A RESOLUTION OF THE KODIAK ISLAND BOROUGH PLANNING AND ZONING
COMMISSION GRANTING A VARIANCE TO PERMIT THE CONSTRUCTION OF AN ADDITION TO AN
EXISTING NON -CONFORMING STRUCTURE. (ROBERT BRODIE)
WHEREAS, a petition was received from a Mr. Robert Brodie re-
questing a variance from the non -conforming structures provision of Title 17,
Kodiak Island Borough Code of Ordinances to permit the construction of an
addition to an existing structure on Lot 29, Block 19, Kodiak Townsite Subdi-
vision, and;
WHEREAS, notice was published, notices were mailed and a public
hearing was held, and;
WHEREAS, the commission found the existing structure projects
approximately 14.0' (feet) into a required rear yard of 16.7' (feet), and;
WHEREAS, the commission found the applicant wishes to raise the
building approximately 2' (feet) vertically, replace the existing deteriorating
foundation with a basement and add a conforming addition with a loft to the fron
of the building in conformance with the provisions of the building and zoning
codes, and;
WHEREAS, the commission found that strict application of the pro-
visions of the zoning ordinance would result in practical difficulties and un-
necessary hardship in that without the variance the new conforming construction
could not take place, and;
WHEREAS, the commission found that granting the variance would
not result in material damage or prejudice to other property in the vicinity
nor be detrimental to public health, safety and welfare as all new construction
other than the foundation and basement would take place in a conforming location
On the site, and;
WHEREAS, the commission found granting the variance would not be
.THEREFORE BE IT -RESOLVED by the Kodiak Island Borough Plan-

REQUEST. This is a request for a variance to permit the a n;struction of an
addition to an existing dwellingstructure which encroaches 14.0''��nto a rectUtred

lo..',daryard.in a residential zoning use district. In the application, the
applicant Mr. Brodie, described the existing situation and that granting his request
would permit as follows: "The existing situation is - there is 45' of usable yard
in the front of my lot and the house foundation needs repair. Granting of this
petition would permit me to more'fully Utilize my property and upgrade the appearance
and value,o.f my house.: Mr. Brodie further states "that he has further provided in
his application the following information:.. He states from his application on

1. That there are exceptional physical, circumstances or conditions applicable to
the propery or to its intended use for development which do not apply- generally
to other properties in the same land use district. 'These special conditions are:
"The house rests on the extreme rear portion'o f the lot leaving a great deal of
usable space in the front. In the strict -application of the provisions of this
title would result in practical difficulty or unnecessary hardships
2. That the granting of the variance will not be contrary to the objectives of the
Comprehensive Plan for the following reasons: '
a. -No work will be done which changes any existing situat'ion and all the work
would be within the frame work of the zoning ordinance. The applicant
further states "I wish to raise the existing structure 2.' in order to obtain
a full height basement which is at presently'only 6' high". Also."I would

like to fix'an area of deteriorating wood in the rear foundation. In the
addition I want to extend the basement and first floor and add a small loft
with attic area.

RECOMMENDATION.
The following options are available foryoUr"consideration in deciding what action
you wish to take in regard to. this application:

ADDENDUM
1973 UBC Table 5 A Single family dwelling side yard 1 hour less than 3'.
Superimposing a property .line.between the 2 houses there should:be 6' with the
type of construction involved there there is to be no openings within 3' of the
property line. Both houses have openings between them.for fire life safety.
There should be not less than 6' between the houses. The structure encroaches
into the side 7" on one side and 10" on the -other side. The 7" encroaches onto
