He was inquiring about the reason for the Stop Work Order issued for his Lot 1C, Lakeside 2nd Addition warehouse project. I passed that the order was issued due to the following information that was discovered during our research into his screening review request (Case No. 14-006): 1. The site plan accepted during the issuance of ZCP BZ 2012-041 does not meet the KIBC side yard setback requirements for the industrial Zoning District. 2. KIBC 17.105,0403 requires a side yard on each side of a principal building of not less than 20 feet, except that approved fire wall installations between adjoining structures provide for construction on the lot line. 3. The side yard property line in question boarders a public right-of-way and no adjoining structure can be placed there: therefore, the building may not be constructed on that lot line and the 20 foot setback requirement applies. 4. Our department failed to identify this discrepancy during the issuance of ZCP BZ2014-041, which was an error on our part. 5. Possible remedies: a. Provide an updated site plan that shows the building will be located in an area that meets setback requirements. b. Apply for a variance that will allow the building to be constructed in the location identified in the current site plan. i. The department will waive required fees. ii. The department will make every effort to have the case presented to the Commission during their October meeting. Mr. Wing stated that he would be in Anchorage for the next two days and would be in contact with us when he returned to Kodiak. He expressed concerns over investments he has made based on a KIB issued ZCP and with costs related to delayed construction, He said he would be contacting his attorney. I passed that he may contact the department if he had any further questions or concerns. I'll place a copy of this email in the property file as a record of our conversation.
