Dear Mr. Bloomquist:
The Kodiak Island Borough Planning and Zoning Commission at their
meeting on December 15, 1993, granted the conditional use permit
request cited above, subject to the following conditions:
A site plan review by the Kodiak Island Borough Planning and Zoning
Commission is required of all site plans, parking plans, etc., prior to the
issuance of a zoning compliance permit for this project. The
Commission reserves the right to place reasonable conditions of
approval on the development proposal, as it deems necessary, when the
review is conducted.
2. This CUP is subject to approval of related rezone request 93-071. This
CUP becomes effective only upon the adoption by the Borough
Assembly of a rezone to Light Industrial for Lots 1 - 6, Block 1,
Lakeside Subdivision.

THIS APPROVAL DOES NOT ALLOW ANY CONSTRUCTION TO BEGIN.
Zoning compliance and/or a building permit must first be obtained. An
approved conditional use must be permitted within a two year period
to be valid. Please contact this office for further details.
An appeal of this decision may be initiated by; 1) the applicant, or 2) any
person who was sent a written notice or submitted timely written comments
or gave oral testimony at the public hearing before the Commission, by filing
a written notice of appeal with the Borough Clerk within twenty (20) working
days of the date of the Commission's decision. The notice of appeal must
state the specific grounds for the appeal and the relief sought by the
appellant.. Therefore, the Commission's decision will not be final and
effective until twenty (20) working days following the decision.
This letter shall constitute the conditional use permit. Please bring it
when you come to our office to obtain zoning compliance for any construction
on the property.
The Commission adopted the following findings in support of their decision:
1. That the conditional use will preserve the value spirit. character and
integrity of the surrounding area.
Given the prevailing zoning of the surrounding area for industrial and
commercial uses and the separation from residential areas by Lot 7,
Block 1, Lakeside Subdivision, it does not appear that the project will
have any effect on the value, spirit, character and integrity of the
surrounding area. This approval will be subject to a future plan review
by the Planning and Zoning Commission which reserves the right to
consider appropriate conditions of approval, if applicable, at the time
such review occurs.
2. That the conditional use fulfills all other requirements of this chapter
pertaining'to the conditional use in question.
This can only be answered at the time a plan is presented for review by
the Planning and Zoning Commission. The City of Kodiak will have
plans developed by an architectural firm once the project hasbeen
approved and funded by the State of Alaska. These plans will be
developed in accordance with the codes and regulations in effect at that
time, subject to Commission review prior to the issuance of zoning

compliance. The Commission reserves the right to place reasonable
conditions of approval on this project at the time of this review to
ensure compliance with this provision of the CUP.
That granting the conditional use permit will not be harmful to the
public health, safe y. convenience and comfort.

public safety and jail facilities. This project will improve the ability of
the police . department to meet the public safety needs of the
community. AU structures proposed for development as a result of this
CUP will be reviewed by the Commission and the Building Officials to
ensure that the development is consistent with all applicable zoning,
building and fire safety codes in effect at the time of review.
4. The sufficient setbacks. lot area. buffers or other safeguards are being
provided to meet the conditions listed in subsections A through C of
this section.
The LI --Light Industrial zoning district does not have any setback
requirements, however, the building code regulates setback of
structures by requiring a higher firewall, rating for structures that are
built close to, or on the lot line. When the Commission reviews the site
plan for this project, it will have the option of applying reasonable
screening, setback or other conditions that it feels are necessary to
ensure compliance with the provision of this CUP.

The 1991 Lakeside Subdivision/Safeway Subarea Plan
indicates this area for GeneralBusiness. The proposed
LI—Light Industrial zoning district evolved directly from
the efforts of the Commission to develop a new "General
Business" zone to implement the plan designation. As a
result, this zoning change is consistent with the
objectives of the plan.

DUANE DVORAK indicated 50 public hearing notices were
mailed for this case and none were returned. Staff originally
recommended approval, subject to conditions. However, due to
lack of information especially from the Department of
Environmental Conservation, staff recommended
postponement of this case and rescheduling for another public
hearing at the January 19, 1994 regular meeting.

17.72.030 Manner of initiation. Changes in this title may be initiated in the
following manner:
A. The borough assembly upon its own motion;
B. The planning commission upon its own motion;
C. By petition of one or more owners of property within an area proposed
to be rezoned. A petition shall be in the form of an application for a
change in the boundary of a district, shall be filed in the community
development office, be accompanied by the required fee and such data
and information as may be necessary to assure the fullest practicable
presentation of facts and shall set forth reasons and justification for
proposing such change.
17.72.055 Submission to assembly.
A. Within thirty days after the planning commission has acted favorably
upon a proposed zoning change in accordance with the above provisions, a
report with recommendations shall be submitted to the assembly together
with the proposed ordinance. Such recommendations of the planning
commission shall be advisory only and shall not be binding upon the
assembly. When an ordinance has been forwarded to the borough assembly,
the assembly shall act in accordance with this chapter and notice shall be
issued as provided in Section 17.72.070, by the borough clerk.
COASTAL MANAGEMENT APPLICABLE POLICIES
Industrial Development
1. Optimal Location
In order to satisfy industrial requirements, meet safety standards,
protect fish and wildlife resources, and maintain environmental
quality; sites for industrial development shall be identified in
conjunction with the Kodiak Island Borough.
Consistent: Yes. The Kodiak Island Borough has identified this
area as General Business in the 1991 Lakeside

Subdivision/Safeway Subarea Plan. Commission
development of a "General Business" zone, evolved
into the existing LI --Light Industrial zoning district.
The LI --Light Industrial zoning district was always
intended to fulfill the role of implementing the
General Business designation of the subarea plan.
Natural Features
Dredge and fill, excavation, shoreline alteration and disturbance of
anadromous streams, tideflats and wetlands shall be minimized
when constructing and operating port, harbor, dock, business and
energy facilities - if permitted under applicable regulations.
Consistent: Not applicable. This action does not involve
excavation or alteration of the shoreline, disturbance
of anadromousstreams, tideflats or wetlands.
Natural Setting Views and Access
Development shall be conducted in a manner that mitigates adverse
impacts upon the Kodiak Archipelago; developers shall provide
opportunities for public access to the shoreline and scenic views, to
the extent feasible and prudent.
Consistent: Not applicable. This land is not located along the
shoreline.
4. Dredge and ExcavaUlon Material
Dredging and filling shall be consistent with ACMP Standards 6 AAC
80.040 (Coastal Development) and 6 AAC 80.110 (Mineral and Mining
Processing). Dredge spoil may be utilized in shoreside landfills if
permitted under applicable regulations for the purpose of creating
usable waterfront land.
Consistent: Not. applicable. This action does not involve any
dredging or filling along the shoreline.

Developments in or over the water, such as piers, docks and
protective structures shall be located, designed and maintained in a
manner that prevents adverse impacts upon water quality, fish,
wildlife and vegetative resources and minimizes interruption of water
circulation patterns, coastal processes and navigation.
Consistent: Not applicable. This action does not involve
development in or over the water.
6. Buffer Zones
Buffer zones shall be established to the extent feasible and prudent,
between business areas and major public transportation routes and
between business development and adjacent, non -business properties
in order to minimize conflicts between land uses.
Consistent: Not applicable. This site is located in a long
established industrial area.
7. Accessory Development
Accessory development that does not require a shoreline location in
order to carry out its support functions shall be sited away from the
shoreline whenever there is a feasible and prudent inland alternative.
This category includes parking, warehousing, open air storage, waste
storage, treatment or storm runoff control facilities or utilities.
Consistent: Not applicable. This request does not involve
accessory development.
8. Wetlands
Filling and drainage of water bodies, floodways, backshores or
natural wetlands shall be consistent with ACMP Standards 6 AAC
80.070 (Energy Facilities) and 6 AAC 80.130 (Habitats).

COMMENTS
This request is related to rezone case 93-071, a request to rezone Lots 1 - 6,
Block 1, Lakeside Subdivision from I --Industrial to LI --Light Industrial. The
LI --Light Industrial zoning district permits institutional uses as a conditional
use where the I --Industrial zoning district does not permit any type of
residential use not related to an established fish processing facility. As a
matter of course, the rezone must be approved by the Kodiak Island Borough
Assembly before this CUP can take effect.
An exception for a public safety complex/jail was previously approved by the
Commission for Lots 3-6, Block 1, Lakeside Subdivision (Case 91-029).
This CUP is intended to obtain conceptual approval for a joint City/State
Public Safety Complex, including a new jail facility. The exact location, size
and other particulars of the proposal are not known at this time. The
approval is necessary in order to assure the State of Alaska that a suitable site
is available for the project before funding can be considered to pursue further
planning of the proposed facility.
Staff recognizes that a CUP cannot be adequately reviewed by the
Commission in the absence of such information necessary to describe the
character and impact of the proposed development. Given the proposed
location, staff sees no problem in granting conceptual approval at this time,
subject to the condition of'a site plan review by the Planning and Zoning
Commission at the time permits are requested. The lots are adjoining
existing commercial and industrial areas, the Kodiak Municipal Airport and
separated from the nearest residential development by a large buffer
strip/reserve (Lot 7, Block 1, Lakeside Sub.). A site plan review would be easy
to accomplish after specific site and parking plans have been developed for
this project. The Commission could place conditions of approval on the
project as it deems necessary at the time a plan has been developed and
submitted for review.
In order to grant a conditional use permit, the Commission must find that the
use proposed in the application meets all of the following:

RECOMMENDATION
Staff finds that, with conditions, this request does meet all the conditions
necessary for a conditional use permit to be granted under Chapter 17.67
(Conditional Use Permits) of the Borough Code.
APPROPRIATE MOTION
Should the Commission agree with the staff recommendation, the appropriate
motion is:
Move to grant a request for a conditional use permit in
accordance with Section 17.27.040 B. (Conditional Uses) of the
Borough Code, to permit a proposed public safety/correctional
facility to be located on Lots 1-6, Block 1,. Lakeside Subdivision;
subject to the conditions of approval contained in the staff report
dated November 30, 1993, and to adopt the findings contained in
the staff report dated November 30, 1993, as "Findings of Fact"
for this case.

PUBLIC HEARING NOTICE
A public hearing will be held on Wednesday, December 15, 1993. The
meeting will begin at 7:30 p.m. in the Borough Assembly Chambers, 710
Mill Bay Road, Kodiak, Alaska, before the Kodiak Island Borough Planning
and Zoning Commission, to hear comments, if any„ on the following
request:
Case 93-072. Request for a conditional use permit, in
accordance with Section 17.27.040 B. (Conditional Uses) of the
Borough Code, to permit a proposed public safety/correctional
facility to be located on Lots 1-6, Block 1, Lakeside Subdivision.
2102, 2166, 2234, 2310, 2406, 2478 Selief Lane.
This notice is being sent to you because our records indicate you are a property owner in the area of the request.
If you do not wish to testify verbally, you may provide your comments in the space below,
or in a letter to the Community Development Department prior to the meeting. If you

One week prior to the regular meeting, on Wednesday, December 8, 1993 a work session
will be held at 7:30 p.m. in the Kodiak Island Borough Conference Room (#121), to review
