D. OTHER ITEMS 1. Authorization to bid East Elementary Playground. STEVENS, moved to authorize East seconded by GREGG Elementary Playground. Mayor Selby explained there were 495 children enrolled at East Elementary School this fall. With the addition of the new school wing and more students, there was a need for more playground space, fencing, and drainage, he stated. VOTE ON MOTION MOTION CARRIED Unanimous voice vote 2. Authorize $3,400 to Chamber of Commerce for Boston Fish Exposition. GREGG, seconded by BARKER moved to award $3,400 to Chamber of Commerce for Boston Fish Exposition. Assemblyman Stevens abstained from voting since he is the Director of the Chamber of Commerce. Mayor Selby said the request had been for $6,800 which was split between the city of Kodiak and the borough to have representatives of Chamber of Commerce participate in the Boston Fish Exposition, He said the Chamber's attendance at the Seattle Fish Exposition last year was a factor contributing to the successful Kodiak Fish Exposition this past spring. He felt there was a need to educate the residents of the east coast about Alaska to clear up several misconceptions. The presiding officer interrupted Mr. Berry by stating the Clerk had advised him there was an appeal pending on the subject of crab pot storage in the Womens Bay area. He said the assembly should not listen to testimony prior to hearing the appeal. He said he looked into the situation and would like an explanation about what was happening. Mayor Selby said the project was part of the parks development program. He said that he had heard about the culvert and explained the situation. 'He said it would have cost as much to do the paperwork to bid a small job like this as it cost to do the project. Assemblyman Merriman disagreed with the mayor and felt it would have been cheaper to have qualified people do the work. Assemblyman Austerman further expounded on the culvert and the project at Island Lake Park. He, also, reported on the Southwest Alaska Municipal Conference meeting in Sand Point and the achievements of that community regarding the fishing industry. He thought the assembly needed to take a more aggressive stance in pursuing fishing support industries. He noted that Anchorage was also pursuing the fishing industry. He said Kodiak was strategically located and should be the shipping hub for the state of Alaska. He thanked the individuals who testified on the outdoor storage issue and said it was an issue that needed to be addressed. He stated that he would be out of town until September 18. Assemblyman Gregg pointed out that two borough service districts had contracts with low bidder contractors for road maintenance. He suggested these contractors be used on jobs that were too small to go out for bid. He felt Ordinance No. 88-28-0 should have been defeated since tabling it put an undue burden on individuals concerned about it. He said the assembly's intent was clear, and the ordinance should be rewritten. Also, he thought it was time to build the new school in the Monashka Bay area since both Main and East Elementary schools were filled to capacity. Assemblyman Stevens said he heard over the radio about some creative staffing and utilization of existing school structures by using double shifting of teachers and year round segmented school terms. He wondered if the school board had looked into alternatives to building a new. school. He also spoke about the SWAMC meeting and regional concerns. Assemblyman McFarland supported Assemblyman Gregg's analyses of the outdoor screening problem. He reviewed the points brought up by Ginny Chitwood at the Consolidation Committee Meeting on Monday. Assemblymember Harker added her personal best wishes and congratulations to Harry Michelson. She said Mr. Michelson was not only a fine representative on the Olympics for Kodiak, but also a fine individual and role model for children. Assemblyman White stated he had mixed feelings on the tabling of the outdoor storage ordinance. He thought by tabling the ordinance, it would be kept in front of the assembly. He felt a substitute ordinance was needed to address the concerns of the assembly. He said he wanted to meet with the Planning and Zoning Commission next week to discussion this ordinance along with other matters. Assemblyman Austerman wondered if it might be possible to have a joint meeting with the city of Unalaska to discuss fishing issues and to prevent conflicts or misunderstandings. Request to investigate the rezoning of Lots 4 through 11, Block 3, Lakeside Subdivision from I --Industrial to a different zoning district classification in accordance with Chapter 17.72 (Amendments and Changes) of the Borough Code. 2327, 2289, 2249, 2207, 2165, and 2095 Selief Lane; 443 Von Scheele Way; and, Lot 10 is presently a greenbelt extendingfrom Selief Lane (along Beaver Lake Drive) to Von Scheele Way. (Kodiak Island Borough) BACKGROUND This rezoning investigation -was before the Commission for a public hearing at the May 18, 1988 regular meeting and before the Commission as Old Business at the June 15, 1988 regular meeting at which time the Commission tabled it until the September 21, 1988 regular meeting., It was the Commission's intent to discuss the issue at one worksession a month until the September meeting. The Mayor has asked for a quicker response from the Planning and Zoning Commission, so staff put the item on the August agenda as an Old Business item. The Commission's intent when this item was tabled, was to hold another public hearing on the item in September. Staff was not able to schedule this item as a public hearing, lacking information for the notice. 'Staff contacted the executive director of the Kodiak Island Housing Authority to notify her of the placement of this item on the August agenda. The Commission discussed this item at both the June 22 and the August 3 worksessions.. The August 3 worksession included a field trip to the property. Please refer to the attached staff report for further infouuation. RECOMMENDATION At the August 17, 1988, Planning and Zoning Commission regular meeting, the Commission moved to recommend to the Kodiak Island Borough Assembly that: Lots 4 through 11, Block 3, Lakeside Subdivision not be rezoned, but that an alley be platted and developed on the interior of the adjacent platted green belt. The alley Re: Lakeside Subdivision Assembly: September 1, 1988 should be developed at the existing grade so that access is provided to the rear of the platted lots. Development of the alley should not disturb the platted green belt. In addition, although not included in the motion, the Commission discussed a proposed width for the alley. There was general consensus that the alley should be a minimum of 30 - 40 feet in width. Section 17.72.020 states that the Commission shall incorporate the following criteria into their report to the Assembly: FINDINGS OF FACT 1. Findings as to the Need and Justification for a Chance or Amendment. The Commission finds that there is no need or justification to rezone Lots 4 though 11, Block 3, Lakeside Subdivision from I --Industrial to another zoning district classification. Especially, in light of the lack of undeveloped industrially zoned property within the City limits, the proximity of the property to the municipal airport and impound yard, and the large platted buffer between the block and nearby residentially zoned property. 2. Findings as to the Effect a Change or Amendment would have on the Obiectives of ghe Comprehensive Plan. The 1968 Comprehensive Plan generally depicts this area for Light Industrial and Public and Open Space. Retaining the existing zoning district classificationis consistent with the light industrial designation in the comprehensive plan. Much of the area identified in the vicinity of this block for public and open space has been already developed for other uses, primarily residential. As a result, the comprehensive plan designation of public and open space is no longer appropriate for this area. For your information, Section 17.72.055 (Submission to assembly) of the Borough Code states: B. If the planning commission recommends denial of any proposed amendment, its action shall be final unless the initiating party, within ten days, files a written statement with the clerk requesting that the commission's action be taken up by the borough assembly. The requirement of thirty (30) foot flag stems in this instance would result in real difficulties, and the variance from the thirty (30) foot flag stem requirement will allow the subdivider to develop his property in a reasonable manner. 2. (Kodiak Island Borough) Although this area was extensively scrutinized prior to an area wide rezoning in 1985, as a result of development that has taken place, and continues to take place in the area, the Assembly asked the Commission to investigate rezoning Block 3 of Lakeside Subdivision in a manner compatible with the character of the area (Resolution Number 88-32-R). The request from the Assembly did not include Lots 1 through 3, Block 3 that are currently owned by the City of Kodiak. Subsequent correspondence has confirmed that the City of Kodiak does not want their three (3) lots included in the rezoning investigation. In addition, the City also recommended that the zoning of the block remain unchanged due to the scarcity of undeveloped industrially zoned land in the City of Kodiak. This rezoning investigation was before the Commission for a public hearing at the June 15, 1988 regular meeting at which time the Commission tabled it until the September 21, 1988 regular meeting. Staff was not able to schedule this item as a public hearing, lacking information for the notice. Staff contacted the executive director of the Kodiak Island Housing Authority to notify her of the placement of this item on the August agenda. The Commission discussed this item at both the June 22 and the August 3 worksessions. The August 3 worksession included a field trip to the property. The results of the Commission's discussion appears to be a consensus not to rezone the property, but to Case 88-027 1 of 2 P&Z: August 17, 1988 :TEM VII -C recommend that the Assembly plat and develop an alley on the property on the "inside" of the greenbelt to allow access to the lower portion of the block. It also appeared to be the consensus of the Commission that the Assembly reevaluate the sale price asked for the property and consider reducing the price. APPROPRIATE MOTION Should this memo accurately reflect the consensus of the Commission, an appropriate motion is provided below. Move to recommend to the Kodiak Island Borough Assembly that Lots 4 through 11, Block 3, Lakeside Subdivision not be rezoned, but that an alley be platted and developed on the interior of the adjacent platted green belt. The alley should be developed at the existing grade so that access is provided to the rear of the platted lots. Development of the alley should not disturb the platted green belt. The Commission also adopts the findings of fact contained in the staff memorandum dated August 9, 1988. FINDINGS OF FACT Section 17.72.020 states that the Commission shall incorporate the following criteria into their report to the Assembly: 1. Findings as to the Need and Justification for a Change or Amendment. The Commission finds that there is no need or justification to rezone Lots 4 though 11, Block 3, Lakeside Subdivision from I --Industrial to another zoning district classification. Especially, in light of the lack of undeveloped industrially zoned property within the City limits, the proximity of the property to the municipal airport and impound yard, and the large platted buffer between the block and nearby residentially zoned property. 2. Findings as to the Effect a Change or Amendment would have on the Objectives of the Comprehensive Plan. The 1968 Comprehensive Plan generally depicts this area for Light Industrial and Public and Open Space. Retaining the existing zoning district classification is consistent with the light industrial designation in the comprehensive plan. Much of the area identified in the vicinity of this block for public and open space has been already developed for other uses, primarily residential. In so doing, they were instrumental in preventing serious injury, not only to the officer, but to the suspect and members of the public. Mayor Brodie said their actions, taken at considerable personal risk, were in the highest tradition of public service and were great'. appreciated by the members of the City Council, Folic Department, City administration, and the local citizens. Special commendation certificates were presented to Mike Fisher and Audy Algoso. Mr. Algoso was unable to attend the meeting' and his certificate was accepted by his father, Vic Algoso. Officer Rambac was present for the ceremony. b. Proclamation RE: Perfect Posture Month in Kodiak Acting City Manager Deebel said this proclamation designated May as "Perfect Posture Month in Kodiak." Public Hearing RE: Navy Romeporting Acting Manager Deebel said this hearing was the second of two public hearings on the possibility of the Navy home - porting in Kodiak. • After limiting each speaker to three minutes and cautioning against personal attacks, Mayor Brodie closed the regular meeting and opened the public hearing. Ron Chase, a resident since 1954, worked for the Navy whe. the Kodiak Navy base was larger than the town. He sai 4,000 Army, Navy, and Marines did not ruin Kodiak in the early 1940's and would not do so now. He wished to rebut the negative letters printed in the newspaper. He had never seen a problem the Navy did not take care of themselves. He spoke about.. the Navy's conservation club which harvested .. fish eggs and stocked streams. He said the Navy did not want trouble with civilians. Nick Troxel, an 18 year resident and a fisherman, said there were many unanswered questions on the Navy homeporting in Kodiak. It would amend the City of Kodiak Personnel Rules and Regulations regarding job announcements, impending demotion or termination, and em- ployee organizations. The public hearing on Ordinance Num- ber 834 was held April 28 at which time action was deferred to May 12 when it was again tabled to this meeting. The Council met with the Personnel Board on May 5 and May 17. At the Council's request, the City Attorney prepared an amending motion. First Reading, Ordinance Number 838 RE: Prohibiting the Riding of Skateboards and Similar Devices in the Down- town Business Area Mayor Brodie read Ordinance Number 838 by title. The Acting City Manager said this ordinance was presented at the re- quest of the Police Advisory Board to amend Kodiak City Code Title 10 to prohibit riding skateboards and similar devices in the downtown business area. Prohibiting bicycles had al- ready been addressed by the State in 13 AAC 02.400(g) stat- ing that no person may ride a bicycle on a sidewalk in a business district. Amending the ordinance to provide the option of community service as a penalty was discussed at the May 25 worksession. Councilmember Iani MOVED, seconded by Councilmember Cratty, to approve Ordinance Number 838 in the first reading. Councllmember Cratty MOVED, seconded by Councilmember Thompson, to amend Ordinance Number 838 to provide for a S20 fine or the equivalent in community service. Resolution No. 88-31-R Urging The Alaska State Senate To Pass House Bill 4 Continuing The Alaska Women's Commission And Retaining Commission Funding. STEVENS, move to adopt Resolution seconded by AUSTERMAN No. 88-31-R. Assemblyman Stevens requested Acting Mayor Freed who serves on the Alaska Women's Commission to explain the commission's stance. Acting Mayor Freed said she had only been a member of the commis- sion since January and since Mr. Reppond spoke about the commis- sion activities in 1982, she could not say where the commission stood at that time. She did say the commission does view its roll as advocacy and was working with the state legislature to get a new divorce and dissolution bill. The purpose of advocating within the legislature for this new bill was to protect families in the divorce and dissolution process. She said the commission had also worked on economic equity for women within the state. She added that one of the main advocacy rolls which the commission had played in the last few years was advocating for the current state displaced homemaker program. Assemblyman Stevens thanked all those individuals who testified in favor of the school district budget.
