John Lucas, Borough Assessor and four people in the audience. III i4INUTES OF PREVIOUS MEETING A. P&Z - regular meeting - January 27th, 1971. lir. Constance moved for approval of the minutes of January 27th, 1971, as presented, seconded by Mr. Erwin. Motion passed by unanimous voice vote. IV kl.WIES OF OTHER ISI A. Assembly - regular meeting - February 18th, 1971. There were no comments concerning the minutes of the February 18th meeting. V COMMUNICATIONS AND CORRESPONDENCE - NONE VI PUBLIC HEARINGS VII A. Rezoning Request - Millie Markham, Lots 1 through 8, Allman Addn., Block 1 (Case 236-A). Since the applicant had indicated that she might be late it was decided to continue with the rest of the agenda in order to give her time to appear. There were no objections from the members of the Commission. . Exception Request, Lot 31, Block 19, Townsite (Case 237-A) - 13i11 Lame. The letter of application was read by At. Walker, Clerk -Treasurer, in which Mr. Lame stated that an exception to the Zoning Ordinance be granted to allow.. for home occupation in this R-2 Zone. The house will be leased to Mt. & Mts. Arthur Ziegler and one roam of the four -room residence will be used for making candles. This will be owner -operated with no other -employees. Formerly -the residence had housadRadar_Electric. Mt. Constance moved to grant the exception • request for the residence on Lot 31, flock 19, Townsite, seconded by Mr. Erwin. The regular meeting was closed by the Chairman and PUblic Hearing on the exception request opened. At. & Mrs. Ziegler were present and Mr. Ziegler noted that this home occupation would not crealeproblems with noise and when asked about smell, he noted that he would not be doing any rendering of the oil but would be using refined oil for the candles. There being no other individuals present for caauents the public hearing was closed and, the regular meeting reconvened—The_question was called for and the motion passed by unanimous roll call vote. ZONIOG ITEMS A. Preliminary Review Rezoning Request, Lots 93, 94, 96, 97 & 98, Block 9, Erskine (Case 238-A) At. John Burnham. The letter of application was read by the Clerk, Mr. Walker, stating that the request was being made iwotder to establish a retail sales and service business.The location was pinpointed for the members of the Commission and the present land use maps as well as the proposed land use maps, as shown in the Comprehensive Plan, were reviewed by the commission members. According to the Comprehensive Plan this area has been designated for future business use. Mr. Constance moved for approval of a public hearing to be held at the next lAtquld/. lueLin4 on March 24, seconde y Ar. Erwin. Motion passed by unanimous voice vote. Mt. Burnham indicated • that his time was limited and that his contract allowed him sixty days in which to have the area rezoned. This deadline had been set as 15th of April; he was advised to wait until after the public hearing to determine whether or not it would be necessary for him to request an extension on the sixty day period or to request that the Borough Assembly hold a special meeting for the reading of the ordinance should the request be granted. EXCEPTION request, Block 19, Lot 31, William Lanme (Case 237-A) Short resume given in that the request was submitted to enable the occupant of the house to operate a candle shop from his residence. It was noted that in an"R-2 zone according to the Borough Code of Ordinance no consideration was given for such an occupation. Further noted that no other employees will be employed and that there is :maple parking for any customers that would be visiting the shop. The Commission felt that the exception should be opened for a public hearing prior to any decision. Mr. Welch moved for a Public Hearing on this matter to be held at the next regular meeting, seconded by I•'Ir. Constance, motion passed by unanimous voice vote. Noted that the public hearing will be advertised for the February 24th meeting. D. Zimmer Subdivision - it was noted that Mr. Zimmer withdrew his request at this time and after securing additional land will again apply for the subdivision. VIII SUBDIVISION, PRELIMINARY REVIEW - NONE IX SUBDIVISION, FINAL - NONE X PLANNING NING & ZONING ITEMS A. Mr. Lucas asked if the Planning & Zoning Commission had an overall plan for rezonings or were these done only at the request of individuals. It was noted that there is an overall plan for the development of the Community and that the Commission has the responsibility to insure that the rezonings would fit into this Comprehensive Plan. B. Resignation of the Commission Chairman - Mr. Huer submitted his resignation as Chairman of the Commission at this time due to additional responsibilities in business that would prevent him from attending the meetings. Property will be leased to Arthur Ziegler who plans to use one room of 4 -room residence to make candles. There will be no. employees and parking is adequate.
