KODIAK ISLAND BOROUGH RESOLUTION NO. 85-75-R A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY RECOMMENDING THE DISPOSAL OF CERTAIN BOROUGH PROPERTIES. WHEREAS, Title 18 of the Borough code requires that the disposal of Borough land be reviewed by the Planning and Zoning Commission, and WHEREAS, Title 18 of the Borough code requires that the Commission, by resolution, shall make a recommendation to the Assembly regarding this proposed land disposal, and WHEREAS, the Kodiak Island Borough is obligated to place surplus, publicly -owned lands into the private sector, and WHEREAS, the Borough owns land suitable for disposal to the public. NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island Borough Assembly declares the following parcels excess to the Borough's needs and therefore available for disposal: 1. WHEREAS, the Kodiak Island Borough owns Block 3 of the Lakeside Subdivision, First Addition, and intends to dispose of these lands, and WHEREAS, the Kodiak Island Housing Authority, a public corporation which is an instrument of the State government, has offered a development contribution of $598,200 in exchange for this parcel, and WHEREAS, the Kodiak Island Borough Planning and zoning Commission was requested to review the disposal of this land at their August 2I, 1985 meeting and found no reason to prevent declaring this parcel surplus to Borough needs, and WHEREAS, Kodiak Island Borough Code Section 18.20.100 makes provi- sions for disposal to political subdivisions of the State of Alaska or non- profit cozpozatnons for less than fair market value, and WHEREAS, the Kodiak Island Horough Code Section 18.20.110 makes I provision to dispose of land by direct negotiation with such organization, and WHEREAS, the Kodiak Island Borough assessor appraised the land on July 25, 1985 at a value of $508,750 as required by Kodiak Island Borough Code Section 18.20.130, and WHEREAS, the development contribution exceeds the £air market value by an amount that more than offsets the potential tax revenue loss due to the payment in lieu of taxes agreement, and WHEREAS, the public interest is well served by the disposal of this parcel in this manner. NOW, THEREFORE, BE ST RESOLVED that the Kodiak Island Borough 1 Assembly agrees to exchange Block 3, Lakeside Subdivision, First Addition,, for a $598,200 development contribution from the Kodiak Island Housing Authority. The proposed use will endanger the public's health, safety or general welfare, as the duplex will increase the permitted ::density of the lot by a factor of two. Additionally, no permits , have been issued or inspections performed for the conversion to a duplex to ensure compliance with building and fire codes. 2) The proposed use will be inconsistent with the general purposes and intent of Title 17 and with the specific description and intent of Chapter 17.17, the RR1, Rural Residential District. _ 3) The proposed use could potentially adversely impact other properties in the area. Granting this exception will set a precedent for changing the use, density, and expected life- style (i.e., large lot, low-density, single-family residential) of the subdivision and the RR1 zoning district. I am here to speak in favor of the land disposal (Block 3 Lakeside Subd., 1st Addition) to Kodiak ,Island Housing Authority for residential development. K.I.H.A. proposes to transfer 5598,200 in funding to Kodiak Island Borough to offset the water, _..sewer and road costs in return for the site being requested. I believe this is a fair arrangement for both. Our analysis of all the sites that .r responded to our advertisements indicated that the project .rsuld not be financially feasible due to the severe restrictions we are round on the • • purchase of property. The project proposed is a mutual help home ownership opportunity program. We believe this project is worthy of your favorable consideration and we hope you agree with us. I wish to go on record as endorsing the efforts of the Kodiak Island Housing Authority in trying to find a way for people to become homeowners who wouldn't ordinarily have ..,,the opportunity to be homeowners. 1 urge your favorable consideration to their request. • Clarence Selig: I would like to state that the plan presented to the Borough Assembly regarding certaih lands sought by the Kodiak Island Housing Authority in my estimate is quite an equitable deal. Rather than ,industrial, I would like to see it as an extension of the inner Relief ,.extended outward as residential and public lands. I again would like the Assembly to look'at that residential -industrial complex back there with small buffer zones. John Parker: I would like to speak against the ordinance and see the Borough table it because I believe there is already enough data and adequate staff to,really determine some of the financial impact that this is going to have on Kodiak as well as on the Borough tax rolls. Until this evening, I was under the impression that there was probably some additional properties that the housing authority would be developing in some of the outlying rural areas and I believe they have done some excellent things in those areas out there. I believe they have done that with a lot of forethought and a lot of study. I believe that we are not seeing the same amount of forethought and study being done here so that information could be presented so that all of us could look at it as a term of equity and reasonable business practices rather than an emotional issue of who is.and,who is not going to benefit by it. Carol Hartman: As a hopeful participant, 1 hope that you will adopt this resolution to make these Borough lands available to Kodiak Island Housing Authority. There are always people out there that want freebies and I know that these programs have to try to weed people out as best they can. I think that most of the people that are in this program, that 1 have met and been with, feel the same way. I don't think they want to be parasites on • this program. 1, think they want to have their own home. Dan Maciak: I do have my own house. I am for this program. I believe there is a need for this particular program. The people who would be eligible for this need would not be people who would be eligible for the traditional type of loans and mortgage payments. I support them and encourage you to pass this resolution. Alan Austerman: I think that if a little more forethought had been given to this public hearing tonight you wouldn't have quite the long public hearing you are having tonight. As far as the concept of the housing authority, I agree with it. Kodiak has an inherent problem, with its fishing industry and its economic base of needing this type of housing. You didn't give it adequate thought before you put it up for public hearing. I am not against the Kodiak Island Housing Authority. I am against the fact that this is being presented at this point in time in that area. Dennis Murray: I think without the industrial property, we really evade the question when we continue to add more property to the tax exempt status roles with the hope that we will be providing shelter to people that can't otherwise afford housing. There won't be a necessity for that if we don't have some economics. I think there are a lot of problems with this. I am not opposed to the concept. I think if you could go out and buy a 5100,000 house, one in this subdivision and that one, you would encourage these people because they would be part of the general community and not isolated and segregated in one area, low cost housing. Pat Briggs: 1 don't quite understand when Mr, Knight says, no he can't make his program meet an $86,000 duplex or zero lot line where ever they are building. Dennis Murray: I would just like to give you one final thought, and that is ' what will you do about fire protection in this area. I think that is another issue. WHEREAS, the Kodiak Island Borough owns Block 3 of the Lakeside Subdivision, First Addition, and intends to dispose of these lands, and WHEREAS, the Kodiak Island Housing Authority, a public corporation 'which is an instrument of the State government, has offered a development ,contribution of $598,200 in exchange for this parcel, and WHEREAS, the Kodiak Island Borough Planning and Zoning Commission was requested to review the disposal of this land at their August 21, 1985 meeting and found no reason to prevent declaring this parcel surplus to Borough needs, and WHEREAS, Kodiak Island Borough Code Section 18.20.100 makes provi- sions for disposal to political subdivisions of the State of Alaska or non- profit corporations for less than fair market value, and WHEREAS, the Kodiak Island Borough Code Section 18.20.110 makes provision to dispose of land by direct negotiation with such organization, and WHEREAS, the Kodiak Island Borough assessor appraised the land on July 25, 1985 at a value of $508,750 as required by Kodiak Island Borough Code Section 18.20.130, and WHEREAS, the development contribution exceeds the fair market value by an amount that more than offsets the potential tax revenue loss due to the payment in lieu of taxes agreement, and WHEREAS, the public interest is well served by the disposal of this parcel in this manner. Subsequently, KIRA received a funding reservation for thirty dwel- ling units for a Mutual -Help Homeownership Opportunity Program from the U.S. Department of Housing and Urban Development. This unique program provides homeownership opportunity through favorable finan- cing to qualified families that would otherwise not be available. This is not a "low-cost" or "rental housing" project. When we originally approached the Borough Assembly for support, last July, we had not designated the site. However, we hoped to develop a "scattered site" project, whereas the housing would be throughout the community. Other discussion included potential locations in Chiniak, Boy Scout Lake, and Salonie Creek areas. Over the past nine months we have earnestly attempted to identify favor- able sites for the housing and have advertised for available land to pur- chase from private owners. Unfortunately, each response received would result in a project financially unfeasible because of the extremely high land costs. After careful forethought of the alternatives, we submit for the Assem- bly's consideration a proposal for disposal of land pursuant to Title 18, Subsection 18.20.100(B) of the Borough Code. The area considered in- cludes Block 3, Lakeside Subdivision, First Addition. We delayed dis- cussing the proposal pending the Assembly's decision on this appeal. Unfortunately, our position was misrepresented during the hearings by an individual whose property we earlier rejected as too costly. In return, KIHA would make a contribution to KIB for the construction of roads, water and sewer for the Beaver Lake Loop and Beaver Lake Drive from the intersection of Beaver Lake Loop to Von Scheele Way. We roughly estimate this to be approximately $600,000. Disposal of Borough land in Lakeside Subdivision First Addition Background This discussion concentrates on why Block 3 Lakeside Subdivision First Addition and a portion of revised preliminary plat of Lakeside Subdivision (see map) is surplus to Borough needs and should be recommended for disposal, not how it should be disposed. There are other mechanisms such as subdivision and zoning regulations that address matters of density or development patterns. With the lack of any specific direction in Title 18 of Borough Code as to the goals and objectives of a Borough land disposal program, a brief land history of this parcel may give some suggestions in determining why this specific tract is surplus to Borough needs. The land in this area was patented to the Borough from the State in 1967. By that time the area was already identified for future development and was zoned for residential purposes. Future action also suggests that the area be transferred from public to private hands when a portion of the residential land was set aside for industrial purposes. Roads have been approved, and some are now constructed. There is also other development occurring in adjacent areas. "Smokey's" dump lease is up in 1986 and is scheduled to be moved from its present site. Disposing of land in this portion of Lakeside Subdivision makes good land management sense. It is the next logical area of expansion of residential and industrial development, as it is in close proximity and will incorporate into the existing road and utility systems. It is close to business and recreational parks. Disposal of Borough land in Lakeside Subdivision First Addition Background This discussion concentrates on why Block 3 Lakeside Subdivision First Addition and a portion of revised preliminary plat of Lakeside Subdivision (see map) is surplus to Borough needs and should be recommended for disposal, not how it should be disposed. There are other mechanisms such as subdivision and zoning regulations that address matters of density or development patterns. With the lack of any specific direction in Title 18 of Borough Code as to the goals and objectives of a Borough land disposal program, a brief land history of this parcel may give some suggestions in determining why this specific tract is surplus to Borough needs. The land in this area was patented to the Borough from the State in 1967. By that time the area was already identified for future development and was zoned for residential purposes. Future action also suggests that the area be transferred from public to private hands when a portion of the residential land was set aside for industrial purposes. Roads have been approved, and some are now constructed. There is also other development occurring in adjacent areas. "Smokey's" dump lease is up in 1986 and is scheduled to be moved from its present site. Disposing of land in this portion of Lakeside Subdivision makes good land management sense. It is the next logical area of expansion of residential and industrial development, as it is in close proximity and will incorporate into the existing road and utility systems. It is close to business and recreational parks. Recommendation Because of the above discussion, it appears that disposal in these areas of Lakeside Subdivision is a good use of Borough land and should be recommended to the Assembly for disposal. pb Kodiak Island Borough MEMORANDUM DATE: August 9, 1985 TO: Planning and Zoning Commission [//////�// FROM: Community Development Department/ ITEM VI -E SUBJECT: CASE 85-053. Review by the Planning and Zoning Commission of the disposal of Borough land in accordance with Section 18.20.030A of the Borough Code. Lot 8, Block 1; Lots 1 through 9 and 11 through 19, Block 2; and Lots 4 through 9 and 11, Block 3, Lakeside Subdivi- sion Revised Preliminary Plat (S-84-016 Revised April 22, 1985) and Lots 1 through 17, Block 3, Lakeside Subdivision First Addition (s-85-012). (Kodiak Island Borough) The purpose of this memo is to evaluate the disposal of Borough land from a land use and zoning perspective. Please refer to the Resource Management Officer's discussion of why this land is surplus to the Borough's needs and should be recommended for disposal. It should first be noted that Lakeside Subdivision and Lakeside Subdivision First Addition have received preliminary plat approval. Of the 43 lots proposed for disposal, 36 are designed as residential lots and 7 are designed as industrial lots. The industrial lots are currently zoned I --Industrial. The lots proposed for disposal are part of a larger rezoning request submitted by the property owner (Kodiak Island Borough) and the Planning and Zoning Commission. All of the residentially designed lots proposed for disposal are requested for rezoning to R1 --Single-family Residential or R2 --Two-family Residential zoning. They are currently zoned RR1--Rural Residential One. Because the land proposed for disposal has been designed for residential and industrial lots and because the property owner and Commission have proposed zoning districts that conform with approved subdivisions in the area, it appears clear that these lots are intended for development. City Manager Ceske said the Council was sitting as the Board of Adjustment to hear its appeal of the Planning & Taring Commis- sion's February 20, 1985 decision granting an exception to permit con- struction of a hotel in an industrial area on City Tidelands Tract N-18. The hearing would begin with a presentation by the Crnmmity Development Department Director. Next, the Council would present its argument. Only the information available to the Planning & Zoning Commission at the time of its decision could be considered by the Board of Adjustment. Accord- ing to RCC 17.10.060(c), only one argument could be presented by or on behalf of each party. After hearing both parties, the Board of Adjustment would affirm or reverse the decision of the Planning & Zoning Commission, in whole or in part, and give the reasons for its decision, . The decision being appealed was the approval of an excep- tion by the Kodiak Island Borough Planning and Zoning Commission. The approved exception permitted a hotel on City Tidelands Ttact N-18, which is zoned industrial. The pertinent facts produced at the hearing frau I. which the appeal was taken included: -- - 1. The request was consistent with the Cmprehensive Plan which .• a - designated this area as part of the "central business district"; - 2. Other businesses, notably a restaurant, had operated successfully on the propery for several years without observable conflict with other - - land uses in the area, specifically the adjacent seafood processing plant; 3. There were no direct objections to the request submitted at or prior to the public hearing on the request. - - . . . • The applicable legal principles were taken frac Borough Cade Section 17.65.050 which stated: - "If it is the finding of the commission, after consideration of the investigator's report and receipt of testimony at the public hearing, that the use as proposed in the application, or under the appropriate conditions or restrictions, will not endanger the public's health, safety or general welfare, or be inconsistent with the general purposes and intent of this title, and not adversely impact other properties -or uses in the neighbor- hood, the commission shall•approve the exception, with or without condi- tions." He said the Intel project sight be a cont point with Dischner/Mathisen's dropping the project, bit a lot of nosey had been spent pursuing the concept. The Council responded that a day -time business use (restamrant) vas different from a 24 -lc resi- dential use like a hotel. It was the Coumcit's considered opinion that a residential use was not compatible to industrial uses and did not be- long in an Industrial Zone. Following additional discussion, it. Perrozzi asked what the City's plans mere for the Sc. Paul Harbor spit area. He requested the Council's feedback. Linda Freed said she wanted to clarify the answer to CamcilmeIIber Ramaglia's question on the Planning and Zoning Ccondssion's considera- tion of Case 85-053, land disposal. She said the consideration was on recce:melding disposal of four blocks in the preliminary lakeside Subdivi- sion. None of the blocks bordered Beaver Lake.
