Dear Mr. & Mrs. Hansen: The Kodiak Island Borough Planning and Zoning Commission at their meeting July 21, 1993, approved the waiver request sited above. This letter shall constitute the waiver. This fulfills condition of approval #1 stated in your letter of preliminary approval dated July 1, 1993, for subdivision case S93-017. Please refer to that letter to complete the platting process. The Commission adopted the following findings in support of their decision: 1. A type I flag stem with a thirty (30) foot width would not provide practical vehicle access to Lot 6B. 2. A thirty (30) foot flag stem will reduce the improvement created on this plat by making Lot 6A or 6C nonconforming. 3. Consolidation of five (5) lots into the four (4) lots proposed is an improvement to the land pattern in the area. 4. The land pattern resulting from this replat is consistent with the characteristics of the surrounding area. Steven Hansen REQUEST: LOCATION: ZONING: A waiver from requirements according to Section -16.110.010 of the Borough Code, to allow a flag stem access in a proposed subdivision to be less than the required 30 feet in width, on proposed Lot 6B, Block 14, Kodiak Townsite. 210 - 216 Hillcrest Drive R1 --Single-family Residential BACKGROUND The purpose of this request is to review the flag stem access, noted above, to determine whether a waiver of the strict interpretation of Title 16 is justified. The action is the result of a vacation and replat which reduces the number of lots in a pre-existing subdivision from two (2) conforming lots and three (3) nonconforming lots to four (4) conforming lots. The 18 foot flag stem will provide legal access to Lot 6B, but will not provide practical vehicular access or the required 30 foot width according to Section 16.40.050.B.3.a.i of the Borough Code. The flag stern will provide an alternative route for the stairway access presently located across proposed Lot 6C. The flag stem may also provide for two (2) off-street parking spaces if adequate area is cleared and leveled near the road right-of-way. The flag stem is wide enough to accommodate the future routing of water and sewer utilities to serve Lot 6B so that the service lines need not encumber the lot below it with unnecessary utility easements. APPROPRIATE MOTION Should the Commission agree with the staff recommendation, the appropriate motion is: Move to approve a waiver from requirements according to Section 16.110.010 of the Borough Code, to allow a flag stem access in a proposed subdivision to be less than the required 30 feet in width, on proposed Lot 6B, Block 14, Kodiak Townsite, and to adopt the findings contained in the staff report dated June 22, 1993 as "Findings of Fact" for this case. Preliminary approval of the vacation of Lots 6-10, Block 14, Kodiak Townsite, creating Lots 6A, 6B, 6C, & 6D, Block 14, Kodiak Townsite. Dear Mr. Hansen: The preliminary plat submitted for your abbreviated subdivision, referenced above, has been reviewed and is hereby granted preliminary approval subject to the requirements of Chapter 16.50 (Final Plat) of the Borough Code, in addition to the following condition: 1. Preliminary approval is subject to Planning and Zoning Commission approval of a waiver of the 18 foot flag stem width, which is required to be at least 30 feet wide, per KIBC 16.40.050.B.3.a.i. Once this condition has been met, please instruct your surveyor to complete the final plat and submit it to this office for final review. We suggest the use of a final "check plat" for this purpose. Once the check plat has been reviewed and approved it is your responsibility to obtain all the signatures required on the plat prior to submitting to the Kodiak Island Borough for recording. A current certificate to plat from a licensed title company should accompany the final plat. For your information, State of Alaska regulations require that all subdivisions be approved by the Alaska Department of Environmental Conservation (ADEC). It is your responsibility to obtain approval from ADEC, which may be contingent upon certification by the City of Kodiak that adequate capacity for wastewater treatment exists at the City operated wastewater treatment facility. This certification goes beyond the scope of the preliminary subdivision approval granted by the Community Development Department, therefore, inability to obtain this certification may result in delays, beyond the control of the Kodiak Island Borough, in the final subdivision process. The approval of this preliminary plat shall be effective for twenty-four (24) months from the date of approval. After this time, the preliminary Kodit :island Bor©ugh J. Steven Hansen July 1, 1993 Page Two plat shall become null and void unless an extension of time is granted by the Planning and Zoning Commission prior to the expiration of the preliminary plat. Approval of this plat by the Kodiak Island Borough Community Development Department does not necessarily mean that development of the property complies with State and federal regulations, which may also be applicable. An appeal of this decision may be initiated by any person or party aggrieved by filing a written notice of appeal with the .Community Development Department within ten (10) days of the date of the decision. The notice of appeal must state the specific grounds for the appeal and the relief sought by the appellant and be accompanied by the appropriate fee. Upon commencement of an appeal, the decision appealed is stayed until the decision on the appeal becomes final. The Community Development Department has developed the following findings of fact in support of this decision: 1. This plat meets the minimum standards of survey accuracy and proper preparation of plats required in Title 16 of the Borough Code; 2. ' This plat meets all the requirements of Title 17 of the Borough Code; and 3. This plat is generally consistent with adopted Borough plans and provides a subdivision of land that is supports those plans.
