I understand that a question has arisen concerning permitting for structural additions to these zero -lot line units. Specifically, when one occupant of a Mutual Help zero -lot line unit applies for a permit to build an addition to his or her unit, who is the appropriate party to provide consent under code provision 17.34.070(C), which requires written approval from the owner of the adjacent unit? Under state and federal law, KIHA is the only entity having a "legal interest in the title" of the adjoining unit for purposes of declining or granting consent to unit additions. KIHA is the record owner of the real property, and the Mutual Help participant is merely a lessee with option to purchase. 24 C.F.R. 446. The occupant's lease interest is not recorded, and does not qualify as an equitable interest in the property. At least until title passes, KIHA continues to own the unit and exercises control over all material alterations any. any other decision which may affect the value of the property.I As such, KIHA is the appropriate entity to decline or grant consent for building permits on the Beaver Lake project. As the Beaver Lake project ages, occupants of various zero -lot line units will obtain title, and the party from whom consent is required may change accordingly. Presently, however, KIHA is the legally vested owner of all Beaver Lake units. Accordingly, no occupants may alter their units without KIHA's approval.
