A variance was granted by the Kodiak Island Borough Planning and Zoning Commission on June 26, 1978 (Case Z-78-056) authorizing construction of the dwelling on this property to encroach approximately 17 feet into the standard 25 foot front yard setback. Parking decks are permitted to encroach into rights -of -ways. The encroachment of the other deck itself into the right-of-way, which appears on a 1979 as -built survey, would have been legitimized as a nonconforming structure by the general 1980 "grandfathering" ordinance. Both are therefore legal as regards zoning, but are subject to authorization from the City of Kodiak, as owner, to remain located in the right-of-way.
