This correspondence is directed to you as a courtesy notice and advisory.
The Community Development Department has recei'ved a written complaint alleging the
use of the above identified Business/Conservation Zoning District property'for gravel
extraction purposes (a prohibited use in'those Zoning}Districts). As per standard
procedure, our department performed,an'investigation of the allegations of that
complaint. Our investigation included field reviews,of the property, a review of the
pertinent property files, and conversationa`wifh,.you and Mr. Rick Ryser, owner of
Golden Alaska Excavating, -.
Our department conducted various field .reviews of the property from July 27 through
August 15, 2011. Although those field reviews seemed•to verify the allegations of the
complaint (piles of rock/gravel and heavy ekpavating equipment noted on the property),
a conversation with you.on,August 15, 2011,?revealed otherwise. During that
conversation you stated you,had hired Golden Alaska Excavating to push off rock/gravel
from the surface of -the upper level of your property and remove that material, as well as
other materiel that -had already fallen to the improved lower level of your property (no
excavation'taking place). You stated t_hat.you had done so to reduce the potential for
falling rock to damage container vans being stored on your property (something you had
experienced in the past). \
Upon your explanation of the activities taking place, our department advised you that
you couldmaktno profit onithe rock/gravel being removed. You were also advised that
if your contractor intended prase any of the removed material for commercial purposes,
that material would-be_subject to Kodiak Island Borough Severance Tax as prescribed
in chapter 3.45 of the Kodiak Island Borough Code (copy enclosed with this
correspondence).
As a result of our advising you of the Severance Tax requirement, our department was
visited by Mr. Rick Ryser (owner of Golden Alaska Excavating) an August 16, 2011. Mr.

Ryser confirmed your explanation of the activities taking place on the property. He also
stated that you were not profiting from the material being removed, but that he was
using that material during the performance of other jobs (commercial use). In addition,
Mr. Ryser registered with our Finance Department to pay the required Severance Tax
on any rock/gravel he removes during the maintenance of your property and has paid
that tax on the materials he has removed since.
Due to the findings of our department's investigation, we have determined the activities
taking place on your property are directed towards the maintenance of the currently
improved portion of your property and not towards commercial gravel extraction. This,
combined with the fact that no site grading activities were observed (excavation and fill
in excess of one foot) and the fact that your contactor has paid\the required Severance
Tax on any commercially utilized removed material, has led to our department to the
determination that no related violation of Kodiak Island Borough' 'Code exists.
Please be advised that the Kodiak Island Borough=Severance Tax must continue to be
paid on any further commercially utilized rock or gravel removed during the
maintenance of your property. In addition, thetonly-such material that can be removed
is that which has been pushed from the surfacetf (not'excavated), or -he's -fallen from,
the upper level of your property to the improved lower leVel of your property:
If, in the future, you intend to perform`any site grading adtivities on your property, those
activities must be directed towards the further improvement of the property and not
towards the extraction of rock and gravel,'as dravelextraction is a prohibited use for
properties located within theBusne`ss-or Conservation Zoning District. Any such site
grading activities will alsoorequire that -you obtain4he.,mendatory Zoning Compliance and
Excavation Permits, and that you ensure payment'of the Severance Tax due on any
commercially utilized material removed from the property during that activity.
The Community Development Department thanks you for your cooperation during our
investigation and for your, contactors timely attention to the Severance Tax requirement.
