September 19, 1988 Ami,�' 61 Joseph Hok Lot 3B, Block 1, Lakeside Subdivision First Addition Called in August 1988 to complain about neighbors fence. Mr. Clarence Selig of Lot 4A, Block 1, Lakeside Subdivision First Addition, had built an unsightly fence which was taller than the Borough allows. Also the fence was built upon Mr. Hok's property by about 6 inches. The fence was estimated to e4mca be about 6 inches too tall. It did not appear that Mr. Selig had a Zoning Compliance to build the fence. After discussion with other planning staff members it appeared'that the department would not have a problem if the fence is only a matter of a few inches over the requirement. As long as it Lu�.5 "substantially in compliance". As for the look of the fence, there again, the Borough does not regulate appearances. If there is a blatant code violation then the Borough would take action. As for the property dispute, the Borough does not get involved in civil matters not related to code enforcement. This is something better left to the individuals themselves to work out. Final note. Mr. Selig had not obtained a Zoning Compliance Permit for the fence. All items built without zoning compliance are built at the owner's risk. If enforcement action were appropriate, the 8ourough could require the fence to be removed at the owner's expense. Duane Dvorak, Planner Kodiak Island Borough cc: Lot 4A, Block 1, Lakeside Subdivision First Addition. 7/26/88 Memorandum to file On 7/26/88, l received a complaint from Mr. Clarence Selig, Lot 4A, Block 1, Lakeside Subdivision, concerning a development by his neighbor, Mr. Joseph Hok, at Lot 3B, Block 1, Lakeside Subdivision. Mr. Selig came to the office with some plans and proceeded to describe the development of an attached deck to the existing zero lot line single family residence. I checked for zoning compliance and found that Mr. Hok had been issued zoning compliance to construct a green house and a backyard fence. l then checked with the Building Official and obtained plans for the development which l placed in the existing file. A building permit has been issued for the green house as it had been determined by the Building Official to be an un -attached structure. I called back the complainent and told him the situation. He had no problem with the interpretation of the code concerning accessory buildings however he then stated that it was larger than it was supposed to be on the zoning compliance. I said that l would pass that along to the building department and have them inspect for compliance.
