The single family residence known as North Garden at 545 Selief Court, owned by the Holy Spirit Association, is located on Lot 15, Block 2 of the Lakeside Subdivision zoned R1. North Garden was constructed as a summer home for Reverend and Mrs Sun Myung Moon and their family to stay in when they visit Kodiak. Reverend and Mrs Moon have 12 married children and 37 grandchildren. They all love to visit Kodiak in the summer to fish and hunt and enjoy Kodiaks' pristine outdoor environment. Members of the family have visited Kodiak and stayed at North Garden every summer since it was completed in 1990. They usually only stay at North Garden for 2 to 3 weeks of each year in the summer depending upon their schedules, the rest of the year the building is held vacant. As the families have expanded and the parents have needed a little more privacy the need for more space and rooms has grown. North Garden needs to be upgraded in order to accommodate Reverend Moons large family and many summer guests. For this reason we seek to; 1. to provide a more spacious and gracious standard of accommodation for the owners on the second floor. 2. replace the tiny east facing open balcony with an enclosed sun room 3. separate the owners' apartment from the rest of the house by providing a new alternate "front entrance" whereby guests can access the amenities of the house while preserving a degree of privacy of the owners living space. 4. From the space created on the first floor we will expand some and add three more bed rooms for the family. 5. The existing wet room will be extended under the kitchen and dining room extension. 6. Recently, concerns have been expressed and a complaint received alleging that the two structures on the properties are utilized, periodically, as "bunkhouses" or "boardinghouses". Both of these properties are zoned R1 -Single-family residential. Bunkhouse use in the R-1 Single-family residential zoning district, even on a temporary basis, is a violation of Kodiak Island Borough Code Sections 17.18.010 and .020 addressing the description and intent and permitted uses in the R1 -Single-family residential zoning district. Enclosed is a copy of an administrative interpretation addressing how many persons may .live in a residence. According to Kodiak Island Borough Code Section 17.06.220, a dwelling unit can be occupied by a "family" (any number related by blood or marriage) or by a "single housekeeping unit" (maximum of five unrelated individuals, two of whom may be lodged as renters or boarders). Therefore, any time there are more than five unrelated individuals living, however temporarily, in the single-family dwelling on Lot 15, that property is in violation of the borough zoning code. The church facility on Lot 11A was constructed as a permitted use, and the adjoining day care/school permitted as a conditional use. However, neither of these uses permit any occupancy of the structure, even temporarily on a nightly basis. The program will meet each Tuesday from 5 to 7 p.m. for approximately the next 12 weeks at the Kodiak Island Sportsmen's Association indoor range behind the VFW. The program is designed for boys and girls, 9 to 19 years of age. The program is built around two goals: 1. Participants will complete the Alaska Hunter ,4-:..,, .-...,.....,.., marksmanship, archery, muzzle Ioading, " and shotgunning. Emphasis will be placed upon rifle marksman, ship. This issue has arisen from citizen inquiries. Specifically, the revised construction drawings submitted to the Borough Building Official which were forwarded to this office, show 9 bathrooms, several of which are designated "mens" and "womens" restrooms and contain multiple toilet and shower facilities. These bathrooms meet the 1982 U.B.C. requirements for a hotel and are not the type of bathroom normally found in a typical single family residence. Additionally, the laundry and kitchen facilities are quite different from a typical single family residence. Similar comments can be made about 7 additional rooms (a 615 square foot play room, a 236 square foot billiard room, a 283 square foot den, a 320 square foot library, and 3 studies totalling 472 square feet). When you also consider that the structure contains 6 bedrooms totalling over 1,600 square feet and nearly 1,300 square feet of living/dining area, it is easy to infer that the intended use of this structure goes beyond a single family residence. Pursuant to Sections 17.06.220 and 17.06.230 (attached) of the Borough Code, a single family residence is defined as a dwelling unit designed for occupancy by only one family, with a family, in part, defined as not more than 5 individuals unrelated by blood or marriage. March 27, 1987 Page 2 Based on the above noted plans, this department is concerned that the structure appears to be designed for and will be perceived by the public for use as a bunkhouse, boarding house or other similar use that will house more than the number of unrelated individuals permitted in a single family residence. These other types of uses are not permitted in the R1 -Single Family Zoning District. International Seafoods of Alaska, Inc. was issued zoning compliance #B-95 on January 23, 1987 for a single family residence. By receiving zoning compliance, Internation Seafoods of Alaska, Inc. certified that they will comply with all provisions of the Kodiak Island Borough Code (KIBC). Therefore, this department is requesting (pursuant to KIBC Chapter 17.75) that International Seafoods of Alaska, Inc. provide written documentation as to the intended use of the structure within 15 days of receipt of this letter. We believe that your documentation and "certification" of the use of the building prior to its occupancy will reduce potential enforcement problems for both you and us in the future.
