Therefore, this structure has "nonconforming" status according to Kodiak Island Borough Code (KIBC) Section 17.36.010. Please be advised that, according to KIBC Section 17.36.040 (enclosed), nonconforming structures are subject to three provisions: A. may not be enlarged or altered in a way which increases its nonconformity; B. if destroyed to an extent of more that 50% of its replacement cost, it shall be reconstructed only in conformity to zoning regulations; and C. if moved, it must thereafter conform to zoning regulations.
