The Commission lapbroved-Yoqr Peque§t-for-a; variance., _ . We wish to inform you that this decision of the Commission may be appealed to the Borough Board of Adjustment within 10 days of the Commission's action. The Borough Code of Ordinances states in Section 17.66.170 that any , variance is good for six months unless construction has been started. JOnes P & Z Secretary Kodiak Island Borough Planning and Zoning Commission Minutes January 16, 1980 Page 3 Mr. Pugh closed the regular meeting and onened the public hearing, Mr. JeffStevens with the Unites Fisherman's Marketing Association. What about grandfather rights? Would like to see that included. Mrs. Crowe questioned Mr. Stevens as to where he thought not storage would be a likely. Sue Painter in favor of Ordinance. Mrs. Arndt representing the meter readers. They would like to see a stipulation so that people do not stack pots and lines so that the meter readers can get to the meter without causing any danger to themselves. Mr. Olf Omlid opposed to Ordinance. MrS_Alwert in favor of Ordinance. Mr, Scott Arndt against Ordinance. Would like to see an area set aside for pot storage. Mr.. Pugh closed the public hearing and reopened the regular meeting.. Mr. Ball moved to recommend to the Borough Assembly that they postpone their next public hearing 1) to return to the Planning and Zoning Commissic for further study and 2) that all interested parties be notified that we will have a work session which would be strictly on not storage and try to come out of the work session with something that we could re -re- commend to the Borough Assembly. Seconded by Mr. Perez. If the Borough Assembly takes our recommendation this be brought back to the Planning and Zoning Commission we should try and have it completed by the April meeting'. Motion PASSED by unanimous roll call vote. 3. Z-79-057. A request for a variance to permit the constructionof an addition on an already existing structure in the second front yard on lot 24A, block 1, Aleutian Homes Subdivision. (Royal Large) STAFF REPORT: Mr. Milligan presented the staff report based on a memorandum prepared by the planning staff. Mr. Pugh closed the regular meeting and opened the public hearing. Hear- ing no comments Mr. Pugh closed the public hearing and reopened the reg- ular meeting. Mr. Baker agrees with Mr. Milligan on. the variance application. Mr. Ball moved to return to Mr. Large until such time that he answers all the questions on the applicationand resubmit to the Planning and Zoning Commission during their February 20, 1980, regular meeting. A D M , DATE: January 14, 1980 TO: Planning and Zoning Commission FROM: Planning Department SUBJ: Information Report RE: A request.for a variance to permit the expansion of an existing structure which will encroach into.'.a required front yard on lot 1C, block 13-, Kodiak Townsite. (Z-79-058) REQUEST: This is a request for a variance to permit construction of an addition to an existing single family dwelling:located on lot .1C, block 13, Kodiak Townsite Subdivision.. The applicant is seeking variances from section 17.36.010 B, (Expansion of existing non -conforming structure.), 17.18.030 1 (lot area) and 17.18.040 A (front yard setbacks). The applicant wishes to construct a master bedroom addition to an existing:one bedroom home which presently has a bedroom of less than the minimum size required under the building -code. SITE: THe petitioned property (lot 1) was'subdivided by deed prior to 1953, which pre dates current building and zoning code regulations. The . . site contains only 5,448 square feet,which is 1,752 square feet below the present required minimum lot area set forth in section 17.18.030 B 1 of the code of Ordinances. The existing house totally abuts the twenty-five (25) foot front yard required in section 17.18.040 A of the Code of Ordinances. The site is located on High Street above Hill Side Drive. The site has a severe topograhpic break and,is split by a small drainage creek. The existing, house is built on the only buildable site on this' lot and part of that is pile support. The steep topography and creek location' make this a difficult property to develop and impossible without variances. HISTORY: ' • Lot 1, block 13, Kodiak Townsite was'subdivided by deed into lots 1A, 18 and 1C, prior to 1953. This activity pre dates current platting, building and zoning regulations. Memorandum, pag January 14, 198, ANALYSIS: Section 17.66:090 of,the Zoning Ordinance sets forth the requirements for submission of a variance application. The applicant to date has not provided buildingelevations of the proposed construction. The applicant states in the applcation the existing situation is: "Small house made'up of -two rooms.. - The smalier.one is a shower room and a section of the larger room is . partitioned off as a small bedroom, J1'4" X Granting of this petitioh.would permit: "The addition of a master bedroom," The applicant has not provided evidence six months if this request is granted. The code further requires the applicant conditions exist: of ability to proceed within prove the following fou 1. That there are exceptional physical circumstances or conditions appicable to the Property or to its.intended use or development which do not apply generally to the other properties in the same land use'district. These special conditions are:. "That the house stands on the edge of the road with no yard on that side of the house." Staff finds there are exceptional physical conditions applicable to the property. The terain is steer and bisected by a drainage stream, The site is extremely difficult and expensive to build upon. We question whether a building could practically be built in a conforming location. 2. That the strict application of the provisions of this title would result in practical difficulties or unnecessary hardship: "The existing bedroom is only 11'4",X 6'9" and too small for a married couble. The minimum width in the Building code is 7 feet.," Staff agrees strict application of this title would result in unnecessary hardship. 3. That the granting of the variance will not result in material damage or prejudice to other properties in the vicinity not be detrimental -to the public health, Safety or welfare in that:. "The property is on the side of the hill, with no buildings directly behind it," Staff agrees granting thisvariancewill not result in material damage or prejudice to other properties in the area, 4. That the gran -Ling Of the_variance will not -be contrary to the object- ives of the Comprehensive Plan for the following reason: no answer. Staff finds the applicant'has not responed to this item. We find that the definition of a variance is appropriate in this instance. A variance is traditionally defined as "relaxation of the strict application of the regulations." Memorandum„ pagti. January. 14,- 1980 In this instance the variance requested is the minimum necessity to make reasonable use of the land, It is staff opinion this request is consistant with the objectives of the Comprehensive Plan.
