KODIAK ISLAND BOROUGH MEMORANDUM T0: P & Z Commission rROM: Planning Department SUBJECT: Variance Application - Opolka DATE: September 14, 1977 I. REQUEST A. The petitioner is requesting the P & Z Commission allow him to repair and construct an addition to his present structure. B. The present structure is a nonconforming structure under Section 17.36.020. II. SITE A. The structure in question is located on Lot 30, Blk 19 of Kodiak Townsite. B. The property is zoned R-2 and totals approximately 3,845 square feet. C. The property fronts South Benson Avenue. D. The lot slopes down towards South Benson Avenue and sharply drops 8 to 10 feet to the sidewalk. E. A retaining wall has been constructed in front of the structure. III. HISTORY A. The house was built in 1948. B. Presently, there is a one bedroom apartment on the bottom floor and one three bedroom apartment on the top floor. IS Variance Application - Opolka Page 2 C. A visual review indicates the structure may need major repairs. D. Staff has requested the City Building Inspector and Engineer to review the building from a structural stability standpoint. IV. STAFF ANALYSIS In granting a variance, the P & Z Commission must take the following factors into consideration. Section 17.66.090 of the Kodiak Island Borough Zoning Code states in part, "Plot plans showing the location of,all.existing and proposed buildings or alterations, and such other data as may be required" should be submitted to the Planning Department at the time the appli- cation was submitted. The petitioner has not complied with this requirement. The code further stated that the petitioner must show evidence of his ability and intension to proceed in accordance with the plans within six months after the effective date of the variance. The staff has no evidence to substantiate that the petitioner has the ability or ready to proceed if the variance is granted. The code further stated that the application shall contain a statement and adequate evidence showing the following conditions, all four of which must exist before a variance may be granted: 1. That there are exceptional physical circumstances or conditions applicable to the property or to its intended use or development which do not apply generally to the other properties in the same land use district; Variance Application - Opolka Page 3 2. That the strict application of the provisions of this title would. result in practical difficulties or unnecessary hardship; 3. That the granting of the variance will not result in material damage or prejudice to other properties in the vicinity nor be detrimental to the public health, safety or welfare; 4. That the granting of the variance will not be contrary to the objectives of the comprehensive plan. The petitioner's structure is a legal nonforming structure under the definition set forth in Section 17.36.020 of the Kodiak Island Borough Zoning Code but subject to the limitations set forth in Section 17.36.010 for Existing Nonconforming Uses. In Section 17.36.010 B it states: "That no building used for such nonconforming use shall be added to, structurally altered or enlarged in any manner, except as required by another ordinance of the city or by state law, or in order to bring the building and its use into full conformity with the provisions of this title; nor shall anything be done that would influence the longev- ity or perpetuation of such nonconforming use or building beyond the normal or reasonable period of time that the saue would exist under the conditions prevailing at the effective date of prior code Chapter 5 Subchapter 2." V. STAFF RECOMMENDATION The staff feels that the petitioner does not meet the requirements set forth in Section 17.66.090 and therefore recommend that the petitioner's request be denied. KODIAK ISLAND BOROUGH Variance - Helmut Opolka I. REQUEST The petitioner, Mr. Opolka, is requesting the P & Z Commission to grant him a variance which will enable him to do some repairs and alterations on the outside of his residential dwelling. Secondly, he would like to construct a two story addition to the present structure of approximately 20 x 24. II. SITE The building in question is located on Lot 30, Block 19 of Kodiak Townsite. This property fronts South Benson Avenue and is located south of the downtown area. III. HISTORY The land uses in this area calls for residential dwellings. The building in question was built in 1948 and was, and still is, used as a residential dwelling. The house does not meet the present setback requirements as required by the present zoning code and, therefore, comes under the existing non- conforming provision of the zoning code as set forth in Section 17.36.010. IV. ANALYSIS Section 17.36.010 states that any lawful use of land, structure, building or premises existing at the time prior to the adoption of this title may be continued, provided that no building used for such noncon- forming use shall be added to, structurally altered or enlarged in any manner, except as required by another ordinance of the city or by state law, or in order to bring the building and its use into full conformity Variance - Helmut Opolka (continued) Page 2 with the provisions of this title; nor shall anything be done that would influence the longevity or perpetuation of such nonconforming use or building beyond the normal or reasonable period of time that the same would exist under the conditions prevailing at the effective date of this title. The land uses in that area, prior to the adoption of the zoning regulations, was residential. This area is presently zoned residential R-2. However, the building does not meet the setback requirement and therefore is a nonconforming structure. The court in the case of Village of Skollae vs Almendinger said that the right to a nonconforming use is a property right and that any provision of a statute or ordinance which takes away that right in an unreasonable manner, or in a manner not grounded on the public welfare, is invalid. Its also been said in Higgins vs Baltimore that a lawful established nonconforming use is a vested right and is entitled to con- stitutional protection. However, the court in McMahon vs Board of Zoning Appeals of New Haven (Connecticut) states: "One of the recognized policies of zoning is to reduce non- conforming uses to conformance as speedily as possible." It is the general policy of zoning to carefully limit the extension and enlargement of nonconforming uses. The policy of the law is to restrict such uses closely, and they may not be enlarged or extended. The court in Martin vs Cestone (N.J. Super) points out that the community's interest in the advancement of its own welfare throuh the medium of a zoning project is to this extent, favored over the individual's interest in his nonconforming use. Variance - Helmut Opolka (continued) Page 3 In the decision of the Supreme Court of Utah in the case of Benjamin vs Lietz, the court decided that where the owner of a planting mill expanded his facilities into a new building after the enactment of a zoning ordinance, he could not rely upon the nonconforming use pro- vision to protect his use in excess of authorized horse power, and the court upheld a decree limiting the owner to the statutory maximum. V. STAFF RECOMMENDATION The intent of the law, we believe, is to reduce all nonconforming uses within the zone to conformity as speedily as is consistent with proper safeguards for those affected. It has been stated that the rule respecting nonconforming uses was evolved as a conceived element of due process and is not a special priviledgp or exemption from the scheme of zoning. Such uses are in conflict with the overall purpose securing fair and proper zoning and that, therefore, they should not be expanded beyond the necessity for protecting the original property interest. Any change in the premises which tends to give permanency to, or expands the nonconforming use would not be consistent with this purpose. It is our understanding that the petitioner wants to do some repair work on the outside of the structure and furthermore construct an addition to the present building. If the Commission grants the petitioner's request to construct an addition of 20 x 24 to the existing structure, it will in our opinion, influence the longevity or perpetuate the life of the building and thus prolong the nonconforming life of the structure. On the other hand, if the petitioner wants to do some minor repairs to the outside of the existing structure, this should be interpreted as Variance - Helmut Opolka (continued) Page 4 not an extension or enlargement of the nonconforming use but merely a necessity to protect the original property interest. The staff, therefore, recommends that the petitioner's request to construct an addition to the existing dwelling be denied.
