Request for variance from Section 17.36.070(C) (Nonconforming Structures) to permit the remodeling of a home including a one-story addition that increases the cubical content of the structure, a variance from Section 17.19.040(A) (Front Yards) permitting bay windows that encroach 8.7 feet into the required 17.8 foot front yard setback, a variance from Section 17.19.040(B) (Side Yards) to permit an entrance way that encroaches 14.4 inches into the required 6.5 foot side yard setback on the left side of the structure, and a parking deck that encroaches 6.5 feet into the required 6.5 foot side yard setback on the right side of the structure. CASE 84-001 1 February 8, 1985 12. Applicable Regulations: On any nonconforming structure or on any building devoted in whole or in part to any nonconforming use, work may be done in any period of twelve consecutive months on ordinary repairs, or on repair or replacement of nonbearing walls, fixtures, wiring or plumbing, provided that the cubical content of the building as it existed at the time of passage or amendment of the ordinance codified herein shall not be increased. COMMENTS 1. Nonconforming Structure: The applicant is proposing to construct an additional story onto an existing nonconforming residential structure. This home is nonconforming because it encroaches approximately 2 feet into the required 25 foot rear yard setback. (The lot line adjacent to High Street is considered the front lot line.) In addition, the proximity of the carport immediately adjacent to the house and the determination that the carport should be considered part of the house makes the structure as a whole nonconforming since it does not meet the required side yard setback of 6.8 feet. 2. Addition: The proposed addition measures approximately 24' x 24' and will be situated on a corner of the existing structure to take full advantage of the view (see drawing). Because of problems of rain associated with the existing flat roof, another sloped roof will extend from the addition to the edge of the current flat roof line (see figure #2). In order for the Commission to grant a variance all of the following conditions must be met: 1. Exceptional physical circumstances or conditions applicable to the property or to its intended use or development which do not apply generally to other properties in the same land use district. Lot 23 has been subdivided by metes and bounds with property access established by deed prior to the adoption of the zoning code. This method of subdivision has created situations where buildings may not meet current setback requirements. This lot is also moderately steep with the existing structure located on the lot's best building site. 2. Strict application of the provisions of this title would result in practical difficulties or unnecessary hardship. Any additions to this structure would require a variance. This addition will not encroach into any currently required setbacks upon completion. 3. The granting of the variance will not result in material damage or prejudice to other properties in the vicinity nor be detrimental to the public's health, safety or general welfare. Although the addition will partially interrupt the view of the neighbors behind this residence, those structures are generally higher on the hillside and command a wider panoramic view. CASE 84-001 2 February 8, 1985 4. The granting of the variance will not be contrary to the objectives of the comprehensive plan. The granting of this variance is not contrary to the objectives of the Comprehensive Plan which identifies this area for residential development. 5. Actions of the applicant did not cause special conditions or financial hardship or inconvenience from which relief is being sought by a variance.
