Number of Persons Living in a Dwelling Unit This letter is written to you as owners of the property referenced above to clarify issues that have arisen about occupancy of the structures located on these properties. Recently, concerns have been expressed and a complaint received alleging that the two structures on the properties are utilized, periodically, as "bunkhouses" or "boardinghouses". Both of these properties are zoned R1 -Single-family residential. Bunkhouse use in the R-1 Single-family residential zoning district, even on a temporary basis, is a violation of Kodiak Island Borough Code Sections 17.18.010 and .020 addressing the description and intent and permitted uses in the R1 -Single-family residential zoning district. Enclosed is a copy of an administrative interpretation addressing how many persons may live in a residence. According to Kodiak Island Borough Code Section 17.06.220, a dwelling unit can be occupied by a "family" (any number related by blood or marriage) or by a "single housekeeping unit" (maximum of five unrelated individuals, two of whom may be lodged as renters or boarders). Therefore, any time there are more than five unrelated individuals living, however temporarily, in the single-family dwelling on Lot 15, that property is in violation of the borough zoning code. The church facility on Lot 11A was constructed as a permitted use, and the adjoining day care/school permitted as a conditional use. However, neither of these uses permit any occupancy of the structure, even temporarily on a nightly basis. The inspection revealed a single family residence being used in accordance with Kodiak Island Borough Code Title 17 Zoning. Therefore, the complaint is determined to be invalid. Lot 15 is being used for parking which is not a permitted use. Martin Burn of your staff informed me that it is your intention to vacate and replat Lots 15 and 16 into a single lot in order to correct this zoning violation. Please initiate this replat through the Borough's Engineering Department within the next month. Your cooperation is very much appreciated. Martin Burn, an International Seafoods of Alaska, Inc., (ISA) employee and project manager for the construction of the structure, was present during this inspection. Mr. Burn took me completely through the building. The structure is a single family residence (SFR) as defined by code, one kitchen. My inspection confirms that the structure is being used as an SFR. This is the home of the President of ISA, Mr. Chay, and from all appearances is being used as such. It is obvious that Mr. Chay entertains in a grand style, based on the furnishing and size of the rooms. Nothing in the house Indicated a bunkhouse use. There are two guest rooms with two beds each. Therefore, it is my determination that this complaint is invalid. Lot 15 Is being used for parking. Recently this office has received several complaints regarding the use of the structure, the cul-de-sac, and the adjacent lot. Specifically, we have received the following complaints: 1. The SFR is being used to house large numbers of people. A bunkhouse use. 2. Citizens are being told that the cul-de-sac is a private road and not to drive on it. The cul-de-sac is a public right-of-way. 3. The adjacent lot, Lot 15, is being used for outdoor storage and parking. Outdoor storage is not allowed in a R-1 zoning district and parking is not allowed without a main dwelling. This office must investigate all complaints, and in accordance with Kodiak Island Borough Code (KIBC) Section 17.75.020, the zoning officer may make inspections necessary to enforce the provisions of KIBC Title 17.
