The reality of its non-use does not win any favor by any of the involved parties I hope you can resolve this for us without consuming any further time or expense. As the City Council is currently reviewing the parking in this area, I would hope my efforts to sow seeds of change to enhance growth, not inhibit, would be considered. A consideration for parking demand, within 600 feet of the Urban Renewal area, would be relevant to code and rational to the original intent for downtown. He was frustrated with the parking requirements in Kodiak and felt that Borough Code was not sensitive to "old downtown." He encouraged the Commission to revise the parking code to make it more reasonable for downtown businesses. Public Hearing Closed. Regular Session Opened. COMMISSIONER BELL agreed with Mr. Myers' comments. She felt requiring him to comply with code requirements in his situation was ridiculous. All parking spaces required under Section 17.57.040 shall be on the same lot as, or any contiguous lot in common ownership as the principal building or use that they serve; provided, that if the planning commission finds that it is impractical to locate the spaces on such a lot, it may permit them to be located on any lot within six hundred feet of the principal building or use. The lot must be in common ownership or a long term easement, license, or permit for use of the altemative parking location shall be secured. All parking spaces required under Section 17.57.040 shall be Located in a use district permitting the use which they serve. COMMENTS The property owner is proposing to add a second apartment on the second floor in the commercial building, recently renovated into an optometric clinic/optical dispenser, located on Lot 1, Block 19, Kodiak Townsite. As a dwelling unit, an apartment requires three (3) off-street parking spaces. Cane 98-008 Page I of 3 P&Z: March 18, 1998 Public nearing Item VI -C A variance was granted by the Commission last October (Case 97-016) to allow the clinic and dispensary and a single apartment, requiring all together twelve (12) parking spaces, to operate in an existing structure with nine (9) grandfathered parking spaces. At that time, the Commission declined to apply the variance to a second apartment unit due to the perception that, historically, this commercial building on an extremely small lot fronting on a busy arterial had a chronic parking problem. In essence, the message to the property owner was that, in order to have the second apartment, three parking spaces would have to somehow be provided as required by code. The property owner has accepted that decision, and, consistent with the direction given, returned now with a proposal to locate the three required parking spaces on a similarly zoned lot within six hundred (600) feet by arrangement of long-term lease, license, or permit as allowed for in KIBC 17.57.050. According to the accompanying site plan and lease agreement submitted, the three parking spaces are located in Lot 1, Block 17, Kodiak Townsite. This lot is vacant and used for employee parking for the Alaska Commercial Store across the street. It would be understood that the lease would preclude use of the designated three spaces by any vehicle not related to the occupancy of the apartment. It would not be difficult for the Commission to find that it is impractical to locate the three required spaces on the same lot as the clinic/dispensary since the building footprint itself occupies approximately sixty percent (60%) of the lot. All requirements of KIBC 17.57.050 are satisfied with the possible exception of defining with some exactness what "long term" means at it applies to a lease. The terms specified in the lease agreement dated February, 1998 between the applicant and Alaska Commercial are one year with an option to renew for five (5) years. The Commission must determine whether this is sufficient to meet the requirement for a "long term" easement, license or permit. The shortest period of time previously approved by the Commission as satisfying the requirement to be "long term" was two years in Case 93-013. In addition, Alaska Commercial is not listed as the owner of record of Lot 1, Block 17, Kodiak Townsite. Staff recommends that the lease would have to be signed by the current property owner, or documentation provided indicating that the Alaska Commercial Branch Manager is authorized, by some legal arrangement with the property owner, to lease or sublease a portion of the property. Consistent with previous parking determinations of this nature, the Commission should also specify that appropriate signage be required to insure that both the business and the parking area are clearly designated as to their relative locations and purpose. RECOMMENDATION Staff recommends that the Commission find that the three (3) parking spaces required for a second apartment unit in the building located on Lot 1, Block 19, Kodiak Townsite can be located on Lot 1, Block 17, Kodiak Townsite, within 600 feet, according to KIBC 17.57.050. When Kodiak's downtown was laid out the streets were few and the lots no bigger than needed, never knowing the problems that could arise 50 years later. After the earth quake, the mall's urban renewal area was drawn out and the best layout for commerce and parking was conceived. Since then, waivers and variances have allowed businesses contiguous to this area to stay in the commerce center of the city. Such is the Mirror Building, now the Vision Clinic. For 17 years, some 21 employers and 50 runners used this building without a problem. As I have added a one bedroom apartment to the existing one bedroom apartment -and removed a 10 -desk office area, the demand for parking bas decreased many fold. 1 was required though, to find three parking spots to compensate for this change within 600 feet. The only available space friendly to the idea was the leased property of A.C.'s Personnel Parking font Mrs, Kim. A gracious gesture was made by the management to the extent of his agreement and concurred by the deed owners, The term "long term" is made in sand as all the property in this area would be sold in a heartbeat for the right price. Two Points: First, within 200 feet exists the access to several hundred parking spots. It is not fair, as tax base is the same on both sides of the street, that one has 100% parking, benefit of the urban renewal, and the other does not have any. For the new apartment above the Village Bar. parking was a given, Perhaps a gradient consideration for access to the downtown parking could be given out to 600 ft. This might be more fair. Second, I appreciate the insight made on my existing grandfather rights, but it seemed proper I should invest in a long term lease because of a comparative to Shelikofs Cannery Row, requiring additional parking. Seven hundred workers and thirty plus administrators in an alley way is hardly the same as our demand. We even have room to park on the street. The one raising the issue had three units on Rezanof with much less parking than we have, So, we have tried to comply for what is ideal, and there are sincere efforts being made to upgrade parking and have a beautification sweep in the West Rezanof sector, This might be more Important than ever with the convenience of large business access and parting gi uwing in the Safeway area. Our difficulty is again the older lets were not designed for the new millenium. Our blessing is we are a small town and its aur "working with what we have" that makes what we are. All parking spaces regmred under section 17.57.040 of this chapter shall be on the same lot as, or any contiguous lot in common ownership as the principal building or use that they serve; provided, that if the commission finds that it is impractical to locate the spaces on such a lot, it may permit them to be located on any lot within F� six hundred feet (600') of the principal building or use. The lot must be in common ownership or a long-term easement, license, or permit for use of the alternative parking shall be secured. All parking spaces required under section 17.57.040 of this chapter shall be located in a use district permitting the use which they serve. Old Harbor and Port Lions. The off-street parking and loading requirements of this chapter shall be computed at fifty percent (50%) of the total required for developments on the contiguous road systems of Old Harbor and Port Lions. Public facilities shall provide a minimum of three (3) off-street parking spaces. Residential land usesshall provide a minimum of one (1) off-street parking space per dwelling unit. All parking areas for one- and two-family dwellings shall be developed in accordance with this section. B.
