streets' boundary. The fact that each lot has a fairly flat topography Is a desirable characteristic for most land uses. Individual lot sizes are 22,000 square feet for Lot 4, and 20,000 square feet for Lot 5. Each lot has a width of about one hundred (100) feet These lot sizes are adequate for the development of institutional and public structures and for the provision of off-street parking. However, the location of the existing structure on Lot 4, at or near the front line, may not permit access to the rear of the property where off- street parking (if needed) would most likely be developed. RECENT DEVELOPMENT TRENDS IN THE AREA The development trend in Larsen Bay, as in other villages within the Kodiak Island Borough, is one of mixed use development occurring within the townsite boundaries. This allows for maximum flexibility in the siting of new development and also provides a measure of consistency with the development that has already occurred prior to the application of land use regulations. Departmental files indicate that Lot 1, Block 14 was rezoned from R1--Single-Family Residential to B -- Business by Ordinance 88-19-0 on August 4, 1988, as a result of Rezone Case 88-035. TRAFFIC IMPACTS Traffic, access and parking are some of the most significant issues to be evaluated in consideration of a rezone. In this case, however, the use of the land for public purposes precedes the rezoning to a consistent land use classification. Aerial photographs do not indicate any developed parking facilities on Lot 4. Because this is an existing nonconforming use and structure, the provision of parking should not be required unless the property owner proposes to redevelop the property in such a way that structural nonconformities are either increased or enlarged. Access to the rear o1 Lot 4 is not very good. Access to Lot 6 is good from either the front or side, due to the fact that this is a corner lot and the existing structure is located more favorably. Traffic volume should not be affected by this rezone. The existing structures have a history of public use and the traffic in Larsen Bay will only increase as a function of community growth or economic development, not because of a rezone such as this. Case 89-019 Page 5 of 7 PBZ: April 19, 1989 ITEM VI -C SUMMARY As noted in the staff report this area is designated for public use development in the 1984 Larsen Bay Comprehensive Plan. The existing use of Lots 4 and 6 for a community building and pre-school respectively are consistent with the proposed Public Use Zoning District. The existing structure on Lot 4 is nonconforming due to its location near the front lot line and the lack of adequate parking facilities. A variance would only be required if the property owner(s) wish 10 enlarge or Increase the nonconformilles. The rezone of Lots 4 and 6, Block 12, Tract A, U.S. Survey 4872, Larsen Bay Townsite from R1--Single- Family Residential to PL --Public Use Lands will: 1) encourage the increased use of the land for public purposes; 2) eliminate nonconforming land uses caused by Inappropriate zoning; and, 3) increase conformance with the comprehensive plan in the area. Section 17.72.020 states that the Commission shall incorporate the following criteria into their report to the Assembly: FINDINGS OF FACT 1, Findings as the Need and Justification for a Change or Amendment. The rezone of Lots 4 and 6, Block 12, Tract A, U.S. Survey 4872, Larsen Bay Townsite from R1— Single-Family Residential to PL --Public Use Land is necessary and justified because the PL -- Public Use Land Zoning District permits development that: A. is consistent with the comprehensive plan; B. is suitable for the existing lots, given the prevailing lot sizes, widths and placement of existing structures; and C. will not create any nonconforming land uses on the two (2) lots identified for rezoning. 2. Findings as to the Effect a Change or Amendment would have on the Objectives of the Comprehensive Plan. The 1984 Larsen Bay Comprehensive Plan shows this area to be Public Use Lands. The zoning of these two (2) lots as R1--Single-Family Residential is inconsistent with the intent of the comprehensive plan as 11 applies to this area. This rezone will:: 1) encourage the increased use of the land for public purposes; 2) eliminate nonconforming land uses caused by inappropriate zoning; and, 3) increase conformance with the comprehensive plan in the area. RECOMMENDATION: Staff finds that this rezone request meets all the required findings and therefore recommends the Commission forward this rezone proposal to the Borough Assembly recommending approval. Our conversation concerned a request to rezone certain parcels of City property to a commercial land use classification. I have reviewed the Larsen Bay Comprehensive Plan and Included a copy of the land use plan map for your review. The plan Is the basis on which all zoning actions are considered. It is a statement of goals and objectives reflecting the direction the community would like to go when future development is concerned. The map is a summary of the actual plan itself. As you can see on the enclosed map, City property being used for public purposes (or Intended for public use) Is so indicated. The Interpretation of this would be to eventually rezone these properties to the PL -- Public Use Lands Zoning District, it this has not already been done, in order to ensure that the development of this property is In accordance with the adopted plan. Your request to use some of the property In a commercial way is not covered by the PL --Public Use Lands Zoning District. Your community, therefore, through the adoption of a resolution by the City Council at a regular or special meeting, must request an amendment to the Larsen Bay Comprehensive Plan before a rezone to a commercial zoning classification can be properly considered by the Planning and Zoning Commission. Thls resolution should specify whether some or all of the areas now designated for public use are to be Included In the scope of this request. Also, the request should indicate what the desired change should be, such as a change from public use to commercial, watertront and residential development classification (mixed use). As you may notice, some areas have already received this designation In the land use plan. We will try to get this Item on the agenda for the Aprtl 19th meeting of the Planning and Zoning Commission. I will check to see If we can run a rezone request concurrently with the comprehensive plan amendment and get back to you.
