The house on Lot 39A, which is one of the oldest in Kodiak, is classified according to Kodiak Island Borough Code Section 17.36.040.A (enclosed) as a nonconforming ("grandfathered") structure by virtue of its encroachment approximately fourteen (14) feet into the twenty-five (25) foot front yard setback required in the R2 zoning district. Code Section 17.36.040.0 allows this structure to be enlarged or expanded so long as other setback requirements (five feet from side lot lines and ten feet from the rear lot line) can be met and so long as the encroachment into the front yard setback does not exceed the original footprint. Further encroachment into a setback would require a variance. Should the house be completely destroyed, it could be reconstructed only in conformity with current code requirements. The current parking requirement for a dwelling is three (3) 9 ft. by 18 ft. parking spaces. Due to topography and the location of the house, it does not appear that all (if any) of this required parking is available on site. For this reason, the use is also nonconforming (KIBC 17.36.050). The structure can be enlarged or expanded as otherwise permitted with no change to this status of parking so long as it remains a single-family dwelling. Since the zoning is R2, the structure might be converted into a duplex, but this can happen only if three (3) additional parking spaces are provided on-site. The variance procedure requires 4-6 weeks lead time to allow for proper public hearing notice and scheduling on the Planning and Zoning Commission agenda. Per our phone conversation yesterday, I am planning to either remodel or rebuild the house on Lot 39A (located at 410 Rezanof Drive West), in approximately three to five years. I've recently hired a local surveyor and engineer to locate the lot lines and provide a drawing with elevations, so that 1 can construct a three-dimensional model and consider plans during the next year. At this point 1 need to know what options are available to me concerning zoning requirements, and I'm specifically interested in off street parking, setback, or other demands which might effect the design. I'd also like to know if this lot has any "grandfather rights", which might allow me to avoid impractical or cost prohibitive requirements, and would appreciate any advice or guidance you can provide concerning these issues, and the review and approval process in general. This is an educational process for me, and I'm not in a big hurry.
