KODIAK TWNST BK 20 LT 1 - Conditional Use Permit (2)Jim Ramaglia, Vice Pre dent Kodiak Oil Sales, Inc. Box 1487 Kodiak, Alaska 99615 Kodiak Island Borough 710 MILL BAY ROAD KODIAK, ALASKA 99615-6340 PHONE (907) 486-5736 March 17, 1988 RE: CASE 88-012. Request for a conditional use permit in accordance with Section 17.24.020(F) (Conditional Uses) of the Borough Code to permit an additional petroleum storage tank with a maximum capacity of 220,000 gallons to locate in an I --Industrial Zoning District on Lot 1, Block 20, Kodiak Townsite; 712 Shelikof Street. (Kodiak Oil Sales, Inc.) Dear Mr. Ramaglia: The Kodiak Island Borough Planning and Zoning Commission at their meeting March 16, 1988, granted the request for the conditional use permit cited above, subject to the following conditions: 1. Size, dimensions, maximum capacity, and location of the tank will be as shown on the attached site plan. 2. Compliance with all provisions of the Uniform Building Code and Uniform Fire Code shall be demonstrated prior to issuance of zoning compliance or a building permit. The Commission also adopted the following findings in support of their decision: 1. That the conditional use will preserve the value, spirit, character and integrity of the surrounding area. It appears that the proposed use will not detract from the value, spirit, character and integrity •of the surrounding area. The surrounding area is devoted to industrial land uses, including a warehouse, a processing plant and dormitory, waterfront area and the fuel dock. A bulk fuel storage facility or "tank farm" is a long established land use at this location and departmental files do not indicate that the facility has been detrimental to the surrounding area. The addition of one tank will not result in a change of land use and is a relatively minor increase in land use intensity. Six storage tanks are currently located on the site. Kodiak Island Borough Jim Ramaglia, Vice President Kodiak Oil Sales, Inc. March 17, 1988 Page Two 2. That the conditional use fulfills all other requirements of this chapter pertaining to the conditional use in question. The proposed use will be required to fulfill all other requirements of the Industrial Zoning District, the Uniform Building Code and the Uniform Fire Code. The proposed location of the tank meets or exceeds all required setbacks and height limits of the I --Industrial Zoning District. It also appears that the proposed use will comply with the applicable performance standards for industrial land uses. Full compliance with the Uniform Building and Fire Code provisions will be assured through the building permit process but should be identified as a condition of approval for the conditional use permit. 3. That granting the conditional use permit will not be harmful to the public health, safety, convenience and comfort. The proposed use should not be harmful to the public's health, safety, convenience or comfort. As previously discussed, the existing facility has not been shown to be detrimental or harmful to public health or safety, the land use will not change, and the addition of one tank when there are six already on the property, does not represent a significant increase ir the intensity of land use or amount of products stored on the property (15%). It could be argued that another tank will increase the potential for harm in the case of a catastrophic event. Staff feels that this is a slim possibility and even then the additional tank would be a small portion of the bigger picture. It should also be noted that the existing tank farm predates the 1964 tsunami. 4. That sufficient setbacks, lot area, buffers or other safeguards are being provided to meet the conditions listed in subsections A through C of this section. There is sufficient lot area for the proposed tank. The proposed location exceeds the setbacks of the I --Industrial Zoning District and adherence to fire code separation requirements will be assured prior to issuance of a building permit. Compliance with these requirements should ensure adequate separation from cther structures in the area. In addition, the property is fenced for security purposes. THIS APPROVAL DOES NOT ALLOW ANY CONSTRUCTION TO BEGIN. Zoning compliance and/or a building permit must first be obtained. Please contact this office for further details. Kodiak Island Borough Jim Ramaglia, Vice President Kodiak Oil Sales, Inc. March 17, 1988 Page Three An appeal of this decision may be initiated by any person or party aggrieved by filing a written notice of appeal with the City Clerk within ten days of the date of the Commission's decision. The notice of appeal must state the specific grounds for the appeal. Therefore, the Commission's decision will not be final and effective until ten days following the decision.. This letter shall constitute the conditional use permit. Please bring it with you when you come to our office to obtain zoning compliance for any construction on the property. If you have any questions about the action of the Commission, please contact me. Sincerely, Robert H. Pederson, AICP, Associate Planner Community Development Department widely held in the community. In addition, the variance will be decided prior to placement of the signs. 6. That the granting of the variance will not permit a prohibited land use in the district involved. Signs are permitted in the B --Business Zoning District. CASE 88-012. In order to satisfy industrial requirements, meet safety standards, protect fish and wildlife resources, and maintain environmental quality, sites for industrial development shall be identified in conjunction with the Kodiak Island Borough. Consistent: Yes. This area is zoned Industrial and identified for industrial land uses in the comprehensive plan. 2. Natural Features. Dredge and fill, excavation, shoreline alteration, and disturbance of anadromous streams, tideflats and wetlands shall be minimized when constructing and operating port, harbor, dock, industrial and energy facilities - if permitted under applicable regulations. Consistent: Not Applicable. This action does not involve alteration of wetlands, tideflats, or anadromous waters. 3. Natural Setting, Views and Access. Development shall be conducted in a manner that mitigates adverse impacts upon the Kodiak Archipelago; developers shall provide opportunities for public access to the shoreline and scenic views, to the extent feasible and prudent. Consistent: Not Applicable. It is not prudent to provide public access through an industrial area. Case 88-012 2 March 16, 1988 P&Z ITEM VI -D 4. Dredge and Excavation Material. Dredging and filling shall be consistent with ACMP Standards 6 AAC 80.040 (Coastal Development) and 6 AAC 80.110 (Mineral and Mining Processing). Dredge spoil may be utilized in shoreside landfills if permitted under applicable regulations for the purpose of creating usable waterfront land. Consistent: Not Applicable. Dredging and filling activities are not a part of this proposal. 5. Facility Design. Developments in or over the water, such as piers, docks, and protective structures shall be located, designed and maintained in a manner that prevents adverse impacts upon water quality, fish, wildlifeand vegetative resources, and minimizes interruption of water circulation patterns, coastal processes and navigation. Buffer zones shall be established to the extent feasible and prudent, between industrial areas and major public transportation routes and between industrial development and adjacent, non -industrial properties in order to minimize conflicts between land uses. Consistent: Yes, to the extent prudent and feasible. The bulk fuel facility is long established at this location without provision of a buffer along Rezanof Drive. It is not prudent to require provision of a buffer zone at this time. 7. Accessory Development. Accessory development that does not require a shoreline location in order to carry out its support functions shall be sited away from the shoreline whenever there is a feasible and prudent inland alternative. This category includes parking, warehousing, open air storage, waste storage, treatment or storm runoff control facilities and utilities. Consistent: Yes. This accessory development is not located along the shoreline. 8. Wetlands. Filling and drainage of water bodies, floodways, backshores or natural wetlands shall be consistent with ACMP Standards 6 AAC 80.070 (Energy Facilities) and 6 AAC 80.130 (Habitats). Consistent: Not Applicable. This project does not include dredging and filling activities. COMMENTS: The purpose of this request is to permit the storage of an additional 220,000 gallons of petroleum or flammable liquids on the site. The products (diesel fuel or gasoline) will be stored in one large or two smaller tanks as shown on the attached site plan. The existing tank farm contains six tanks with a total capacity of 1,468,000 gallons. Case 88-012 3 March 16, 1988 P&Z ITEM VI -D In order to grant a conditional use permit, the Commission must make the following findings: 1. That the conditional use will preserve the value, spirit, character and integrity of the surrounding area. It appears that the proposed use will not detract from the value, .spirit, character and integrity of the surrounding area. The addition of up to two tanks will not result in a change of land use and is a relatively minor increase in land use intensity. Six storage tanks are currently located on the site. 2. That the conditional use fulfills all other requirements of this chapter pertaining to the conditional use in question. The proposed use will be required to fulfill all other requirements of the Industrial Zoning District, the Uniform Building Code and the Uniform Fire Code. The proposed location of the tanks meets or exceeds all required setbacks and height limits of the I --Industrial Zoning District. It also appears that the proposed use will comply with the applicable performance standards for industrial land uses. Full compliance with the Uniform Building and Fire Code provisions will be assured through the building permit process but should be identified as a condition of approval for the conditional use permit. 3. That granting the conditional use permit will not health, safety, convenience and comfort. The proposed use should not be harmful to the convenience or comfort. As previously discussed, be harmful to the public public's health, safety, the existing facility has not been shown to be detrimental or harmful to public health or safety, the land use will not change, and the addition of one or two tanks when there are six already on the property, does not represent a significant increase in the intensity of land use or amount of products stored on the property (15%). It could be argued that two more tanks will increase the potential for harm in the case of a catastrophic event. Staff feels that this is a slim possibility and even then the two additional tanks would be a small portion of the bigger picture. It should also be noted that the existing tank farm predates the 1964 tsunami. 4. That sufficient setbacks, lot area, buffers or other safeguards are being provided to meet the conditions listed in subsections A through C of this section. There is sufficient lot area for the proposed tanks. The proposed location exceeds the setbacks of the I --Industrial Zoning District and adherence to fire code separation requirements will be assured prior to issuance of a building permit. Compliance with these requirements should ensure adequate separation from other structures in the area. In addition, the property is fenced for security purposes. Case 88-012 4 March 16, 1988 P&Z ITEM VI -D RECOMMENDATION: Staff finds that this request does meet all the conditions necessary for a conditional use permit. APPROPRIATE MOTION: Should the Commission agree with the staff recommendation, the appropriate motion is: Move to grant a request for a conditional use permit in accordance with Section 17.24.020 of the Borough Code to permit up to two (2) additional. petroleum or flammable liquid storage tanks with a maximum capacity of 220,000 gallons to locate in the I --Industrial Zoning District on Lot 1, Block 20, Kodiak Townsite, subject to the conditions of approval outlined in the staff report dated February 29, 1988, and to adopt the findings contained in the staff report dated February 29, 1988, as "Findings of Fact" for this case. CONDITIONS OF APPROVAL 1. Size, dimensions, maximum capacity, and location of the tanks will be as shown on the attached site plan. 2.
