Dear Mr. and Mrs. Sutliff: Please be advised that a zoning compliance permit must be obtained from the Kodiak Island Borough prior to changing the use of land. It appears from recent advertisements that the property referenced above is now available for a land use other than that of the previous tenant, the Kodiak Daily Mirror. With the recent announcement that the Kodiak Daily Mirror is now constructing its own building at another location, it appears that any use locating on Lot 1, Block 19, Kodiak Townsite will require review by Borough staff through the zoning compliance permit process. The requirement for zoning compliance review is set forth in Sections 17.03.060.B and .D (Zoning Compliance), of the Borough Code, as shown below: 17.03.060 Zoning compliance. Zoning compliance is required for site grading (excavation and fill), erection, construction, establishment, moving, alteration, enlargement, repair, or conversion of any building or structure in any district established by this title, subject to the following: B. An application for zoning compliance will be filed with the community development department on a form provided by the department. If the application meets the requirements of this title, as verified in the department, and other applicable regulations, a permit will be issued. No building permit shall be issued by a building official until the community development department has verified from the application for zoning compliance for a proposed building that it conforms and will be occupied for a use in conformity with the provisions and regulations of this title, except that this provision shall not apply to building permits for residential structures when no yard or height changes are involved. Any building permit issued in conflict with this title is null and void. Zoning Compliance Permit number CZ -89-158 (attached) was issued on December 26, 1989, for the express purpose of repairing the fire damage to the structure that occurred late last year. At that time no change in use was proposed and it was assumed by staff that the Kodiak Daily Mirror would reoccupy the structure when the repairs were complete. Since this is not the case, a new zoning compliance form must be completed for any new land use that proposes to locate on the property. As with all changes in land use, such a change must be reviewed for compliance with existing applicable parking and zoning requirements. When reviewing a proposed land use, staff compares the parking requirement for the previous use of land with the new use proposed. If the new use requires additional off-street parking spaces, the spaces must be provided on the property, or a variance from the off-street parking requirements must be obtained from the Planning and Zoning Commission. There is no documentation on file of the previous use of Lot 1, Block 19, Kodiak Townsite. Therefore, a zoning compliance permit is required for any new use of the lot. We believe there is an apartment in the building, in addition to the floor area previously occupied by The Daily Mirror. A dwelling unit requires two (2) off-street parking spaces. The Daily Mirror was required to have a minimum of seven V) off-street parking spaces at the new location now under construction. Since these land uses are grandfathered on your Kodiak Island Borough Norman and Margaret Sutliff October 1, 1990 Page Three property, we believe that you have at least nine (9) nonconforming parking spaces on the property. You would only need to seek a variance if the proposed use of the property requires more than nine (9) off-street parking spaces. If you are planning to lease the property for a single predetermined use, such as residential, office or retail only, staff can review the parking requirements and zoning compliance criteria in advance of actual occupancy. If you are not sure what type of activity will be located on this property, or if the structure is intended to accommodate a number of different uses, then a separate zoning compliance permit will be necessary for each land use that is proposed for the structure prior to occupancy. Upon reading the account of the fire in the Kodiak Daily Mirror, we noticed that you intend to rebuild or repair the building and put it back in service. We would like to help you with this process in any way we can. Our reason for writing this letter, however, is to let you know that there are certain ordinances that apply to the reconstruction of nonconforming structures like the one located on Lot 1, Block 19, Kodiak Townsite. The building located on the lot referenced above is a nonconforming structure because it fails to meet the off-street parking requirements established for the Business Zoning District. As required by Kodiak Island Borough Code (KIBC) Chapter 17.57 (Off -Street Parking and Loading Requirements) office buildings are required .to provide one (1) off- street parking space for each three hundred (300) square feet of gross floor area (KIBC 17.57.020.A.2.a). In addition, a parking area serving a business use must provide at least three hundred fifty (350) square feet of developed parking area for each off-street parking space required (KIBC 17.57.040.F). Additionally, points of ingress from and egress to public streets shall be designed and located to minimize traffic congestion and hazards to pedestrians. The intent of the Borough Code with regard to nonconforming structures is illustrated by Section 17.36.020, which states: 17.36.040 Nonconforming structures. Where a lawful structure exists at the effective date of adoption or amendment of the ordinances codified in this title that could not be built under the existing terms of this chapter by reason of restrictions on area, lot coverage, height, yards, or other characteristics of the structure or its location on the lot, such structure may be continued so long as it remains otherwise lawful, subject to the following provisions: A. No such structure may be enlarged or altered in a way which increases its nonconformity. B. Should such structure be destroyed by any means to an extent of more than fifty percent of its replacement cost at time of destruction, it shall not be reconstructed except in conformity to the regulations for the provisions of this title.
