17.24.005 Description and intent. The I -Industrial Zoning District is established as a district '
in which the principal use of the land is for business, manufacturing, processing, fabricating,
repair, assembly, storage, wholesaling, and distributing operations, which may create some
nuisance, but which are not pope ly associated nor compatible with residential land uses. For the
industrial zone, in promoting the general purpose of this title, the specific intentions of this
chapter are:
A. To encourage the construction of and the continued use of the land for business and
industrial purposes;
B. To prohibit all nesidential uses of the land not associated with industries and any other land
use which would substantially interfere with the development, continuation or expansion of

industry in the zone;
C. To concentrate the industrial and business uses within designated areas to protect residential
districts from noxious or noisy operations; and
D. To encourage the discontinuance of existing uses that would not be permitted as new uses
under the provisions of this chapter. (Oid. 8140-0 §2(part), 1981).
17.24.010 Permitted uses. The following uses of the land are permitted in the industrial districtsr
A. All uses permitted in B -Business District, except residential;
B. Aircraft, automobile and truck assembly or remodeling;
C. Asphalt batch and mixing plant, manufacturing or refining;
D. Assembly of music and vending machines;
E. Auction business;
F. Beverage manufacturing;
G. Boat building, repair and storage;'
H. Cabinet shops;
I. Concrete mixing batch plants;
1. Coal storage yards;
K. Dwelling units for a watchman or caretaker on the premises;

L. Dyeing plants;
M. Gravel or sand extraction;
N. Junkyards, wrecking, salvage or scrap metal operations;
0. Lumber mills and sawmills;
P. Lumberyard, building material manufacture or sales;
Q. Machine or blacksmith shops;
R. Manufacturing, servicing or repair of light consumer goods, such as appliances, batteries,
furniture and garments;
S. Metal working or welding shops;
T. Motor freight terminals;
U. Outdoor storage;
V. Paint shops;
W. Public uses;
X. Rock crushers;
Y. Seafood processing establishments and their dormitories;
Z. Sewage treatment plants;
AA. Slaughterhouses;
BB. Steel fabrication shops or yards;
CC. Vehicle impound lots;
DD. Vocational or trade schools;
EE. Utility installations; and
FF. Warehousing within an enclosed structure. (Ord. 92-13 §7, 1992; Ord. 81-40-0 §2(part),
1981).
17.24.020 Conditional uses. The following uses may be permitted by obtaining a conditional
use permit in accordance with the provisions of chapter 17.67 of this title:
A. Acetylene gas manufacture or storage;
B. Ammonia, bleaching powder or chlorine manufacture;
C. Cement, concrete, lime and plaster manufacture;
D. Chemical bulk storage and sales;
E. Garbage disposal sites, dumps and sanitary landfills; and
F. Petroleum or flammable liquid production, refining or storage. (Ord. 81-40-0 §2(part),
1981).
17.24.030 Lot requirements.
A. Lot ant. The minimum lot area required is twenty thousand (20,000) square feet.
B. Lot width: The minimum lot width required is seventy-five feet (75'). (Ord. 81-40-0
§2(part), 1981:

17.24.040 Yards.
A. Front yards.
1. There shall be a front yard of not less than thirty feet (30').
2. The front yard, when facing a state highway, shall be not less than fifty feet (50').
B. Side yards.
1. There shall be a side yard on each side of a principal building of not less than twenty
feet (20'), except that approved fire wall installations between adjoining structures provides for
construction on the lot line.
C. Rear yards.
1. There shall be a rear yard of not less than twenty feet (20'), except that approved fire
wall installations between adjoining structures provides for construction on the lot line.
D. Exemptions. Waterfront industries are exempt from the requirements of this section.
(Ord. 81-40-0 §2(part), 1981).
17.24.050 Building height limit. The maximum height of a structure is unrestricted, except that
no structure shall interfere with Federal Aviation Administration regulations on airport approach;
and provided further, that within fifty feet (50') of any residential district boundary, no portion
of any structure shall exceed the height limitations of the residential district. (Ord. 81-40-0
§2(part), 1981).
17.24.060 Performance standards. All permitted and conditional uses shall comply with the
performance standards listed, where applicable, in this section.
A. Noise. The noise emanating from a premises used for industrial activities shall be muffled
so as to not become objectionable due to intermittent beat, frequency; or shrillness; and where a
use adjoins a residential district, the noise loudness measured at the boundary line shall not exceed
ninety (90) decibels.
B. Lighting. Any lighting shall not be used in a manner which produces glare on public
highways and neighboring property. Arc welding, acetylene torch cutting and similar processes
shall be performed so as not to be seen outside the property.
C. Fire and safety hazards. The storage and handling of inflammable liquids, liquefied
petroleum, gases and explosives shall comply with the fire prevention code and all other applicable,
laws and regulations. Enameling and paint spraying operations shall be permitted when incidental
to the principal use and when such operations are contained within a building of two-hour fire -
resistive construction. Bulk storage of inflammable liquids below ground shall be permitted if.the
tank is locateino closer to the property; line than the greater dimension (diameter, length or
height) of the tint
D. Odor. -Uses causing the emission of obnoxious odors of any kind and the emission of any
toxic or corrosive fumes or gases are prohibited.
E. Dust and smoke. Dust and smoke created by industrial operations shall not be exhausted
into the air in such a manner as to create a nuisance.

F. Open storage. Any storage shall not be located closer than twenty-five feet (25') to any
street right-of-way. Any storage shall be enclosed with a fence acceptable to the commission.
Whenever lumber, coal or other combustible material is stored, a roadway shall be provided,
graded and maintained from the street to the rear of the property to permit free access for Fre
trucks at any time.
G. Screening. Where an industrial use is adjacent to and within one hundred feet (100') of
a residential use or zone, that industry shall provide screening as approved by the commission.

COMMITTEE REPORTS
Assemblymember Milligan attended the Mental Health
Center Advisory Board meeting where several issues
were discussed including acquiring a psychiatrist for
Kodiak. He felt the Board was motivated.
Assemblymember Austerman explained that he would
attend his first Hospital Advisory Board meeting due
to the fact that one meeting was cancelled and he was
out of town for the subsequent meeting. He attended
Borough/employee union negotiation meetings and was
impressed with the caliber of people attending. He
was pleased to be a part of the negotiations and
hoped for resolution of the issues in a timely
manner.
Assemblymember Burt stated the Planning and Zoning
Commission had several issues upcoming and there was
a need to appoint additional Commissioners because of
the lack of A quorum at the last meeting.

Assemblymember Austerman, for the benefit of the
listening audience, explained that the property was
adjacent to the municipal airport. He understood
that the City of Kodiak intended to build a public
safety facility that combined city police, state
troopers and jail.
At questions raised by Assemblymember Burt, Mayor
Selby replied that rezoning the property did not
affect the operation of the airport and that, in
fact, it was actually a down zone that reduced
potential conflicts between industrial use and future
airport use.
At Assemblymember Burt's additional question, Mayor
Selby stated the property would act as a buffer zone.
Presiding Officer McFarland recalled a meeting two
years ago with the Planning and Zoning Commission and
City representative where zoning of neighboring
property was discussed.

the final bonds sale.

Mayor Selby explained that Borough code required that
the clerk attest mayor and finance director
signatures. He noted that, because Clerk Smith was

Mayor Selby stated the city -owned property was
adjacent to the municipal airport. He deferred to
Linda Freed, Community Development Department
Director, for a staff report. Director Freed
explained the city requested the, rezone because
industrial zoning did not allow any type of
residential use. Because the city planned to build a
public safety facility that combined city police,
city troopers and jail facility, rezoning of the
property to light industrial was necessary. She said
the Planning and Zoning Commission granted a required
conditional use permit for the light industrial
zoning district contingent on approval of the rezone
and Commission review of the site plan.
At questions raised by Assemblymember Burt, Director
Freed replied that rezoning the adjacent property did
not affect the operation of the airport and that, in
fact, the airport was zoned light industrial.
In response to Assemblymember Milligan's query,
Director Freed confirmed that the rezone was
specifically needed because prisoners would reside in
the jail.
Director Freed responded to Assemblymember
Austerman's question in that the city requested
rezone of the entire property because the lot to be
developed was not specifically identified. She noted
that light industrial zoning was consistent with the
Lakeside/Safeway Sub -area Land Use Plan.

Dear Mr. Bloomquist:
The Kodiak Island Borough Planning and Zoning Commission at their
meeting on December 15, 1993, moved to forward the request cited above,
recommending approval, to the Borough Assembly.
This item will likely appear for first reading at the Assembly's January 6,
1994 regular meeting and if approved, will likely appear for second reading
and a public hearing at the Assembly's January 20, 1994 regular
meeting. Please confirm these dates with the Borough Clerk, Donna Smith,
at 486-9310, no sooner than five (5) working days from the date of this letter.
Section 17.72.055 (Submission to assembly) of the Borough Code states:
A. Within thirty days after the planning commission has acted favorably
upon a proposed zoning change in accordance with the above
provisions, a report with recommendations shall be submitted to the
assembly together with the proposed ordinance. Such
recommendations of the planning commission shall be advisory only
and shall not be binding upon the assembly. When an ordinance has
been forwarded to the borough assembly, the assembly shall act in
accordance with this chapter and notice shall be issued as provided in
Section 17.72.070, by the borough clerk.

LI --Light Industrial zoning district evolved directly from
the efforts of the Commission to develop a new 'General
Business' zone to implement the plan designation. As a
result, this zoning change is consistent with the
objectives of the plan.

17.72.030 Manner of initiation. Changes in this title may be initiated in the
following manner:
A. The borough assembly upon its own motion;
B. The planning commission upon its own motion;
C. By petition of one or more owners of property within an area proposed
to be rezoned. A petition shall be in the form of an application for a
change in the boundary of a district, shall be filed in the community
development office, be accompanied by the required fee and such data
and information as may be; necessary to assure the fullest practicable
presentation of facts and shall set forth reasons and justification for
proposing such change.
17.72.055 Submission to assembly.
A. Within thirty days after the planning commission has acted favorably
upon a proposed zoning change in accordance with the above provisions, a
report with recommendations shall be submitted to the assembly together
with the proposed ordinance. Such recommendations of the planning
commission shall be advisory only and shall not be binding upon the
assembly. When an ordinance has been forwarded to the borough assembly,
the assembly shall act in accordance with this chapter and notice shall be
issued as provided in Section 17.72.070, by the borough clerk.
COASTAL MANAGEMENT APPLICABLE POLICIES
Industrial Development.
1. Optimal Location
In order to satisfy industrial requirements, meet safety standards,
protect fish and wildlife resources, and maintain environmental
quality; sites for industrial development shall be identified in
conjunction with the Kodiak Island Borough.
Consistent: Yes. The Kodiak Island Borough has identified this
area as General Business in the 1991 Lakeside
Subdivision/Safeway Subarea Plan. Commission

development of a "General Business" zone, evolved
into the existing LI --Light Industrial zoning district.
The LI --Light Industrial zoning district was always
intended to fulfill the role of implementing the
General Business designation of the subarea plan.
2. Natural Features
Dredge and fill, excavation, shoreline alteration and disturbance of
anadromous streams, tideflats and wetlands shall be minimized
when constructing and operating port, harbor, dock, business and
energy facilities - if permitted under applicable regulations.
Consistent: Not applicable. This action does not involve
excavation or alteration of the shoreline, disturbance
of anadromous streams, tideflats or wetlands.
Natural Setting. Views and Access
Development shall be conducted in a manner that mitigates adverse
impacts upon the Kodiak Archipelago; developers shall provide
opportunities for public access to the shoreline and scenic views, to
the extent feasible and prudent.
Consistent: Not applicable. This land is not located along the
shoreline.
4. Dredge and Excavation Material
Dredging and filling shall be consistent with ACMP Standards 6 AAC
80.040 (Coastal Development) and 6 AAC 80.110 (Mineral and Mining
Processing). Dredge spoil may be utilized in shoreside landfills if
permitted under applicable regulations for the purpose of creating
usable waterfront land.
Consistent: Not applicable. This action does not involve any
dredging or filling along the shoreline.

Developments in or over the water, such as piers, docks and
protective structures shall be located, designed and maintained in a
manner that prevents adverse impacts upon water quality, fish,
wildlife and vegetative resources and minimizes interruption of water
circulation patterns, coastal processes and navigation.
Consistent: Not applicable. This action does not involve
development in or over the water.
6. Buffer Zon s
Buffer zones shall be established to the extent feasible and prudent,
between business areas and major public transportation routes and
between business development and adjacent, non -business properties
in order to minimize conflicts between land uses.
Consistent: Not applicable. This site is located in a long
established industrial area.
7. Accessory Development
Accessory development that does not require a shoreline location in
order to carry out its support functions shall be sited away from the
shoreline whenever there is a feasible and prudent inland alternative.
This category includes parldng, warehousing, open air storage, waste
storage, treatment or storfn runoff control facilities or utilities.
Consistent: Not applicable. This request does not involve
accessory development.
8. Wetlands
Filling and drainage of water bodies, floodways, backshores or
natural wetlands shall be consistent with ACMP Standards 6 AAC
80.070 (Energy Facilities) and 6 AAC 80.130 (Habitats).

draining of water bodies, floodways, backshores or
natural wetlands.

COMMENTS
The purpose of this request is to. investigate the possible rezone of six lots
contiguous with the Kodiak Municipal Airport from I --Industrial to LI --Light
Industrial. These lots are located along Selief Lane and are owned by the City
of Kodiak.
A related Exception was granted by the Commission on December 19, 1991,
to permit a 30 bed, 15 cell jail and police station complex. This Exception
expired on November 5, 1992, when the Assembly deleted the Exception
procedure from Title 17 (Zoning) of the Borough Code. Due to the fact that no
permits were issued or construction begun prior to the expiration of the
exception, no vested rights were established by the City of Kodiak to give this
project nonconforming status.
This rezone is intended to put the appropriate zoning in place to pennit a jail
facility as an institutional use. Institutional uses are a conditional use in the
LI --Light Industrial zoning district. A CUP will also be reviewed by the
Commission in related case 93-072.
Issues to be considered in evaluating this rezone request include conformance
with the comprehensive plan, • land suitability, recent development trends in
the area, and traffic impacts including adequate access and offstreet parking.
CONFORMANCE WITH THE COMPREHENSIVE PLAN:
The proposed LI --Light Industrial zoning district is consistent with the
designation of General Business contained in the 1991 Lakeside
Subdivision/Safeway Subarea Plan. During the development of a "General
Business" zone to implement the plan designation, the name of the zone
evolved to Light Industrial. The LI --Light Industrial was fully intended by the
Commission to fulfill the intent of the General Business designation.
ZONING/USE:
The site is primarily vacant with the exception of Lot 2 which is used for
impound vehicle storage. A rezone to LI --Light Industrial zoning will not
create any nonconforming uses.

Implementation of the LI --Light Industrial zoning district will eliminate the
present setback requirements of the existing I --Industrial zoning district. This
will permit more flexibility in the siting of new facilities on the site.
LAND SUITABILITY:
The site has moderate elevation changes across the length of all six lots. The
individual lots are all reasonably developable for industrial or light industrial
purposes. The combined area of all lots is adequate to sustain a large
development, including required off-street parking, regardless of the ultimate
use or uses established at this location.
RECENT DEVELOPMENT TRENDS IN THE AREA:
The adjoining Kodiak Municipal Airport was rezoned from I --Industrial to LI --
Light Industrial by Ordinance 92-18. Lots 4 - 9 and 11, Block 3, Lakeside
Subdivision were rezoned from I --Industrial to LI --Light Industrial and Lot 10,
Block 3, was rezoned from PL --Public Use Land to NU --Natural Use Land by
Ordinance 92-14.
TRAFFIC IMPACTS:
Potential traffic impact to the surrounding area will be minimal given the
similar types of uses permitted in both the I --Industrial and LI --Light
Industrial zoning districts. Given the area and width of the lots requested for
rezone, all the lots are adequate for off-street parking development whether
singly or in combination. There 'should be no problem siting adequate off-
street parking for any uses established on this site.
