that it is too steep to be used.as a.business area. Mr. Hansen and Mrs.
Hajdu felt that it could be used for apartments.
After considerably more discussion and map study, it was agreed that another
attemtp should be made to rezone a smaller portion of the aeaa which was
originally proposed., Mt. Barr commented that if the area develops rapidly, •
then it can be expanded further. The Zoning Commission will further define
the boundaries of the area at their next meeting.
. Exception to Parking Requirements Granted to Ron Ball for Bunkhouse,
Restaurant and Bar - TOWnSitelBik-lb_Lota9ACase-1557B0-. Mr. Hansen explained
that there was no provision in the ordinance for parking requirements for a
bunkhouse or dormitory --therefore the requirements for a hotel are used.
However, the people using these facilities are cannery workers and very seldom
own cars. Since the requirements were being met for the restaurant and bar,
with some spaces left over for the bunkhouse as well, the Commission had
granted the exception. It was not the intent of the Commission to include
Mr. Ball's Hertz car rental business in the exception. The Commission
agrees that there is a parking problem in the area, but does not feel that
Mr. Ball's establishment will add to it. If Mr. Ball eventually finds that
'he does not have sufficient parking space, he will have to purchase.more
land to provide it.
It was agreed that the biggest parking problem in the area is that of the
fishermen's cars, and also the•dannery 0001bYdeskOolution must be found
for these problems, but individuals Opening establishMentS in the area should
not be required to provide parking for these other Cats. Mr. Lester pointed
out that the Kodiak Inn had not anticipated parking problems, which it now
has, and felt that Mr. Ball might also have a problem later on. However, he
did not wish to hold up Mr. Ball's COnstruction. The other Assemblymen
concurred, and4In.711irrtated-that:hewould:Withdraw-his_appearto_the
(decision-on:the exception. Mr. HanSen suggested that the ordinance be
amended to include different parking requirements for rooming houses.
C. Resignation of Mr. Breckberg from Zoning Commission. Mr. Hansen presented
Mr. Breckberg's resignation which was read by Mr. White. Mr. Hansen requested
that an appointment be made to fill the vacancy. Mr. White asked for
suggestions and Herb Richmon's name was mentioned. Mr. White inquired if
the group was sufficiently large, and Mr. Hansen replied that he thought it
should be larger, and that he would appreciate the participation of the
Comprehensive Planning Commission,
D. Comprehensive Plan and Expert Planner. It was agreed that the Borough should
have an expert long-range planner, but that it must be someone who will
remain on the staff to put the plan into effect. Mr. Sutliff stated that the
planners who worked on the 1980 Plan were experienced and had good ideas, but
left when they had drawn up the plan. Mrs. Hajdu felt that even a specialist
would still have to depend on the local people for recommendations. Mr.
White stated that the Federal Government will not give Kodiak any grants for
water or sewer work until a new Comprehensive Plan has been established, but
that neither will they provide a grant to accomplish a new Plan. For this
reason, other means are being sought to accomplish a Plan, such as through
a private planning firm. It may be more expensive, but it does not, look as
if funds are going to come through from ASHA, and even if they did, it would
probably be 1970 before the Plan were completed.
-E. Future Joint Meetings. It was agreed that future joint meetings would be
worthwhile. The Zoning Commission was invited to attend a meeting with the
Assembly and representatives from the Division of Lands to discuss various
problems in Bells Flats on Wednesday, May 3, at 9:00 a.m.

Please accept this letter as a request to appeal the decision

I do not .feel that this exception is justified since there is
already a serious parking problem in this area caused by lack
of parking for the canneries and fisherman, and a relaxation
of the requirements in this case would add Ito this problem.

resulting surplus will remain in the general fund. Motion carried by
unanimous roll call vote.
B. Menlo from P&Z re Expansion, of Business District. The memo was read, requesting
that the Assembly take a second look at the proposed rezoning. Mr. Barr
suggested a joint meeting with.. the Zoning Commission to:discuss the matter.
Mr. Sutliff felt that areas should be zoned however the people living in them
wanted them zoned. Mr. White'did not feel that this would be a solution,
since it is the Borough's,resporsiblity to create a balanced zoning for the
entire community, and probably no individuals would ask for their property
to be zoned business. Mr.. Sutliff,a.lso objected to people who have been here
only a few years attempting to. rezone the; town for people who have lived here
all their lives. After. further discussion,'it was agreed to hold a joint
meeting on Monday, April' 24.
C. Letter from F. J. Keenan re Conditions of Land Sale. The letter was read
asking whether the Borough wished the land sale contracts to be held open
until after the requiredimprovements had been made, or if the restrictions
should be incorporated into the deeds, which would require enforcement after
the fact. It was agreed that the best approach would be to hold the deed
transfer up until the improvements had been made. A question was then raised
as to how an individual could finance construction of a house without having
title to the property. Mr. Ruskin suggested that the deed be placed in
escrow. He stated that no loan would be made if the individual intended to
take ten years to p,y for the land, so that the land would have to be paid
for at the same time the house is constructed. Under these circumstances, he
felt that the bank might provide a loan if the deed were placed in escrow.
It was pointed out that even if .the deed were issued, a loan could not be
obtained if the deed had restrictions in it. Mr. Stansbury commented that
at present the banks are not lending money to construct homes except on
lots inside the City that have :.eewer and water. .It was agreed that Mr. White
should discuss with the banks and with the State the possibility of holding
the deed transfer up and placing the deeds in escrow until the improvements
are completed.
D. Sanitariah'S Report. The -report was perusedty'the Assembly members.

A. Exception to Parking Requirements Granted by the Zoning Commission to Ron
Ball for his Proposed Hotr1,. Townsite Bik 18 Lot 19 (Case 155-B). Mr. Barr
felt that this exception should not have been granted, since there is already
a serious parking problem in this area. Mr. Barr said that he would formally
appeal the decision, and that it could be discussed at the meeting on April
24. Mrs. Haj du suggested that forcing compliance with the parking require-
ments (Dor the canneries also be discussed. The Assembly concurred. A
question was also raised as to which body was the correct one to sit as the
Board of Adjustment to hear the appeal.
OLD BUSINESS
A. Vacation of Taxes on Boat Owned by George Naumoff of Port Lions. Memo from
Assessor was read explaining that this boat was totally destroyed by fire in
1966, and since Mr. Naumoff was disabled by the accident, it was
recommended that these taxes be forgiven. After a brief discussion, Mr.
Sutliff moved, seconded by Mr. Barr, that these taxes be forgiven. Motion
carried by unanimous roll call vote.

X CHAIRMAN'S REPORT
A. Community College for Kodiak. Mr. White reported that the Chamber of
Commerce had asked the Borough to adopt a resolution urging the establish-
ment of a community college under the sponsorship of the University of
Alaska. Mr. Norton spoke in favor of the idea, stating that over 50% of
Kodiak's high school graduates go to college, and that they, as well as
the teachers in town, could use the facilities. After further discussion,
Mr. Barr moved, seconded by Mr. Sutliff, that the Assembly go on record as
favoring continuation of efforts to establish a community college in Kodiak.
Motion carried by unanimous voice vote.

VI PUBLIC HEARINGS
A. Request`ror.Exception to Construct Radio Transmitter and Antenna System in
Unclassified and Conservation. Zones - USS 1682, 10 acres in Southeast Corner -
MidnightSian.Broadcasters (Case 173-A). The meeting was recessed and public
hearing opened. The Midnight Sun representative explained that they had
submitted an application to FAA for approval for a 300 foot high tower. At
the end of 30 days, if no complaints are heard by FAA, approval will be
granted. Mr. Cornelius spoke in favor of the exception. He felt that a radio
station would be of great benefit to the community, especially if owned by
a reliable concern such as this group. He stated that attempts have been
made for 12 years to establish a radio station in Kodiak. There were no
further comments, and the hearing was closed and meeting reconvened. Mr.
Walser moved, seconded by Mr. Williams, that the exception be approved subject
to approval of the tower by FAA. Motion carried by unanimous voice vote.
VII ZONING ITEMS - PRELIMINARY REVIEW
A. Request for Exception to Build, Store and Sell Crab Pots in Unclassified
Zone - USS 3100 Lot 6B - Ted Olafson (Case 174-A). Application letter was
read. Mr. Olafson stated that the building he wished to use is located 30
to 40 feet back from the road, and that he could store the pots on the rear
of the lot. After further discussion, it was decided that a public hearing
should be held on this request. Mr. Waller moved, seconded by Mr. Welch,
that a public hearing be held on this request at the next meeting. Motion
carried by unanimous voice vote.
B. Request for Exception to Parking Requirements for Hotel, Restaurant and Bar -
Townsite Blk 1: Lot 19 - Roliyn Ball Case 155-B . Application letter was
read. There was a discussion on the parking requirements of the ordinance,
and it was determined that Mr. Ball's plans would require 55 parking spaces,
and that he could supply only 23, 15 of which were required for the bar and
restaurant. However, Mr. Ball stated that the hotel was intended entirely
for_cannery -workers, and that only a very few of them had cars. Mr. Waller
stated that he was in favor of the exception in this case, but that if one
exception were granted, everyone else would ask for one. Be suggested that
perhaps the ordinance requirements should be changed. Mr. Hansen stated
that he felt in this case there won't be more parking needed than will be
provided. After further discussion, Mr. Waller made a motion, seconded by
Mr. Welch, that the exception be granted. Motion carried by unanimous voic
vote.

require one space for each 5 seats or stools. Since seating is
not shown on plans we are unable to tell total required for your
building. •
