I respectfully submit that I cannot accomodate you on this request. WE have just completed a lengthy process of two appeals and counter appeals before the Planning and Zoning Commission and. City Council. This process started last July when I submitted revised plans on the renovation and addition to my home to John Sullivan.(local building inspector) The proposed stairs were clearly detailed on he plans submitted.Evidently, through a lack of communication between the city building inspector and yourself it was overlooked.Aparently no one considered it to be a problem.It could easily have been taken care of at one of the two appeals heard. By your own admission the Planning and Zoning Comission and Kodiak City Council are tired of hearing Joe Perrozzi-Tim Hill appeals. They don,t want to see us a third time.I truly regret that this situation has reached thesee proportions. Dear Joe: Tim Hill contacted the Community Development Department on February 7, 1985 concerning a doorway being constructed as part of your one-story addition. Mr. Hill felt that a stairway leading down from this door would not meet the rear yard building setbacks of 6.8 feet required by borough code. My initial phone call to you on February 8, 1985 and the many subsequent conversations since that date have indicated that it is your intention to construct a flight of stairs from this door to ground level. In our conversa- tion of February 27, 1985, you suggested the possibility that the stairs may be built around the side of the building before going down to ground level. As stated in our conversations, either proposal would require a variance from the Kodiak Island Planning and Zoning Commission because they fail to comply with Section 17.40.010(A) of the borough code which states: 17.40.010 Projections into required yards. Where yards are required, they shall not be less in depth or width than the required minimum dimensions in any part, and they shall be at every point open and unobstructed from the ground to the sky, except as follows: A. Outside stairways, fire escapes, porches, decks, or landing places, if unroofed and unenclosed, may extend into a required side yard for a distance not to exceed four feet or into a required rear yard for a distance not to exceed twelve feet, but never more than one-half the distance of any required yard. The minimum required setbacks for Lot 30, Block 19, Kodiak Townsite Alaska for a set of uncovered stairs are as follows: Stairs built on to the rear of the dwelling - 6.8 feet. Stairs built on to the side of the dwelling - 3.55 feet. Any stair construction that might occur within these minimum setbacks requires a variance granted by the Planning and Zoning Commission. Joe Perrozzi March 5, 1985 Page 2 Construction of exterior stairs would also violate the provisions of your building permit which states that there will be "no changes" to the setbacks of the existing structure by your new additions. The site plan used to determine the borough's required setbacks was drawn by Rolland A. Jones, Consulting Engineer, in 1977. You have expressed a concern that this survey was not completed by a registered surveyor and therefore may not be accurate. If you feel that you meet the required setbacks, a current property survey of your lot should be initiated.
